It names as defendants\u00a0the pharmacy benefit managers CVS Caremark, Express Scripts and OptumRx, as well as drug manufacturers Eli Lilly, Novo Nordisk and Sanofi.<\/p>\n<p><b>MORE:\u00a0<\/b><a href=\"https:\/\/www.phillyvoice.com\/norovirus-symptoms-stomach-bug-prevent-treatment-\/\" rel=\"nofollow noopener\" target=\"_blank\">With norovirus cases on the rise, here&#8217;s how to prevent the &#8216;stomach bug&#8217;<\/a><\/p>\n<p>Philadelphia is one of more than 550 <a data-original-title=\"\" href=\"https:\/\/www.13newsnow.com\/article\/news\/state\/virginia-sues-over-alleged-insulin-price-inflation-targeting-pharma-giants\/291-98df4139-c323-4262-915b-d45c7db916bd\" style=\"font-size: 1.2em;\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">state<\/a> and <a data-original-title=\"\" href=\"https:\/\/www.ctinsider.com\/waterbury\/article\/torrington-ct-lawsuit-insulin-cost-20871743.php\" style=\"font-size: 1.2em;\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">local<\/a> jurisdictions, <a data-original-title=\"\" href=\"https:\/\/www.keranews.org\/health-wellness\/2025-04-14\/texas-health-resources-insulin-price-lawsuit\" style=\"font-size: 1.2em;\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">companies<\/a> and unions \u2013 including  <a data-original-title=\"\" href=\"https:\/\/www.buckscounty.gov\/m\/newsflash\/Home\/Detail\/1301\" style=\"font-size: 1.2em;\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">Bucks County<\/a> and the <a data-original-title=\"\" href=\"https:\/\/whyy.org\/articles\/university-of-pennsylvania-lawsuit-price-fixing-drugs\/\" style=\"font-size: 1.2em;\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">University of Pennsylvania<\/a> \u2013 that run their own insurance plans and have sued these drug manufacturers and pharmacy benefit managers over alleged insulin price-fixing schemes.<\/p>\n<p>California will be the first state to start selling low-cost insulin in January, bypassing pharmaceutical companies and <a data-original-title=\"\" href=\"https:\/\/www.ama-assn.org\/health-care-advocacy\/access-care\/what-are-pharmacy-benefit-managers-pbms-and-why-we-need-reform#:~:text=on%20PBM%20reform-,What%20are%20PBMs%20and%20what%20do%20they%20do?,and%20higher%20prescription%20drug%20prices.\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">pharmacy benefit managers<\/a>, which act as middlemen between pharmaceutical companies, health insurance companies and pharmacies in negotiating drug costs.\n<\/p>\n<p>\nAlongside other prescription drugs, the price of insulin has skyrocketed over the last 20 years. Insulin was about $20 a vial in the 1990s. Today, it costs $300 to $700 a vial \u2013 even though it costs about $2 to make, Philadelphia&#8217;s lawsuit claims.<\/p>\n<p>&#8220;Instead of working to make essential drugs, like insulin, accessible to the people that need them, these companies operated a scheme to drive prices up at the expense of patients and insurers like the City of Philadelphia,&#8221; City Solicitor Renee Garcia said in a news release.\n<\/p>\n<p>\nThe pricing scheme has forced the city to overpay for insulin for the 30,000 employees and families covered under its health insurance plan, the lawsuit claims.\u00a0<\/p>\n<p>About 14% of adults in Philadelphia have diabetes \u2014 one of the highest rates in the country, according to the complaint.\u00a0<a href=\"https:\/\/www.mayoclinic.org\/diseases-conditions\/diabetes\/in-depth\/diabetes-treatment\/art-20044084\" style=\"font-size: 1.2em;\" rel=\"nofollow noopener\" target=\"_blank\">Insulin<\/a>\u00a0helps keep blood sugar under control and prevent diabetes complications.\u00a0<\/p>\n<p>&#8220;Thanks to medications like insulin, Philadelphians suffering from diabetes can live a full, healthy life,&#8221;\u00a0Health Commissioner Palak Raval-Nelson said in the news release.\u00a0\u00a0&#8220;&#8230; When people cannot afford their insulin, they frequently go without or cut back, leading to disastrous consequences both for themselves and Philadelphia as a whole.&#8221;<\/p>\n<p>The city is seeking damages, alleging that the drug companies have violated the\u00a0<a data-original-title=\"\" href=\"https:\/\/www.law.cornell.edu\/wex\/rico\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">Racketeer Influenced and Corrupt Organizations Act<\/a>\u00a0and the\u00a0<a data-original-title=\"\" href=\"https:\/\/www.attorneygeneral.gov\/wp-content\/uploads\/2018\/02\/Unfair_Trade_Practices_Consumer_Protection_Law.pdf\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">Pennsylvania Unfair Trade Practices and Consumer Protection Law<\/a>.<\/p>\n<p>&#8220;Novo Nordisk believes that the allegations against it are meritless, and we intend to vigorously defend against these claims,&#8221; the company said in an emailed statement. &#8220;While we will not comment further about pending litigation, we recognize that not all patient situations are the same and we have a number of different insulin affordability offerings available through NovoCare. Importantly, we continually review and revise our offerings as well as work with diverse stakeholders to create solutions for differing patient needs.&#8221;\u202f<\/p>\n<p>CVS Caremark provided an emailed statement reading: &#8220;Pharmaceutical companies alone are responsible for the prices they set in the marketplace for the products they manufacture. Nothing in our agreements prevents drug manufacturers from lowering the prices of their insulin products and we would welcome such an action.
