The Supreme Court yesterday blocked President Donald Trump<\/a> from deploying the National Guard in the Chicago area to bolster his mass deportation<\/a> push. \u201cAt this preliminary stage, the government has failed to identify a source of authority that would allow the military to execute the laws in Illinois,\u201d the court said in an unsigned emergency docket opinion<\/a>. Three conservative justices \u2014 Samuel Alito, Clarence Thomas and Neil Gorsuch \u2014 publicly dissented.\u00a0<\/p>\n

Who said what<\/p>\n

The ruling was a \u201crare setback\u201d for Trump before a conservative Supreme Court<\/a> that has \u201cfrequently backed his broad assertions of presidential authority,\u201d Reuters<\/a> said. This was the \u201cfirst time the justices have weighed in on Trump\u2019s efforts to dispatch the military to American cities,\u201d The Wall Street Journal<\/a> said, and their \u201cpreliminary\u201d ruling suggests they are \u201cunwilling to rubber-stamp Trump\u2019s assertions of broad authority to use the National Guard to manage protests and violent crime.\u201d\u00a0<\/p>\n

Yesterday\u2019s ruling \u201chinged on the definition of \u2018regular forces,\u2019\u201d the Journal said. Lower courts had blocked Trump\u2019s deployment after determining that anti-ICE protests aren\u2019t a brewing \u201crebellion,\u201d but the justices found that Trump had failed to meet the other condition needed to nationalize the Guard over the objections of state officials: showing he was \u201cunable with the regular forces to execute the laws of the United States.\u201d The court\u2019s majority agreed with Illinois that \u201cregular forces\u201d likely meant the U.S. military, not federal agents. They also noted that presidents can only use the regular military for domestic law enforcement under \u201cexceptional\u201d circumstances because of the 1878 Posse Comitatus Act.\u00a0<\/p>\n

Illinois Gov. JB Pritzker (D) welcomed the ruling<\/a> as \u201can important step in curbing the Trump administration\u2019s consistent abuse of power and slowing Trump\u2019s march toward authoritarianism.\u201d The White House said the ruling doesn\u2019t detract from Trump\u2019s \u201ccore agenda\u201d of immigration enforcement and protecting federal personnel from \u201cviolent rioters.\u201d<\/p>\n

What next?<\/p>\n

The decision was \u201cnot a final ruling,\u201d but it could affect pending legal challenges to Trump\u2019s \u201cattempts to deploy the military in other Democratic-led cities,\u201d The Associated Press<\/a> said. Lower courts have blocked Trump\u2019s deployments in Oregon and California. But some Republican governors have welcomed National Guard missions in their Democratic-run cities, and minutes after yesterday\u2019s ruling, Louisiana Gov. Jeff Landry<\/a> (R) announced that about 350 Guard troops will join immigration agents in New Orleans before New Year\u2019s Eve.<\/p>\n
