{"id":47218,"date":"2025-07-07T23:37:09","date_gmt":"2025-07-07T23:37:09","guid":{"rendered":"https:\/\/www.europesays.com\/us\/47218\/"},"modified":"2025-07-07T23:37:09","modified_gmt":"2025-07-07T23:37:09","slug":"23andme-founder-can-re-acquire-company-after-judge-rejects-californias-attempt-to-delay-sale","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/47218\/","title":{"rendered":"23andMe founder can re-acquire company after judge rejects California\u2019s attempt to delay sale"},"content":{"rendered":"<p><a style=\"display:block\" href=\"https:\/\/www.theglobeandmail.com\/resizer\/v2\/PMV2OCMYTBCLTI4DHCXYBC4OHQ.jpg?auth=a31da0ec588e05da8d2118daac3201700ee5f41b680758d1550ea084ed86d87e&amp;width=600&amp;height=400&amp;quality=80&amp;smart=true\" aria-haspopup=\"true\" data-photo-viewer-index=\"0\" rel=\"nofollow noopener\" target=\"_blank\">Open this photo in gallery:<\/a><\/p>\n<p class=\"figcap-text\">TTAM Research, 23andMe founder Anne Wojcicki\u2019s new non-profit, won a bankruptcy auction for the genetic testing company\u2019s assets in June.TING SHEN\/AFP\/Getty Images<\/p>\n<p class=\"c-article-body__text text-pr-5\">Genetic testing company 23andMe can proceed with a US$305-million sale to the company\u2019s co-founder Anne Wojcicki after a U.S. bankruptcy judge rejected California\u2019s bid to delay the sale while the state appeals over privacy concerns related to the deal.<\/p>\n<p class=\"c-article-body__text text-pr-5\">U.S. Bankruptcy Judge Brian Walsh, who previously approved Wojcicki\u2019s buyout of the company, said in a court hearing in St. Louis that California\u2019s appeal was \u201clikely to fail\u201d and that California customers would not be \u201cirreparably harmed\u201d if the sale went forward while the state appealed.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cThey remain free to delete their accounts and data at any time,\u201d Walsh said of 23andMe\u2019s California customers.<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/business\/economy\/article-23andme-did-not-protect-customers-data-canadian-and-british-watchdogs\/\" rel=\"nofollow noopener\" target=\"_blank\">23andMe did not protect customers\u2019 data, Canadian and British watchdogs find<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">23andMe <a href=\"https:\/\/www.theglobeandmail.com\/canada\/article-23andme-bankruptcy-dna-samples-for-sale\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/article-23andme-bankruptcy-dna-samples-for-sale\/\">filed for bankruptcy in March<\/a>, seeking to sell its business after a drop-off in consumer demand and a 2023 data breach that exposed millions of customers\u2019 genetic data.<\/p>\n<p class=\"c-article-body__text text-pr-5\">California had argued the sale violates the state\u2019s Genetic Information Privacy Act, which prohibits the transfer and disclosure of genetic data or biological samples to third parties, including Wojcicki\u2019s new non-profit TTAM Research.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The state had sought to prevent California customers\u2019 data from being transferred, a step that 23andMe said would effectively kill the sale. California consumers represent about 1.8 million of the approximately 10 million genetic profiles in 23andMe\u2019s inventory, according to California\u2019s court filings.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cEveryone knows that this is a sale of DNA to a third party,\u201d California\u2019s attorney Bernard Eskandari said in court. \u201cIt has always been a sale of DNA to a third party.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">TTAM Research won a bankruptcy auction for 23andMe\u2019s assets in June, overbidding a US$265-million offer from Regeneron Pharmaceuticals.<\/p>\n<p class=\"c-article-body__text text-pr-5\">TTAM said it would continue to protect customers\u2019 genetic data and maintain 23andMe\u2019s privacy policies, including customers\u2019 right to delete their data. Wojcicki was 23andMe\u2019s CEO before its bankruptcy filing, and her new nonprofit\u2019s name is an acronym formed from the first letters of the words \u201ctwenty-three and me.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Several other U.S. states, including New York and Texas, also opposed the sale and said that their state laws also prevent the sale of customers\u2019 genetic data without their consent.
