A single envelope slid through the metal bars into his cell.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000k3b6pvd76lwc0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He stared at the return address in disbelief.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000l3b6pluzccf6c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It was from the man he believed fired the fatal shot in a killing that had put McDowell behind bars in New York City. The man he believed should have been arrested \u2013 not him.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000m3b6ps01swd56@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He tore open the envelope. The words hit like a punch.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000n3b6pwwzivxyn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Emel, you know me and you were friends for a very long time. And that incident that occurred\u2026 should not break our friendship, the letter said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000o3b6p7hjluoib@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Emel, don\u2019t think for one bit that cause I\u2019m out here I\u2019m not suffering&#8230; I don\u2019t think I deserve to walk the face of the earth because one of my best friends is locked up, for something that he didn\u2019t do.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000p3b6ptpopir8b@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The \u201cincident\u201d occurred three months earlier at a Brooklyn house party, when McDowell said his friend opened fire during an altercation, killing a 19-year-old man.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000q3b6po8lfyxk5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI\u2019m sitting here charged with murder, trying to adjust to being in jail,\u201d McDowell told CNN this month. \u201cI had just spent my first birthday incarcerated. I had spent my first Christmas (incarcerated). My first New Year. And to get this letter \u2026 it opened a lot of wounds.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000r3b6p4zvdyj8r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell believed the letter, hand-written on unlined paper and dated January 1991, would clear his name. He gave it to his court-appointed attorney, and trusted justice would prevail.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000s3b6p9rz7eqwq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It didn\u2019t \u2014 not for a long time.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000t3b6p0wmotlcf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Despite conflicting witness accounts and the letter from the alleged killer suggesting McDowell had nothing to do with the shooting, a jury convicted him of murder and weapon possession.  He was sentenced to 22 years to life in prison.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000u3b6p0wcvxpiu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The letter stayed with him. He tucked it inside a brown Bible beside his bed in prison, still believing it was key to his freedom.\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/12\/real-blount-letter-1.jpg\" alt=\"The first page of the letter Emel McDowell received in jail in early 1991.\" class=\"image__dam-img image__dam-img--loading\" onload=\"this.classList.remove('image__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"3228\" width=\"2500\" loading=\"lazy\"\/><\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000v3b6puv8gb0rp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            From behind bars, McDowell launched a relentless campaign to prove his innocence. He cold-called lawyers, activists and journalists to tell them about the letter. He took paralegal classes in prison, earned college credits and helped other inmates draft legal briefs. He filed his own appeal.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000w3b6progz6xep@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Years passed, and his hope faded. The letter\u2019s fraying edges and deepening creases became a symbol of his long fight for justice.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000x3b6pr2zscjbp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Then in December 2009, prosecutors offered him a deal: plead guilty to manslaughter and walk free with time served.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000y3b6p8gl5wlt9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt was an opportunity to get home with my family for Christmas after spending 19 years and two months in prison for something I didn\u2019t do,\u201d McDowell said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj000z3b6puow60e9t@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He took it and left prison a free man who was still guilty in the eyes of the law. But freedom without exoneration was not justice, he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00103b6p98pdhdhm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Finally, more than 13 years later, came the vindication he had long sought. The Brooklyn District Attorney\u2019s Office <a href=\"https:\/\/michelenlaw.com\/after-19-years-brooklyn-mans-name-is-finally-cleared-in-1990-murder-im-going-to-exhale\/\" target=\"_blank\" rel=\"noopener\">vacated his conviction<\/a> in March 2023 after <a href=\"https:\/\/brooklynda.org\/2023\/03\/16\/brooklyn-district-attorney-moves-to-vacate-wrongful-conviction-of-man-who-pleaded-guilty-to-manslaughter-after-real-killer-confessed\/\" target=\"_blank\" rel=\"noopener\">it said<\/a> McDowell\u2019s friend confessed to the shooting.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00113b6p8mai5gfr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Last year, McDowell received a $9 million settlement in a wrongful conviction lawsuit against New York City and several police officers.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00123b6prus5nfwz@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Now he\u2019s filed a claim against the state, citing, among other arguments, his forced labor and lost wages while working for pennies an hour in prison, a situation his attorney compares to a modern form of slavery.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00133b6p1uh58sgx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Almost 35 years later, the fight that started before that single envelope fluttered into his cell is not over.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00143b6pz1w0pyx7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cEvery time I looked at that letter, I cried, I got emotional,\u201d he said. \u201cI stopped reading it now because it opens old wounds.\u201d\n    <\/p>\n<p class=\"paragraph_drop-cap-elevate inline-placeholder vossi-paragraph_drop-cap-elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00163b6pj5a31uwt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell\u2019s parents separated when he was 10. His mother raised him and his younger brother in Brooklyn.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00173b6pkuy04tcb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            By the fall of 1990, he was a high school honor student set to graduate and enlist in the Army. His goal was to later transition to the Air Force and become a pilot.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00183b6p3s4k8y3d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The night he went to the house party that October, his mother had asked him to stay home. But he was 17 and wanted to spend time with his girlfriend, so he went anyway, he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj00193b6p30gr9shd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A melee broke out at the party involving a friend of McDowell\u2019s. Another friend \u2013 the one who sent him the letter \u2013 pulled out a gun and opened fire, he said. McDowell told investigators that he grabbed his girlfriend\u2019s arm and fled the scene.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001a3b6p3147ecfv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The shooting left 19-year-old Jonathan Powell dead and ultimately shattered the lives of two families. Once he left the party shortly after midnight, McDowell went to a different friend\u2019s house for a sleepover, not knowing it would be his last night of freedom.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001b3b6paovnehx3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The next morning, his mother told him to return home immediately.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001c3b6pg4jcsggs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI walked straight to my house about eight blocks away. And when I got there, my mother said, \u2018Oh, the detective was here looking for you.\u2019 I said, \u2018For what? And she was like, \u2018About the boy who got shot.\u2019\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001d3b6p4i94f26f@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            His mother urged him to go to the precinct and find out what they wanted.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001e3b6pcfnmg151@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cMy mother didn\u2019t even come with me because in both our minds, I didn\u2019t have anything to do with it. I wasn\u2019t even involved in the fight,\u201d he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001f3b6pc2ywk5f2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At the precinct, McDowell said he was taken straight to the homicide division, where detectives accused him of murder. He never made it back home.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001g3b6p0509oavg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Within 24 hours, police charged him with the crime. Despite conflicting witness statements, detectives didn\u2019t follow up on the accusations against his friend, the Brooklyn District Attorney\u2019s Office <a href=\"https:\/\/brooklynda.org\/2023\/03\/16\/brooklyn-district-attorney-moves-to-vacate-wrongful-conviction-of-man-who-pleaded-guilty-to-manslaughter-after-real-killer-confessed\/\" target=\"_blank\" rel=\"noopener\">said later<\/a> in a statement.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001h3b6psawymn0l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Two witnesses identified McDowell as the shooter while several others indicated it was his friend, the district attorney\u2019s office said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001i3b6pvequjwel@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The gun used in the killing was never recovered.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001j3b6p0122797x@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In the letter, his friend, who was at the house party with him, said he was haunted by what happened that night.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001k3b6pz229yypi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Don\u2019t think for a minute that I\u2019m out here rejoicing, the friend wrote in the letter. Man, I\u2019m suffering. I have nightmares, I can\u2019t sleep or eat. Sometimes I just pray for death. \u2026 P.S. Try &amp; keep our letters confidential.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001l3b6przuyvowd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell said on the day he was arrested, he told investigators at the precinct that his friend did it. (Years later, after being convicted and serving time in prison, the men <a href=\"https:\/\/www.cnn.com\/2019\/06\/19\/us\/central-park-five-where-now-trnd\" target=\"_blank\" rel=\"noopener\">were exonerated<\/a> after a serial rapist confessed to the attack.)\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001n3b6patuadrdd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe political climate back then was do something about these horrible crime rates in NYC, particularly juvenile criminals,\u201d McDowell said. \u201cSo, the cops wanted to get numbers, and I looked like a good candidate: Seventeen, Black, unique name, was present at the party and from a working-class family headed by a single mother.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001o3b6p5qz63taq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In his letter, McDowell\u2019s friend stopped short of a full confession but said enough to prompt an investigation, said Oscar Michelen, McDowell\u2019s current lawyer.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139cj001p3b6p0z4wtan0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cEmel understood what he meant by it, and he told his lawyer (at the time) that his friend \u2026 did it,\u201d Michelen said. \u201cSo, the friend\u2019s name was known to everybody and there were things that could have been done to establish that it was him, like subpoenaing him, putting any pressure on him. He couldn\u2019t believe he was going to prison at 19 for a murder he didn\u2019t commit.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck001w3b6pzbxsarbc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAs a young man, I believed that the criminal justice system had a way of sorting things out. So, when I went to trial in 1992 \u2026 I never in my wildest dreams thought I would get convicted,\u201d he said. After the verdict, he said, \u201cI was numb. I was like, \u2018This is it, I\u2019m done. My life is over. I\u2019m never gonna breathe free air again.\u2019 \u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck001x3b6pawldvtbf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            After a stint in Rikers Island, McDowell was shuttled to the Elmira Correctional Facility in upstate New York, where he became inmate No. 92A5351.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck001y3b6pbagl02js@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Over his years of incarceration, he moved through several state prisons. But with every transfer, he held onto his Bible. It kept safe his most prized possession. Some nights, he\u2019d run his fingers through its pages to make sure the letter was still there.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck001z3b6ph8ru3v5n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI took my Bible with me wherever I went,\u201d he said. \u201cThat letter was a symbol of hope that the truth would eventually come to light.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00203b6pp8lldsoh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            It also gave him a sense of purpose.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00213b6psnji8h2u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At one prison, Great Meadow Correctional Facility in Comstock, professors from nearby Skidmore College visited to teach classes to inmates. The training proved so effective that McDowell taught legal research classes at another prison. He helped other inmates file legal briefs challenging their cases \u2014 even as he continued to work on his own.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00233b6pil1iko8d@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In 1995, a state appeals court denied a motion by McDowell challenging his conviction. Not one to give up, he later sent his file to several attorneys. One of them was Michelen.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00243b6peklxjb3o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt was so organized \u2026 I was impressed with the fact that it was written pro se by an inmate,\u201d he said. \u201cAnd I thought he\u2019d set out good facts. So, we did some additional investigation, and I decided to take the case.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00253b6pwf5mn1lm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In December 2009, just before a hearing on whether to vacate his conviction, prosecutors offered him a deal to plead guilty to manslaughter under an agreement that allowed him to be released from prison. As part of the deal, he admitted to taking part in the crime but not shooting the victim, Michelen said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00263b6plbccky38@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell briefly considered rejecting the deal and fighting for full exoneration, but he did not trust the justice system after it failed him once, he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00273b6p6oye6kd0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He chose freedom.\n    <\/p>\n<p class=\"paragraph_drop-cap-elevate inline-placeholder vossi-paragraph_drop-cap-elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00293b6ptc5frxz6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell began fighting his case from outside prison. He learned how to use his mother\u2019s computer and the internet, diving into a digital world unavailable to him before prison.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002a3b6pmeu4npil@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            After years of legal groundwork, he and his lawyer reached out to the Brooklyn District Attorney\u2019s Office and asked prosecutors to review the case.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002b3b6pg71318wt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In March 2023, with a different chief prosecutor in office, their efforts finally paid off. District Attorney Eric Gonzalez, who was elected in 2017, announced that an investigation by his office\u2019s Conviction Review Unit had determined that McDowell was innocent and moved to vacate his conviction.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002c3b6pi8ie6vcm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell\u2019s friend had confessed to the unit\u2019s investigators and said he fired the gun in self-defense, the District Attorney\u2019s Office said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002d3b6pxco43mtq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cOur legal system failed Emel McDowell when he was wrongfully convicted of murder in 1990 and his release years later was conditioned on an admission to a crime he did not commit,\u201d Gonzalez said in a 2023 statement.  \u201c\u2026Today we will ask to give him his good name back. As prosecutors, it is our obligation to do justice in every case.\u201d\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/12\/img-7021-20251219191824028.jpg\" alt=\"Brooklyn District Attorney Eric Gonzalez shakes hands with McDowell following a 2023 hearing vacating McDowell's sentence.\" class=\"image__dam-img image__dam-img--loading\" onload=\"this.classList.remove('image__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"1868\" width=\"2500\" loading=\"lazy\"\/><\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002e3b6po9fxnlvs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A law enforcement source confirmed to CNN that the friend who the DA\u2019s office said confessed to the killing was the same person who wrote the letter to McDowell back in 1991.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002f3b6p7gcukgsg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Authorities said they have determined the friend acted in self-defense that night at the party and do not plan to file charges.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002g3b6pcyvarwuq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            For McDowell, the battle goes on.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002h3b6p3lvp81l8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In his civil claim against the state, he argues that he\u2019s owed compensation for being forced to work in prison for almost two decades and for missing out on years of income he likely would have earned if he hadn\u2019t been incarcerated. Similar legal actions have been brought in New York and other states.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002i3b6puxea7s6v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI\u2019ve given you free labor for years, at pennies on a dollar \u2026 and I was wrongfully convicted,\u201d McDowell said. \u201cYou forced labor out of me. You don\u2019t get to keep it. You have to compensate me for that.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002j3b6p4nuv6twa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Although McDowell received millions in his wrongful-conviction settlement with New York City, the state owes him damages over his forced free labor, Michelen said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002k3b6pigwlyfsb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt\u2019s easy for people who were not honor roll high school seniors and had their lives torn apart for 19 years to attempt to devalue life and someone\u2019s experience,\u201d he told CNN.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002l3b6p66quj26q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The New York state attorney general\u2019s office declined to comment on the lawsuit.\n    <\/p>\n<p class=\"paragraph_drop-cap-elevate inline-placeholder vossi-paragraph_drop-cap-elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002n3b6pcefvrqaf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell was 17 when he was first jailed. He was released from prison in his late 30s. Now he\u2019s 53.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002o3b6pcirh4y4k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            No amount of money can make up for what he lost while behind bars, he said.\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/12\/still-22211764-25943-665-still.jpg\" alt=\"McDowell speaks after a court hearing vacating his sentence. \u201cPeople think after an exoneration that we go on to live like any other citizen. That\u2019s a myth,\" he=\"\" told=\"\" cnn.=\"\" class=\"image__dam-img image__dam-img--loading\" onload=\"this.classList.remove('image__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"1588\" width=\"2500\" loading=\"lazy\"\/><\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002p3b6pdv7z81yl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            His father died when he was in prison, and he never got a chance to reconnect with him, he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002q3b6popu1r3y2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Sometimes, he wonders what his life would be like now if he\u2019d never been wrongfully convicted.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002r3b6p8y9dqwtj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI didn\u2019t get the life experiences that most youth have \u2026 school, work, girls \u2026\u201d he said. \u201cIf I was able to accomplish the things that I have now with my roadblocks, what could I have accomplished in life? Where would I be now?\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002s3b6p78yjsv1m@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Though his exoneration is a welcome step, the stigma of a felony conviction never really goes way, he said. CNN ran a nationwide criminal background search on McDowell and the results show his manslaughter conviction but no mention of him being exonerated.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002t3b6p6m2otmgr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            CNN also ran a similar search in New York state, which shows no results under McDowell\u2019s name. That means his case file has been sealed, a law enforcement source said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002u3b6pgvdbr6w8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But McDowell said he still must constantly prove himself to people who judge him for his conviction and prison term.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002v3b6pfrv3h1q4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Exonerees face extra hurdles, he said. When adopting children, opening certain businesses like liquor stores or applying for professional licenses to practice law or real estate, they can be required to submit detailed records and sworn statements, he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002w3b6pqa466b6c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cPeople think after an exoneration that we go on to live like any other citizen. That\u2019s a myth. Particularly in New York state, where they only seal the record, not expunge it,\u201d he said. \u201cThere is never really justice.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002x3b6p7fmupoie@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            McDowell has a real estate license and works on contract with law firms to help them prepare motions. He said his goal is to go to law school and become an attorney who does a broad range of legal work \u2013 including wrongful conviction cases.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002y3b6ppmqcmszm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI didn\u2019t come this far in my life to be pigeonholed,\u201d he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck002z3b6pezqq77l4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And he no longer looks at the letter \u2014 it brings back too many painful memories. He gave it to his attorney for safekeeping as a reflection of where he\u2019s been.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmjn139ck00303b6pm29s50nm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Instead, he\u2019s looking ahead.
