{"id":50035,"date":"2025-07-09T00:24:13","date_gmt":"2025-07-09T00:24:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/50035\/"},"modified":"2025-07-09T00:24:13","modified_gmt":"2025-07-09T00:24:13","slug":"family-sues-san-diego-county-over-fatal-shooting-by-deputies","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/50035\/","title":{"rendered":"Family sues San Diego County over fatal shooting by deputies"},"content":{"rendered":"<p>The family of a mentally ill man who was <a href=\"https:\/\/www.sandiegouniontribune.com\/2024\/11\/27\/investigators-release-footage-showing-deputies-fatally-shoot-armed-man-in-spring-valley\/\" target=\"_blank\" rel=\"noopener\">shot and killed last year<\/a> by sheriff\u2019s deputies after showing up with a gun at his ex-girlfriend\u2019s Spring Valley home has filed a wrongful death and excessive force lawsuit against the county and the <a href=\"https:\/\/www.sandiegouniontribune.com\/2024\/11\/21\/investigators-identify-7-deputies-involved-in-fatal-spring-valley-shooting\/\" target=\"_blank\" rel=\"noopener\">seven deputies who opened fire<\/a>.<\/p>\n<p>The lawsuit, filed last week in San Diego federal court, claims that 34-year-old Victor Rendon Jr. \u201cbegan to bring the firearm up to his own head\u201d and was not pointing it toward the deputies when they shot and killed him in November at a home in the La Presa area.<\/p>\n<p>The San Diego County Sheriff\u2019s Office, in <a href=\"https:\/\/www.youtube.com\/watch?v=IL40wQ_h6lc&amp;rco=1\" target=\"_blank\" rel=\"noopener\">edited video footage of the shooting<\/a> released last year, said Rendon pointed the gun at deputies after he had earlier fired multiple rounds in an unknown direction. The county District Attorney\u2019s Office also declared that Rendon \u201craised and pointed the firearm toward the deputies,\u201d according to a <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/07\/04\/da-wont-file-charges-in-7-police-shootings-around-san-diego-county\/\" target=\"_blank\" rel=\"noopener\">review released Thursday<\/a> that <a href=\"https:\/\/www.sdcda.org\/content\/MediaRelease\/2025\/24-159PS%20Rendon.pdf\" target=\"_blank\" rel=\"noopener\">found the deputies bear no state criminal liability.<\/a><\/p>\n<p>Filed by Rendon\u2019s minor son and father, the lawsuit alleges excessive force and wrongful death, among other claims. It also contends the county failed to properly train the deputies and maintains policies or customs that are unconstitutional.<\/p>\n<p>The suit seeks damages in excess of $20 million.<\/p>\n<p>\u201cIt\u2019s a situation where there\u2019s a lot (the deputies) could have done for somebody who was clearly having a mental health crisis, but instead they treated it like an armed standoff and opened fire at the first sign of provocation they thought they saw,\u201d the family\u2019s attorney, David Finn, said Monday. \u201cHe didn\u2019t have to die.\u201d<\/p>\n<p>The county and the Sheriff\u2019s Office, which do not typically comment on pending litigation, did not respond to requests for comment.<\/p>\n<p>The shooting occurred the evening of Nov. 15 after Rendon\u2019s ex-girlfriend called 911 to report he showed up unannounced and entered her home on Leland Street, according to audio of the 911 call previously released by the Sheriff\u2019s Office. The woman said Rendon had a gun and she didn\u2019t feel safe with him there, though she also stated twice that \u201che\u2019s not trying to hurt me with it.\u201d<\/p>\n<p>She described Rendon as \u201cdisoriented and under the influence of something,\u201d said that he had \u201cmental issues\u201d and reported that he was talking to voices in his head, according to the 911 recording. She said she was outside the home, but her children were still inside.<\/p>\n<p>According to the Sheriff\u2019s Office, deputies arrived and safely retrieved the children after Rendon exited onto the back patio area. Over the next few hours, the deputies tried to convince Rendon to surrender, but he \u201cshowed no indication of compliance\u201d and at least once appeared to smoke narcotics on the back patio, according to the Sheriff\u2019s Office video and the district attorney\u2019s review.<\/p>\n<p>Footage released by the Sheriff\u2019s Office showed that for a period of about 30 minutes toward the end of the standoff, Rendon went in and out of the home\u2019s front door multiple times while deputies crouched behind vehicles with\u00a0their weapons trained on him.<\/p>\n<p>The Sheriff\u2019s Office said last year that upon exiting the home one final time, Rendon raised his pistol toward the deputies, who shot and killed him. One video provided by sheriff\u2019s officials, taken from a deputy\u2019s helmet-mounted camera, does not show clearly the moment Rendon allegedly raised the weapon. Footage from a sheriff\u2019s helicopter showed Rendon raising his arm, but the grainy video does not show clearly whether the gun went toward deputies or his own head.<\/p>\n<p>The lawsuit alleges the seven deputies combined fired at least 30 shots at Rendon, striking him at least 10 times.<\/p>\n<p>\u201cBased on the number of shots fired, the Defendants appeared to engage in \u2018contagious fire,\u2019\u201d the lawsuit alleges, contending that such an act constitutes excessive use of force and violates the sheriff\u2019s use-of-force policy, California law enforcement guidelines, state statutes and the U.S. Constitution.<\/p>\n<p>The lawsuit also alleges the deputies should have called out the county\u2019s Psychiatric Emergency Response Team, known as PERT, but failed to do so despite being aware that Rendon \u201csuffered from serious mental health issues \u2026 that required immediate care and treatment.\u201d<\/p>\n<p>In its review of the case, the District Attorney\u2019s Office found the deputies \u201creasonably believed Rendon presented an imminent threat of death or serious bodily injury.
