{"id":506852,"date":"2026-01-10T19:46:56","date_gmt":"2026-01-10T19:46:56","guid":{"rendered":"https:\/\/www.europesays.com\/us\/506852\/"},"modified":"2026-01-10T19:46:56","modified_gmt":"2026-01-10T19:46:56","slug":"judge-denies-mistrial-in-uvalde-officer-case-nbc-5-dallas-fort-worth","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/506852\/","title":{"rendered":"Judge denies mistrial in Uvalde officer case \u2013 NBC 5 Dallas-Fort Worth"},"content":{"rendered":"<p>Testimony is set to resume Thursday in the trial of a former Uvalde school police officer charged for his response to the 2022 shooting at <a href=\"https:\/\/www.nbcdfw.com\/tag\/uvalde-school-shooting\/\" target=\"_blank\" rel=\"noopener\">Robb Elementary School that killed 19 children and two adults<\/a>, after a judge denied a defense motion for a mistrial on Wednesday.<\/p>\n<p>The trial of former Uvalde school officer Adrian Gonzales continued Wednesday without a jury present following testimony from a former teacher that prompted the defense to seek a mistrial.<\/p>\n<p>The witness told jurors Tuesday that she saw the shooter approach the school from an area near where Gonzales was positioned. Gonzales\u2019 defense team argued the detail had never been disclosed before and said it significantly affected their trial strategy.<\/p>\n<p>Defense attorneys asked Judge Sid Harle to declare a mistrial. Harle denied the request, ruling that other remedies were sufficient.<\/p>\n<p>\u201cOn that motion for mistrial, I\u2019m going to find it\u2019s denied,\u201d Harle said. \u201cI think the remedies available are sufficient to protect the due process rights of the defendant.\u201d<\/p>\n<p>\t\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2026\/01\/UVALDE-TRIAL-5PKG-01-07-2026-03.59.15-PM_2026-01-07-17-04-25.jpg\" loading=\"lazy\"   alt=\"Judge Sid Harle, Wednesday, Jan. 7, 2026.\"\/><\/p>\n<p>\t\t\t\tWOAI-TV<\/p>\n<p>\t\t\tWOAI-TV<\/p>\n<p>Judge Sid Harle, Wednesday, Jan. 7, 2026.<\/p>\n<p>Harle also said the testimony did not appear to be intentionally withheld by prosecutors.<\/p>\n<p>\u201cIt was not intentional by the district attorney\u2019s office, it was negligent \u2014 and I don\u2019t believe what was testified to in front of the jury resonated enough to significantly affect your trial\u2019s strategy,\u201d Harle said.<\/p>\n<p>The judge ruled that the disputed testimony will be excluded when the jury returns.<\/p>\n<p>The expected two-week trial is a rare case in which a police officer is criminally charged for allegedly failing to do more to save lives. Gonzales faces 29 counts of child abandonment or endangerment and has pleaded not guilty.<\/p>\n<p>Gonzales and former Uvalde school police Chief Pete Arredondo are the only two officers facing criminal charges related to the law enforcement response at Robb Elementary.<\/p>\n<p>Witness testimony is expected to resume Thursday morning in Corpus Christi.<\/p>\n<p>\n\t\t\t\t\t\t\t\tTestimony in the trial of former Uvalde school officer Adrian Gonzales is set to resume Thursday in Corpus Christi.
