But they grilled the state\u2019s lawyer over the trial judge reciting Peters\u2019 false statements about elections in handing down her sentence.<\/p>\n<p>\u201cThe court cannot punish her for her First Amendment rights,\u201d Appeals Judge Craig Welling said.<\/p>\n<p>The remarks are significant because President Donald Trump has embraced Peters, who was trying to find evidence of the fraud that he continues to claim,\u00a0<a href=\"https:\/\/apnews.com\/article\/capitol-riot-trump-election-lies-explainer-816a43ed964e6d35f03b0930e6e56c82?utm_source=homepage&amp;utm_medium=RelatedStories&amp;utm_campaign=position_03\" target=\"_blank\" rel=\"noopener\">without evidence<\/a>, caused him to lose the\u00a0<a href=\"https:\/\/apnews.com\/article\/election-claims-biden-won-explained-bd53b14ce871412b462cb3fe2c563f18\" target=\"_blank\" rel=\"noopener\">2020 presidential election<\/a>. He\u2019s threatened Colorado with the loss of federal funding if it does not release her and even\u00a0<a href=\"https:\/\/apnews.com\/article\/trump-pardon-tina-peters-colorado-43abc451b87ade3bd63b4b246f31edd4\" target=\"_blank\" rel=\"noopener\">issued a pardon<\/a>\u00a0of her last month, although she was convicted on state crimes that he cannot erase.<\/p>\n<p>Peters\u2019 lawyers have said Trump does have\u00a0<a href=\"https:\/\/apnews.com\/article\/trump-pardon-tina-peters-colorado-appeal-28b86c413ae9d112931aaf3fb5a1abd3\" target=\"_blank\" rel=\"noopener\">the authority to pardon her<\/a>, arguing that President George Washington issued pardons to people convicted of both state and federal crimes during the Whiskey Rebellion in 1795. But that argument did not even come up during oral arguments as they appealed her sentence Wednesday.<\/p>\n<p>A member of her legal team, Peter Ticktin, said they didn\u2019t have time to argue about the pardon during the 30 minutes allotted by the court. But he also said he thinks Gov. Jared Polis will grant Peters clemency, based on his recent comments. Polis, a Democrat, has said he would consider granting clemency for Peters, characterizing her sentence as \u201charsh.\u201d<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"1200\" height=\"752\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2026\/01\/TDP-L-TINA-PETERSA03_9974x-1200x752.jpg\" alt=\"\" class=\"wp-image-470484\"  \/>Judge Ted C. (Photo by AAron Ontiveroz\/The Denver Post, Pool)<\/p>\n<p>The former clerk in Mesa County, in the far western part of Colorado, was\u00a0<a href=\"https:\/\/apnews.com\/article\/tina-peters-election-computer-breach-8a171657321dd595dfd2dd81e0a0a848\" target=\"_blank\" rel=\"noopener\">convicted of state crimes<\/a>\u00a0for orchestrating a data breach of the county\u2019s elections equipment, driven by false claims about voting machine fraud after\u00a0<a href=\"https:\/\/apnews.com\/article\/donald-trump-michael-pence-electoral-college-elections-health-2d9bd47a8bd3561682ac46c6b3873a10\" target=\"_blank\" rel=\"noopener\">Trump lost<\/a>\u00a0his reelection bid. She is serving a nine-year sentence at a state prison in Pueblo after being convicted in 2024 in her home county, a Republican stronghold that supported Trump.<\/p>\n<p>Prosecutors said Peters became fixated on voting problems after becoming involved with\u00a0<a href=\"https:\/\/apnews.com\/article\/voting-machines-election-conspiracies-republicans-trump-f867ef5ed8d66f375066f8cbdb25cdf4\" target=\"_blank\" rel=\"noopener\">activists<\/a>\u00a0who had questioned the 2020 presidential election results, including\u00a0<a href=\"https:\/\/apnews.com\/article\/2022-midterm-elections-voting-presidential-biden-cabinet-b4a3422d188fdd921d8e6f38f53ea0d0\" target=\"_blank\" rel=\"noopener\">Douglas Frank<\/a>, an Ohio math teacher, and\u00a0<a href=\"https:\/\/apnews.com\/article\/mike-lindell-dominion-voting-systems-a6affb50e980bbe7dfda519eaeb3acdd\" target=\"_blank\" rel=\"noopener\">MyPillow founder Mike Lindell<\/a>.<\/p>\n<p>Peters used another person\u2019s security badge to allow a former surfer affiliated with Lindell, Conan Hayes, to watch a software update of her county\u2019s election management system. Prosecutors said he made copies of the system\u2019s hard drive before and after the upgrade, and that partially redacted security passwords later turned up online,\u00a0<a href=\"https:\/\/apnews.com\/article\/technology-colorado-voting-hacking-1b6cf27c95b376edcf91bb53af4a4d40\" target=\"_blank\" rel=\"noopener\">prompting an investigation<\/a>. Hayes was not charged with any wrongdoing.<\/p>\n<p>Peters didn\u2019t deny the deception but said she had to do it to make sure election records weren\u2019t erased. (Larry Robinson, Grand Junction Daily Sentinel)<\/p>\n<p>Instead, the three judges all expressed concern about District Court Judge Matthew Barrett\u2019s statements during\u00a0<a href=\"https:\/\/apnews.com\/article\/tina-peters-colorado-clerk-election-vote-fraud-b456ce4f80dc97f4b967eb6297311a51\" target=\"_blank\" rel=\"noopener\">Peters\u2019 sentencing<\/a>. He called her a \u201ccharlatan\u201d and said she posed a danger to the community for spreading lies about voting and undermining the democratic process.<\/p>\n<p>Senior Assistant Attorney General Lisa Michaels said Barrett was responding to a lengthy presentation Peters had just concluded during the sentencing hearing, repeating the debunked election conspiracy theories that she was trying to prove.<\/p>\n<p>\u201cShe made it relevant,\u201d Michaels said of Peters. \u201cShe had a slideshow. She had pages and pages going on about this.\u201d<\/p>\n<p>Michaels contended that Barrett made clear in the sentencing that he was imposing a sentencing her for the specific crimes she was convicted of at trial. But the elements of one of those, a felony conviction for criminal impersonation, was improperly presented to the jury with language for the misdemeanor version of the crime, another element of her case that alarmed the panel\u2019s judges.<\/p>\n<p>Last month, Peters lost\u00a0<a href=\"https:\/\/apnews.com\/article\/colorado-clerk-tina-peters-2020-election-ca614ef134fbfb0d5d1e64c1aaf74330\" target=\"_blank\" rel=\"noopener\">an attempt in federal court<\/a>\u00a0to be released from prison while she appeals her conviction.<\/p>\n<p>Her lawyers say she also is entitled to at least a new sentencing hearing because Barrett based his sentence partially on a contempt conviction in a related case that the appeals court threw out last year. (AP Photo\/David Zalubowski)<\/p>\n<p>Peters\u2019 release has become a cause celebre in the\u00a0<a href=\"https:\/\/apnews.com\/article\/voting-machines-election-conspiracies-republicans-trump-f867ef5ed8d66f375066f8cbdb25cdf4\" target=\"_blank\" rel=\"noopener\">election conspiracy movement<\/a>.<\/p>\n<p>Trump has lambasted both Polis and the Republican district attorney who brought the charges, Dan Rubinstein, for keeping Peters in prison. The Federal Bureau of Prisons\u00a0<a href=\"https:\/\/apnews.com\/article\/colorado-trump-election-conspiracy-2020-prison-010cf75d32459f3a40a5fc4418dfc1fd\" target=\"_blank\" rel=\"noopener\">tried but failed<\/a>\u00a0to get Peters moved to a federal prison.<\/p>\n<p><a href=\"https:\/\/apnews.com\/article\/donald-trump-capitol-siege-new-york-albany-jeff-merkley-2f4dc3c41e4c1dccb3bc882eb46c4826\" target=\"_blank\" rel=\"noopener\">Jake Lang<\/a>, who was\u00a0<a href=\"https:\/\/www.justice.gov\/opa\/page\/file\/1364166\/dl\" target=\"_blank\" rel=\"noopener\">charged with assaulting a police officer<\/a>\u00a0during the Jan. 6, 2021, attack on the U.S. Capitol and was later pardoned by Trump, announced on social media last month that \u201cJanuary 6er Patriots\u201d and U.S. Marshals would storm a Colorado prison to release Peters unless she is freed by the end of this month.<\/p>\n<p>The post included a phone video interview with Peters from behind bars.
