{"id":518275,"date":"2026-01-15T16:09:10","date_gmt":"2026-01-15T16:09:10","guid":{"rendered":"https:\/\/www.europesays.com\/us\/518275\/"},"modified":"2026-01-15T16:09:10","modified_gmt":"2026-01-15T16:09:10","slug":"philadelphia-based-court-reverses-decision-on-mahmoud-khalil","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/518275\/","title":{"rendered":"Philadelphia-based court reverses decision on Mahmoud Khalil"},"content":{"rendered":"<p>A federal appeals panel on Thursday\u00a0<a href=\"https:\/\/apnews.com\/article\/mahmoud-khalil-propalestinian-protest-1bb6d864a8c51b5585617c31bcbc2b9f\" target=\"_blank\" rel=\"noopener\">reversed a lower court decision<\/a>\u00a0that released former Columbia University graduate student Mahmoud Khalil from an immigration jail, bringing the government one step closer to detaining and ultimately\u00a0<a href=\"https:\/\/apnews.com\/article\/mahmoud-khalil-release-columbia-protest-trump-immigration-e833add2d3ef085872c4e8751058450e\" target=\"_blank\" rel=\"noopener\">deporting the Palestinian activist<\/a>.\n<\/p>\n<p>A three-judge panel of the 3rd U.S. Circuit Court of Appeals in Philadelphia instructed the lower court to dismiss Khalil\u2019s habeas petition, a court filing that secured his release. The panel ruled that the federal district court in New Jersey did not have jurisdiction over the matter because immigration challenges are handled differently under the law.\n<\/p>\n<p>In a 2-1 decision, the panel ruled that federal immigration laws require deportation challenges to be made by filing a petition for review of a final order of removal with a federal appeals court \u2014 not a lower-level district court.\n<\/p>\n<p>\u201cThat scheme ensures that petitioners get just one bite at the apple\u2014not zero or two,\u201d the panel wrote. \u201cBut it also means that some petitioners, like Khalil, will have to wait to seek relief for allegedly unlawful government conduct.\u201d\n  <\/p>\n<p>The law bars Khalil \u201cfrom attacking his detention and removal in a habeas petition,\u201d the panel added.\n<\/p>\n<p>Messages sent to Khalil and his legal team were not immediately returned.\n<\/p>\n<p>The decision marked a major win for the Trump administration\u2019s sweeping campaign to detain and deport noncitizens who joined protests against Israel.\n<\/p>\n<p>It is likely not the final word in Khalil\u2019s multipronged legal battle. Lawyers for the 30-year-old Palestinian activist have said they will exhaust all appeal options.\n<\/p>\n<p>An outspoken leader of the pro-Palestinian movement at Columbia, Khalil\u00a0<a href=\"https:\/\/apnews.com\/article\/columbia-university-mahmoud-khalil-ice-15014bcbb921f21a9f704d5acdcae7a8\" target=\"_blank\" rel=\"noopener\">was arrested<\/a>\u00a0at his apartment on March 8, 2025.
