{"id":522134,"date":"2026-01-17T06:23:09","date_gmt":"2026-01-17T06:23:09","guid":{"rendered":"https:\/\/www.europesays.com\/us\/522134\/"},"modified":"2026-01-17T06:23:09","modified_gmt":"2026-01-17T06:23:09","slug":"judge-addresses-death-penalty-charge-in-penn-graduate-luigi-mangiones-federal-court-case","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/522134\/","title":{"rendered":"Judge addresses death penalty charge in Penn graduate Luigi Mangione\u2019s federal court case"},"content":{"rendered":"<p>A federal judge addressed a possible death penalty charge in 2020 Engineering graduate Luigi Mangione&#8217;s ongoing case last week.<\/p>\n<p>Mangione, accused of killing former UnitedHealthcare CEO Brian Thompson in December 2024, faces four charges in federal court and nine charges in New York state court. One of the federal charges against Mangione \u2014 murder by firearm \u2014 may result in the death penalty.<\/p>\n<p>The Jan. 9 pretrial conference was Mangione\u2019s first appearance in federal court since his April 2025 <a href=\"https:\/\/www.thedp.com\/article\/2025\/04\/penn-luigi-mangione-pleads-not-guilty-murder-charges\" target=\"_blank\" rel=\"noopener\">arraignment<\/a>. At the conference, United States District Judge Margaret Garnett said she expects jury selection to begin in September and set Mangione\u2019s next hearing date for Jan. 30.\u00a0<\/p>\n<p>If the murder charge remains, Garnett <a href=\"https:\/\/www.wlbt.com\/2026\/01\/09\/luigi-mangione-heads-court-he-fights-block-death-penalty-murder-charge-key-evidence\/\" target=\"_blank\" rel=\"noopener\">expects<\/a> Mangione to stand trial in late December or early January 2027. If the charge is dropped, however, his trial might begin this October. Mangione has pleaded not guilty to all charges.<\/p>\n<p>Last month, Mangione\u2019s lawyers accused authorities of publicly vowing to seek the death penalty before Mangione&#8217;s indictment and turning his arrest into a \u201cMarvel movie\u201d spectacle. They also argued that two of the 13 total charges against him \u2014 including murder by firearm \u2014\u00a0are legally flawed. The prosecution <a href=\"https:\/\/apnews.com\/article\/mangione-bondi-unitedhealthcare-killing-death-penalty-849024a79b87c3158119d7119ddce517\" target=\"_blank\" rel=\"noopener\">contested<\/a> the defense\u2019s claims, arguing that \u201cpretrial publicity, even when intense, is not itself a constitutional defect.\u201d<\/p>\n<p>At the conference, Garnett said she would rule on the defense\u2019s request to drop death penalty charges and exclude certain evidence from the case proceedings at a later hearing. Evidence the defense hopes to exclude from trial includes the gun that police matched with the one used to kill Thompson, and a notebook in which Mangione reportedly described his desire to \u201cwack\u201d a health insurance executive.\u00a0<\/p>\n<p>Mangione\u2019s defense argues that since police had not obtained a warrant before accessing that evidence, its inclusion in the case is illegal.<\/p>\n<p>The pretrial appearance followed a three-week-long hearing in New York state court, which focused on whether the court would consider the weapon and notebook as evidence.\u00a0<\/p>\n<p>In the state case, Judge Gregory Carro provided <a href=\"https:\/\/abcnews.go.com\/US\/luigi-mangiones-pretrial-hearing-concludes-judge-hell-issue\/story?id=128481340\" target=\"_blank\" rel=\"noopener\">the defense <\/a>a Jan. 29 deadline to finalize a written argument and gave the prosecution until March 5 to submit its argument. After the prosecution\u2019s submission, the defense will have two weeks to submit a reply.<\/p>\n<p>The state hearing also revealed some previously unseen bodycam footage of police officers searching Mangione\u2019s personal belongings, including handwritten notes that prosecutors characterized as a \u201cto-do\u201d list, as well as possible \u201cescape routes.\u201d<\/p>\n<p>In September 2025, Carro <a href=\"https:\/\/www.thedp.com\/article\/2025\/09\/penn-luigi-mangione-terrorism-charges-dismissed\" target=\"_blank\" rel=\"noopener\">cleared<\/a> Mangione of two New York state terrorism charges and ruled that they were \u201clegally insufficient.\u201d Mangione still faces a count of second-degree murder in New York,\u00a0which \u2014 if convicted \u2014carries a 25-year sentence.<\/p>\n<p>As a Penn student, Mangione studied at the School of Engineering and Applied Science and founded UPGRADE, the University\u2019s first game development club. He graduated in 2020 with a bachelor\u2019s and master\u2019s degree in computer and information science.<\/p>\n<p>On campus, Mangione was a member of Phi Kappa Psi, a University-affiliated fraternity. In a previous social media post, he claimed that his mental and physical issues were exacerbated by the fraternity\u2019s \u201chell week.\u201d<\/p>\n<p>Mangione suffered from back issues and \u201cbrain fog,\u201d which he posted about frequently on Reddit. His posts \u2014 which detailed the negative impact of the health issues on his overall well-being \u2014 also attributed <a href=\"https:\/\/www.thedp.com\/article\/2025\/01\/penn-who-was-luigi-mangione-penn-connections\" target=\"_blank\" rel=\"noopener\">his decline<\/a> in academic success to worsening health.\u00a0<\/p>\n<p>\u201cIt\u2019s absolutely brutal to have such a life-halting issue,\u201d Mangione wrote on his brain fog. \u201cThe people around you probably won\u2019t understand your symptoms \u2014 they certainly don\u2019t for me.\u201d\u00a0<\/p>\n<p>Senior reporter William Grantland leads data and enterprise reporting and can be reached at <a href=\"https:\/\/www.thedp.com\/article\/2026\/01\/mailto:grantland@thedp.com\" target=\"_blank\" rel=\"noopener\">grantland@thedp.com<\/a>.
