{"id":526354,"date":"2026-01-19T01:10:08","date_gmt":"2026-01-19T01:10:08","guid":{"rendered":"https:\/\/www.europesays.com\/us\/526354\/"},"modified":"2026-01-19T01:10:08","modified_gmt":"2026-01-19T01:10:08","slug":"epa-rule-clarification-hits-a-significant-source-of-groks-electricity","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/526354\/","title":{"rendered":"EPA Rule Clarification Hits a Significant Source of Grok\u2019s Electricity"},"content":{"rendered":"<p>This past summer, activists at the Southern Environmental Law Center (SELC) <a href=\"https:\/\/www.selc.org\/news\/resistance-against-elon-musks-xai-facility-in-south-memphis-gets-stronger\/\" target=\"_blank\" rel=\"noopener\">announced<\/a> they were going after Elon Musk\u2019s AI company, xAI, for what it claimed were \u201cunpermitted gas turbines that threaten to make air pollution problems even worse,\u201d in the Memphis area, where the xAI \u201cColossus\u201d data centers are located. It appears the SELC has now prevailed, because the language of a <a href=\"https:\/\/www.epa.gov\/stationary-sources-air-pollution\/stationary-gas-and-combustion-turbines-new-source-performance\" target=\"_blank\" rel=\"noopener\">general ruling<\/a> from the Environmental Protection Agency (EPA) regarding that type of turbine essentially confirms the activists\u2019 assertion, undermining the Grok parent company\u2019s legal rubric for using the equipment. <\/p>\n<p>In order to serve the computational needs of products like the <a href=\"https:\/\/gizmodo.com\/can-mechahitler-pass-trumps-anti-woke-ai-test-2000633882\" target=\"_blank\" rel=\"noopener\">Grok AI chatbot<\/a>, <a href=\"https:\/\/gizmodo.com\/elon-musks-version-of-wikipedia-is-live-heres-what-the-difference-is-2000677654\" target=\"_blank\" rel=\"noopener\">Grokipedia<\/a>, and the <a href=\"https:\/\/gizmodo.com\/elon-musks-x-says-it-will-sort-of-crack-down-on-groks-sexual-deepfake-problem-2000710658\" target=\"_blank\" rel=\"noopener\">Grok image generator,<\/a> xAI was generating off-grid power for its data center with gas-powered turbines and <a href=\"https:\/\/www.cnbc.com\/2026\/01\/16\/musks-xai-faces-tougher-road-expanding-memphis-area-after-epa-update.html\" target=\"_blank\" rel=\"noopener\">classifying them<\/a> as \u201cnon-road engines\u201d\u2014temporary generators, ostensibly used for more transitory purposes. That temporary status, it was apparently hoped, would have made them exempt from air quality requirements. The newly updated EPA rules clarify that using such turbines, even temporarily, does not confer any such exemption from clean air rules. <\/p>\n<p><a href=\"https:\/\/www.theguardian.com\/technology\/2026\/jan\/15\/elon-musk-xai-datacenter-memphis\" target=\"_blank\" rel=\"noopener\">According to the Guardian<\/a>, the placement of the initial \u201cColossus 1\u201d turbines\u2014which eventually <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/apr\/09\/elon-musk-xai-memphis\" target=\"_blank\" rel=\"noopener\">came to number 35<\/a>\u2014benefited from a local loophole in environmental laws that says generators don\u2019t require permits as long as they\u2019re in place for 364 days or less. The Guardian\u2019s reporting also notes that xAI now has locally permitted generators at the sites, but that the new EPA rules say the federal government is now in charge of such permitting, not the local authorities. <\/p>\n<p>In a statement <a href=\"https:\/\/naacp.org\/articles\/naacp-responds-epa-confirmation-large-methane-gas-turbines-require-permits\" target=\"_blank\" rel=\"noopener\">published by the NAACP<\/a>, SELC senior attorney Amanda Garcia said this decision \u201cmakes it clear that companies are not\u2014and have never been\u2014allowed to build and operate methane gas turbines without a permit and that there is no loophole that would allow corporations to set up unpermitted power plants,\u201d adding that her organization expects \u201clocal health leaders to take swift action to ensure they are following federal law and to better protect neighbors from harmful air pollution.\u201d<\/p>\n<p>This feels like a lifetime ago, but just under a year ago, during Elon Musk\u2019s tenure at DOGE, Musk sought to slash EPA contracts with the stated aim of reducing government waste. <a href=\"https:\/\/www.eenews.net\/articles\/doge-lands-at-epa\/\" target=\"_blank\" rel=\"noopener\">The EPA\u2019s administrator<\/a>, Lee Zeldin, said at the time, \u201cDOGE is making us better,\u201d adding,\u00a0\u201cThey come up with great recommendations, and we can make a decision to act on it.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Posting the savings and the receipts <a href=\"https:\/\/t.co\/2SywWa3TRN\">https:\/\/t.co\/2SywWa3TRN<\/a><\/p>\n<p>\u2014 Elon Musk (@elonmusk) <a href=\"https:\/\/twitter.com\/elonmusk\/status\/1889861826374222019?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"noopener\">February 13, 2025<\/a><\/p><\/blockquote>\n<p>\u00a0<\/p>\n<p>xAI\u2019s media contact email address sends a three-word auto-reply in response to all inquiries, including one from Gizmodo about what the turbine situation currently is for the relevant facilities in Tennessee. Gizmodo also asked xAI if the Colossus data centers are operating at reduced capacity while the permitting issues are being resolved.
