An Upper East Side subway rider was photographed wearing a leather strap and chain \u201ccage\u2019\u2019 that was barely covering his genitals \u00a0\u2014 and was visible to other shocked transit customers \u2014 but cops said there is nothing they\u00a0can do about it.<\/p>\n
An offended straphanger said that she was told \u201cthe small leather [and] \u00a0chain straps on the penis constitute coverage sufficient to make it not eligible for the penal code.\u2019\u2019 Obtained by the NY Post<\/p>\n
\u201cI\u2019m totally beside myself,\u201d a woman told The Post after trying to file a police report about the sight, which occurred earlier this month on an Upper East Side Q train.<\/p>\n

Police sources said that while the man\u2019s attire may be provocative, it did not constitute exposing himself.<\/p>\n
Public lewdness requires some intentional action that shows the clear effort to reveal oneself \u2014 such as lifting a shirt or opening a coat \u2014 and that was not proven in this case, they said.<\/p>\n
The situation is more akin to a woman wearing a skirt who may have unintentionally revealed too much and failed to meet a criminal standard, sources said.<\/p>\n
The NYPD told The Post in \u00a0a statement Tuesday, \u201cPolice found during their investigation that the subject did not expose himself, did not inappropriately touch himself and did not reference anyone in the subway car.<\/p>\n
\u201cThe NYPD strongly encourages any victims of indecent exposure to make a report.\u201d<\/p>\n

The woman said she snapped a picture of the man and posted it on a local Facebook group, where other women soon came forward saying they shared a similar misfortune of seeing the man in \u00a0the same icky situation.<\/p>\n
