{"id":55583,"date":"2025-07-11T01:33:13","date_gmt":"2025-07-11T01:33:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/55583\/"},"modified":"2025-07-11T01:33:13","modified_gmt":"2025-07-11T01:33:13","slug":"gun-makers-lose-appeal-of-ny-law-that-could-make-them-liable-for-deadly-shootings","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/55583\/","title":{"rendered":"Gun makers lose appeal of NY law that could make them liable for deadly shootings"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"AL6EF6HE4NDDDJURPHHOPXOFCM\">New York \u2014 A New York state law holding gun manufacturers potentially liable when their weapons are used in deadly shootings was upheld Thursday by a federal appeals court.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LGCZ5TFLCRBVTN5YOTPBB4FVOM\">The ruling Thursday by the 2nd U.S. Circuit Court of Appeals in Manhattan affirmed a decision by an Albany judge.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MWEJIAES3FE4ZEAACUQS4EAACY\">A three-judge appeals panel said <a href=\"https:\/\/www.syracuse.com\/politics\/2021\/06\/bill-would-allow-ny-ag-to-sue-gun-manufacturers.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.syracuse.com\/politics\/2021\/06\/bill-would-allow-ny-ag-to-sue-gun-manufacturers.html\">the 2021 New York state law<\/a> was not unconstitutional or vague. The opinion written by Circuit Judge Eunice C. Lee said a lawsuit seeking to stop the law\u2019s implementation did not show that the law was \u201cunenforceable in all its applications.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MTH44UVCOBG3NHZOONXGWGKP3U\">The law requires the gun industry to create reasonable controls to prevent unlawful possession, use, marketing or sale of their products in New York and allows them to be sued for unlawful acts that create or contribute to threats to public health or safety.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NJVO2GUIS5FKXMNG5BSZRVPUSY\">The National Shooting Sports Foundation, a trade association of firearms manufacturers that ships firearms into New York, had sued over the law, saying it was pre-empted by the federal 2005 Protection of Lawful Commerce in Arms Act, which blocks litigation that could destroy the firearms industry.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4VRX2TLUHVBJ7B5SF3ZGIRVFPY\">In May 2022, Judge Mae A. D\u2019Agostino threw out the lawsuit, rejecting arguments that the law\u2019s language did not adequately explain what was prohibited. She said the law closely tracked the language of New York\u2019s general public nuisance law, which has been \u201cgood law since 1965.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"F3RAKWITTNFGNM63HEY72FUZGU\">Lawyers for the gun manufacturers did not immediately respond to requests for comment.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YHVE5B4XBZD77GHULT4SSXGE54\">New York Attorney General Letitia James said in a release that the decision was a \u201cmassive victory for public safety and the rule of law and will help us continue to fight the scourge of gun violence to keep our communities safe.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BOARBQ7IFJFLLDEPPZJN3M2GWE\">Eric Tirschwell, executive director of the nonprofit Everytown Law, praised the ruling. He said the law creates \u201ca new pathway for victims and their families to hold bad actors in the gun industry accountable for their role in fueling the epidemic of gun violence that is ravaging communities across the Empire State.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WMLR6VSLBNHKXKTJKMUCXHBQ7A\">Everytown Law and the Giffords Law Center to Prevent Gun Violence were among gun violence protection groups that filed an amicus brief in the case, arguing that the new law \u201csimply does not create the free-for-all\u201d that gun makers predicted.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QCGVADGSYVACTKVSPNQ354PA3A\">Circuit Judge Dennis Jacobs concurred in the ruling, despite some reservations. He wrote that New York had \u201ccontrived a broad public nuisance statute that applies solely to \u2018gun industry members\u2019 and is enforceable by a mob of public and private actors.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WBM7CKXNZVFUTAP5LC2Q5JXUXA\">And he added: \u201cThe intent of Congress when it closes a door is not for States to thus jimmy a window.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"TSCWE5J2PBEQ7LL5HFEKURJ2AY\">Jacobs, citing a recent Supreme Court ruling, said he agrees with the other two judges on the panel that the law could be applied consistent with the federal law and the U.S. Constitution.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OEBHR4DHIFBIXJ2U2BZ33QCXSY\">But he also wrote that the New York gun law is \u201cnothing short of an attempt to end-run\u201d the federal law, noting that then-Gov. Andrew Cuomo said when he signed it that it would \u201cright the wrong\u201d done by the federal law.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LVD3Y6VEHVCNPBJ5GK2L5VCJAI\">\u201cThere is some legitimate reach to the law, which suffices for us to affirm the dismissal of this facial challenge.
