{"id":56567,"date":"2025-07-11T10:09:07","date_gmt":"2025-07-11T10:09:07","guid":{"rendered":"https:\/\/www.europesays.com\/us\/56567\/"},"modified":"2025-07-11T10:09:07","modified_gmt":"2025-07-11T10:09:07","slug":"texas-cities-cant-unilaterally-decriminalize-marijuana","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/56567\/","title":{"rendered":"Texas cities can\u2019t unilaterally decriminalize marijuana"},"content":{"rendered":"<p class=\"body-text-paragraph\">While nearly half of the 50 states have embraced legal recreational marijuana, pot remains outlawed in Texas, and we don\u2019t see that changing anytime soon.<\/p>\n<p class=\"body-text-paragraph\">Whatever side of that debate you\u2019re on, decisions about weed\u2019s legal status shouldn\u2019t be made at the local level, and it\u2019s a good thing that Dallas\u2019 <a href=\"https:\/\/www.dallasnews.com\/news\/politics\/2025\/07\/04\/dallas-agrees-to-block-enforcement-of-weed-decriminalization-after-appeals-court-ruling\/\" rel=\"noopener\" target=\"_blank\">marijuana decriminalization efforts are on hold<\/a> for now.<\/p>\n<p class=\"body-text-paragraph\">In November, Dallas voters approved a <a href=\"https:\/\/www.dallasnews.com\/news\/2024\/11\/05\/dallas-voters-weed-proposition-marijuana-ballot\/\" rel=\"noopener\" target=\"_blank\">charter amendment effectively decriminalizing the drug<\/a>. It forbade police from using the smell of marijuana as probable cause for search or seizure, and it limited their ability to arrest or cite  anyone for possessing 4 ounces or less. <\/p>\n<p class=\"body-text-paragraph\">We strongly urged Dallasites to vote against the amendment. Willie Nelson <a href=\"https:\/\/www.dallasnews.com\/arts-entertainment\/2024\/10\/16\/willie-nelson-endorses-marijuana-decriminalization-in-dallas\/\" rel=\"noopener\" target=\"_blank\">had a different take<\/a>. So did most voters, with about 66% voting in favor. Austin, San Marcos, Killeen, Elgin and Denton <a href=\"https:\/\/www.dallasnews.com\/opinion\/editorials\/2024\/11\/26\/dallas-marijuana-decriminalization-jumped-the-gun\/\" rel=\"noopener\" target=\"_blank\">have all passed similar measures<\/a>.<\/p>\n<p>Opinion<\/p>\n<p class=\"dmnc_features-cta-social-cta-social-module__zWZy- mb-4\">Get smart opinions on the topics North Texans care about.<\/p>\n<p class=\"body-text-paragraph\">All six have drawn lawsuits from Attorney General Ken Paxton\u2019s office. How those will turn out in the end, we don\u2019t know, but an appeals court in April delivered a blow to the city-level decriminalization movement. It ruled that <a href=\"https:\/\/search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=305c590f-6443-43e6-aa06-f2302cebe06d&amp;coa=coa15&amp;DT=Opinion&amp;MediaID=8c118a21-2fc0-4dd2-95f5-6f282deca299\" rel=\"noopener\" target=\"_blank\">Austin\u2019s ordinance is preempted by state law<\/a>. <\/p>\n<p class=\"body-text-paragraph\">In the wake of that decision late last month, the city of Dallas filed a joint motion with Paxton\u2019s office asking a judge to temporarily halt enforcement of the city\u2019s decriminalization measure until the lawsuit is resolved, this newspaper reported. <\/p>\n<p class=\"body-text-paragraph\">Dallas residents voiced their opinion loud and clear: They wanted decriminalization. But in a rare moment, we agree with Paxton that the decision doesn\u2019t belong in the city\u2019s hands. <\/p>\n<p class=\"body-text-paragraph\">Four ounces might not sound like a whole lot, but it\u2019s an amount most who aren\u2019t dealers wouldn\u2019t carry. Even in Colorado, where weed is legal recreationally, residents can only legally buy up to <a href=\"https:\/\/cannabis.colorado.gov\/legal-cannabis-use\/laws-about-cannabis-use#:~:text=Adults%20over%20the%20age%20of%2021%20can%20buy%20and%20possess%20up%20to%201%20ounce%20of%20cannabis%20at%20a%20time.\" rel=\"noopener\" target=\"_blank\">an ounce at a time<\/a>. <\/p>\n<p class=\"body-text-paragraph\">It\u2019s hard to see why cities should be allowed to unilaterally decide their borders are somehow free from state law around a legal question so serious as the possession of a Schedule 1 drug.<\/p>\n<p class=\"body-text-paragraph\">The <a href=\"https:\/\/tlc.texas.gov\/docs\/legref\/TxConst.pdf\" rel=\"noopener\" target=\"_blank\">Texas Constitution<\/a> allows cities with more than 5,000 residents to adopt a charter and govern themselves. But the state constitution also says that \u201cno charter or any ordinance\u201d is to conflict with state laws. <\/p>\n<p class=\"body-text-paragraph\">Those who want to decriminalize or legalize marijuana should make their case at the state level. That\u2019s what we elect lawmakers for. <\/p>\n<p class=\"body-text-paragraph\">The debate about pot\u2019s future legal status has shifted in recent years, fueled greatly by a <a href=\"https:\/\/www.dallasnews.com\/opinion\/editorials\/2025\/06\/18\/gov-greg-abbott-shouldnt-veto-thc-ban\/\" rel=\"noopener\" target=\"_blank\">sparsely regulated market of intoxicating hemp-derived products<\/a>. Lawmakers banned those products this session, but Gov.
