{"id":581041,"date":"2026-02-11T00:44:11","date_gmt":"2026-02-11T00:44:11","guid":{"rendered":"https:\/\/www.europesays.com\/us\/581041\/"},"modified":"2026-02-11T00:44:11","modified_gmt":"2026-02-11T00:44:11","slug":"taxpayers-footing-bill-city-councilmember-asks-state-ethics-commission-whether-he-can-run-for-vp-action-news-jax","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/581041\/","title":{"rendered":"Taxpayers footing bill, city councilmember asks state ethics commission whether he can run for VP \u2013 Action News Jax"},"content":{"rendered":"<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">JACKSONVILLE, Fla. \u2014 Jacksonville taxpayers are footing the bill as the city council attempts to clear a path for one of its own to run for council leadership.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">Jacksonville City Council is asking the Florida Commission on Ethics to find that Councilmember Joe Carlucci (R-District 5) is free and clear to make a run for Council Vice President.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">Previous <a href=\"https:\/\/www.ethics.state.fl.us\/Documents\/Ethics\/MeetingAgendas\/Jan26Materials\/File2830.pdf\" rel=\"nofollow noopener\" title=\"https:\/\/www.ethics.state.fl.us\/Documents\/Ethics\/MeetingAgendas\/Jan26Materials\/File2830.pdf\" target=\"_blank\">ethics opinions and the commission\u2019s staff<\/a>lean towards the position that Carlucci is barred from running for a leadership role due to the fact that his father serves on the same elected body.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">However, the Florida Attorney General\u2019s Office offered this letter taking the position that the state\u2019s anti-nepotism laws should not apply in this case.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">That same day, Council President Kevin Carrico (R-District 4) signed off on an agreement to hire an outside attorney to argue before the state ethics commission in support of allowing Carlucci to run for council leadership.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">The agreement allows for the expenditure of up to $7,500 on legal fees.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">UNF associate political science professor Sean Freeder noted it\u2019s an unusual move, given that the two Carluccis are the only members who are currently impacted.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">\u201cI\u2019m not quite sure I understand the logic of why you\u2019d pursue it in this way. It makes sense to me that you\u2019d hire a personal lawyer with your own funds to do this,\u201d said Freeder.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">Action News Jax spoke with at least five council members who expressed concerns about the use of taxpayer dollars to litigate the ethics case.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">All of them refused to share their concerns on the record.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">Former constitutional law professor Rod Sullivan argued because the case concerns a question that could impact future council members, it is an appropriate expenditure.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">\u201cThe one who really benefits is the city council, cause the city council doesn\u2019t want to be embroiled in years of litigation if it gets this issue wrong,\u201d said Sullivan.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">In a statement, Council President Carrico defended his decision to hire outside legal counsel instead of using the city\u2019s Office of General Counsel.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">\u201cThe decision reflects the Council\u2019s previously adopted resolution of no-confidence in the Office of General Counsel, which informs when outside counsel is appropriate,\u201d said Carrico.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">Sullivan noted, even if the council had used OGC, that would also have come at a cost.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">\u201cSeems to me like the smart budgetary thing, if you know this is going to be a hornet\u2019s nest, is to get outside counsel to represent the city council,\u201d said Sullivan.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">But given the tough budget year where seemingly every taxpayer dollar was heavily scrutinized, Freeder argued, at least for the sake of optics, the case could be made that Carlucci should have hired his own attorney out of pocket.<\/p>\n<p class=\"default__StyledText-sc-tl066j-0 jsuuLb body-paragraph\">\u201cNot all scandals are equal. Voters actually are somewhat more forgiving for like sex scandals and that kind of thing.
