However, Baker pushed back on the idea that simply implementing a CBA is a \u201c<a href=\"https:\/\/x.com\/DavidWCobb\/status\/2024529947914645905\/photo\/1\" rel=\"nofollow\">simple answer<\/a>\u201d to these issues.<\/p>\n<p>Baker said that a federal law would need to be passed in order for it to be put into place. However, <strong><a href=\"https:\/\/www.on3.com\/college\/tennessee-volunteers\/\" rel=\"nofollow noopener\" target=\"_blank\">Tennessee<\/a><\/strong> athletic director Danny White has since rebuffed Baker\u2019s claims, sharing shared three points against the NCAA president\u2019s response. He <a href=\"https:\/\/x.com\/ad_dannywhite\/status\/2024596734073336274?s=46&amp;t=p3F0DdOXH3fqNfZfXH6XKQ\" rel=\"nofollow\">listed them<\/a> on X, which you can read below:<\/p>\n<p><strong><a href=\"https:\/\/www.on3.com\/nil\/newsletter\/signup\/\" rel=\"nofollow noopener\" target=\"_blank\">SUBSCRIBE to the On3 NIL and Sports Business Newsletter<\/a><\/strong><\/p>\n<p>\u201c1st: You don\u2019t have to get a federal law passed to build a collective bargaining construct to save college sports. It\u2019s actually the only solution we have that doesn\u2019t involve asking congress to give us a pass on the Sherman Act. <\/p>\n<p>\u201c2nd: Nobody has said collective bargaining would be \u2018simple.\u2019 There are no \u2018simple\u2019 solutions to this problem. Clearly, asking congress to save us has not proven to be a \u2018simple\u2019 solution. <\/p>\n<p>\u201c3rd: Not pursuing all avenues to solve our dysfunctional system is negligent.\u201d<\/p>\n<p>White\u2019s direct call-out of the NCAA president comes just over a month after he sounded off on the current state of NIL and the NCAA transfer portal. The Tennessee AD said college athletics is in a \u201c<strong><a href=\"https:\/\/www.on3.com\/college\/tennessee-volunteers\/news\/tennessee-ad-danny-white-sounds-off-on-current-state-of-nil-transfer-portal-its-gotten-worse\/\" rel=\"nofollow noopener\" target=\"_blank\">worse<\/a><\/strong>\u201d state than it was before the house settlement. <\/p>\n<p>He connected potential unionization to stronger academic output by slowing down the frequency of transfers in the future. As a result, White expects graduation rates to rise. To White, a potential union in college sports would also strengthen leadership and continuity in the locker room. <\/p>\n<p>Baker opposed this point, stating that student-athletes don\u2019t want to go this route. He questioned whether scholarships would be considered taxable under the agreement.<\/p>\n<p>\u201cDoes this apply to all college sports?\u201d Baker asked. \u201cBecause if it does, you\u2019re going to have kids in college sports who are going to have to write checks to their schools to pay for all the benefits they currently get that they don\u2019t get taxed on that become benefits that are taxable because they are employees. There\u2019s a lot to that issue that nobody ever talks about.\u201d<\/p>\n<p>While it\u2019s currently unclear what collective bargaining in college athletics would look like, it\u2019s clear that White believes it should be implemented by the NCAA sooner rather than later.
