{"id":616212,"date":"2026-02-25T23:42:15","date_gmt":"2026-02-25T23:42:15","guid":{"rendered":"https:\/\/www.europesays.com\/us\/616212\/"},"modified":"2026-02-25T23:42:15","modified_gmt":"2026-02-25T23:42:15","slug":"san-diego-to-pay-116k-for-legal-fees-in-battle-over-la-jolla-cityhood-process-san-diego-union-tribune","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/616212\/","title":{"rendered":"San Diego to pay $116K for legal fees in battle over La Jolla cityhood process \u2013 San Diego Union-Tribune"},"content":{"rendered":"<p>The San Diego City Council unanimously agreed to pay $116,000 in legal fees associated with its battle with the Association for the City of La Jolla, which is working to have La Jolla detach from San Diego and become its own city.\u00a0<\/p>\n<p>The council voted Feb. 24, without a presentation or questions, to authorize the payment from its Public Liability Fund to cover attorney fees and other costs related to the city\u2019s unsuccessful lawsuit challenging the San Diego Local Agency Formation Commission\u2019s actions during the cityhood process.\u00a0<\/p>\n<p>City Council President Joe LaCava, whose District 1 includes La Jolla, moved to adopt the resolution authorizing the payment, which was deemed necessary after the city decided not to appeal a recent court decision favoring <a href=\"https:\/\/cityoflajolla.org\/\" rel=\"nofollow noopener\" target=\"_blank\">ACLJ<\/a>.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"San Diego City Council President Joe LaCava speaks during a council meeting in June. (Hayne Palmour IV)<\/p>\n<p>In June, the city <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/07\/23\/san-diego-files-lawsuit-over-la-jolla-cityhood-effort\/\" rel=\"nofollow noopener\" target=\"_blank\">filed a lawsuit<\/a> calling on the Local Agency Formation Commission \u2014 which provides guidance to communities seeking to become cities \u2014 to rescind a ruling allowing La Jolla\u2019s cityhood effort to move forward. On April 29, LAFCO had issued a <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/04\/30\/la-jolla-cityhood-effort-collects-enough-valid-signatures-to-move-forward\/\" rel=\"nofollow noopener\" target=\"_blank\">\u201ccertificate of sufficiency\u201d<\/a> indicating ACLJ had gathered the required number of petition signatures to keep the movement alive.\u00a0<\/p>\n<p>The lawsuit sought to stop LAFCO and its executive officer, Keene Simonds, from proceeding with the cityhood process, which includes launching an administrative review of the <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/01\/30\/la-jolla-cityhood-advocates-submit-application-to-detach-from-san-diego\/\" rel=\"nofollow noopener\" target=\"_blank\">application filed<\/a> by ACLJ in January 2025.<\/p>\n<p>The dispute centers on LAFCO\u2019s actions during the process of verifying the petition signatures, which ultimately reversed the San Diego County registrar of voters office\u2019s initial determination that ACLJ\u2019s petition drive had failed to gather enough valid signatures.\u00a0<\/p>\n<p>The city also contended the La Jolla cityhood review process would impose \u201csubstantial irreparable harm\u201d on San Diego due to the costs associated with staff time required for the next steps and that dedicating staff members\u2019 time to that process would take away from \u201cperforming their core functions.\u201d<\/p>\n<p>ACLJ responded with a court motion arguing that the city\u2019s case was a strategic lawsuit against public participation, or SLAPP, calling it a \u201cmeritless attempt to obstruct democratic participation and silence a public interest effort through costly litigation.\u201d\u00a0<\/p>\n<p>In October, Superior Court Judge Judy Bae <a href=\"https:\/\/www.sandiegouniontribune.com\/2025\/10\/24\/judge-finalizes-ruling-in-favor-of-la-jolla-cityhood-advocates-rejects-s-d-lawsuit\/\" rel=\"nofollow noopener\" target=\"_blank\">granted ACLJ\u2019s motion<\/a>, dismissing the city\u2019s lawsuit and allowing LAFCO to move to the next steps in the process.\u00a0<\/p>\n<p>The city had the option to appeal Bae\u2019s ruling but <a href=\"https:\/\/www.sandiegouniontribune.com\/2026\/01\/27\/la-jolla-cityhood-effort-advancing-after-san-diego-decides-not-to-appeal-judges-decision-group-says\/\" rel=\"nofollow noopener\" target=\"_blank\">decided not to<\/a>. As a result, the city must pay ACLJ\u2019s legal fees.\u00a0<\/p>\n<p>The next steps in the process include selecting a consultant to complete a comprehensive fiscal analysis.
