It would be a rare step"},"content":{"rendered":"<p>Multiple times during Donald Trump\u2019s second presidency, Congress has debated his military authority, first in Latin America and now the Middle East.<\/p>\n<p>The <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/live\/donald-trump-news-epstein-cuba-updates-2-26-2026#0000019c-9a8e-d662-a1fd-feef7f750000\" rel=\"nofollow noopener\" target=\"_blank\">latest test<\/a> will come in the GOP-controlled House on Thursday after the Senate <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/iran-war-senate-vote-war-powers-06f9465c16218f90192f7502baa736eb\" rel=\"nofollow noopener\" target=\"_blank\">voted down<\/a> a Democratic measure to limit Trump, at least theoretically, in the U.S.-Israeli war against Iran. <\/p>\n<p>Like many predecessors, Trump claims broad, even unlimited power over U.S. forces. He approved <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/boat-strike-caribbean-cartels-trump-drugs-658f44dda723fea7e628507befe9bce1\" rel=\"nofollow noopener\" target=\"_blank\">boat strikes<\/a> near Venezuela, established a <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-venezuela-maduro-oil-tankers-625a7c9a3106e316c97ceb68a42a1cb5\" rel=\"nofollow noopener\" target=\"_blank\">naval blockade<\/a> and authorized a military operation to arrest and <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-maduro-venezuela-presidential-palace-blowtorches-7969152ae48510003fe9cbde92f3c102\" rel=\"nofollow noopener\" target=\"_blank\">depose its leader<\/a>, Nicol\u00e1s Maduro \u2014 all arguable acts of war under international law. He made noise about additional action in <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/greenland-trump-independence-election-denmark-china-russia-c86afc33375d0fe260f065a662e04b57\" rel=\"nofollow noopener\" target=\"_blank\">Greenland<\/a> and <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/greenland-trump-independence-election-denmark-china-russia-c86afc33375d0fe260f065a662e04b57\" rel=\"nofollow noopener\" target=\"_blank\">Latin America<\/a>, before launching a sweeping bombing campaign in Iran. <\/p>\n<p>Under the Constitution, the military reports to the president. But the document grants oversight roles to Congress. Trump says he won\u2019t sign anything <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-venezuela-senate-war-powers-2350b162d116090759a7428c4b915eea\" rel=\"nofollow noopener\" target=\"_blank\">limiting his options<\/a> \u2014 proof for some experts that control over a civilian-led military has skewed from its original design.<\/p>\n<p>\u201cThe Constitution gives war powers to two different branches of government,\u201d said military historian Peter Mansoor, an Ohio State University professor and retired U.S. Army colonel. \u201cThe pendulum has swung towards the executive,\u201d he lamented, arguing that \u201cthe framers meant for Congress to be the most powerful branch.\u201d<\/p>\n<p>Here is a look at what the Constitution says and how U.S. war powers have played out. <\/p>\n<p>What the constitution says about war powers<\/p>\n<p>Article I, which established Congress, states that lawmakers \u201cshall have power &#8230; to declare war.\u201d Article II, which established the presidency, makes the chief executive the \u201ccommander in chief of the Army and Navy.\u201d The Constitution also gives Congress authority over military budgets. <\/p>\n<p>Congress has not declared an official state of war since World War II. Yet since 1945, U.S. service members have fought and died in full-scale conflicts in Korea, Vietnam, Iraq and Afghanistan, among other places. <\/p>\n<p>In the Maduro mission, an Army pilot was injured, leading Trump to award him the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/state-of-union-maduro-venezuela-wounded-pilot-69c70a7385ec14f58a84a4a7e4557c08\" rel=\"nofollow noopener\" target=\"_blank\">Medal of Honor<\/a> \u2014 recognition legally restricted to actions taken when fighting a foreign enemy. As of Wednesday, six U.S. service members had died in the Iran war.<\/p>\n<p>During Senate debate last month on Venezuela, Sen. Rand Paul, R-Ky., mocked an \u201celaborate song and dance\u201d and said it\u2019s \u201can absurdity\u201d to argue that Trump\u2019s actions were anything other than waging war.<\/p>\n<p>Sen. Tim Kaine, the Virginia Democrat who sponsored Venezuela and Iran war powers resolutions, said the latest version \u2014 which failed 47-53 \u2014 would prevent a presidential \u201cend-run around the Constitution.\u201d<\/p>\n<p>Declarations of war: 11 \u2014 but none since World War II<\/p>\n<p>Congress has declared war against 11 nations across across five wars. Three declarations came in the 19th century, two during World War I and six during World War II. Each time, the president formally asked Congress to act, citing some specific attack on the U.S. or another national interest. <\/p>\n<p>President James K. Polk asked even for the Mexican War, which was principally about expanding U.S. territory.<\/p>\n<p>Over the same span, Congress voted many times to authorize force without declaring war. Early measures were usually for specific naval actions defending U.S. commercial interests. Congress first took this route in 1798; it became a roadmap for the post-World War II era. <\/p>\n<p>The Korean War marked a turn toward presidential power<\/p>\n<p>President Harry Truman won World War II under declarations issued while Franklin Roosevelt was president. Then, in 1950, the fledgling United Nations voted to act in Korea and asked member nations to assist. <\/p>\n<p>Citing the U.N., Truman engaged U.S. troops in a so-called \u201cpolice action\u201d without seeking lawmakers\u2019 approval. Congress later that year approved the Defense Production Act to mobilize U.S. war capacity. It was an after-the-fact endorsement of Truman\u2019s decision, and the law <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/anthropic-military-ai-hegseth-department-of-defense-f05674f7195051ab843e5087d12c8cf8\" rel=\"nofollow noopener\" target=\"_blank\">remains a potential Pentagon tool<\/a>. <\/p>\n<p>Vietnam showed the span of congressional and presidential power <\/p>\n<p>Presidents from Dwight Eisenhower to Gerald Ford presided over what history remembers as the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/saigon-vietnam-war-americans-50-years-f6b8b5823b99038fcdb87bdbcd4c0125\" rel=\"nofollow noopener\" target=\"_blank\">\u201cVietnam War,\u201d<\/a> though it was often called \u201cthe Vietnam conflict\u201d as U.S. administrations expanded southeast Asia operations. <\/p>\n<p>Lyndon Johnson persuaded Congress to pass the Gulf of Tonkin Resolution in 1964 and used that to accelerate U.S. involvement.<\/p>\n<p>As U.S. deaths rose, the war grew unpopular, but Johnson \u2014 and then Richard Nixon \u2014 had broad authority from lawmakers. \u201cCongress approves and supports the determination of the President, as Commander-in-Chief, to repel any armed attack against the forces of the United States and to prevent further aggression,\u201d the 1964 resolution stated. <\/p>\n<p>Congress repealed that measure in 1971, but Nixon did not withdraw. <\/p>\n<p>Mansoor said war declarations don\u2019t just define the start of a war. They also effectively require an official end \u2014 which triggers the Senate\u2019s role in ratifying peace treaties. Sidestepping those legal bookends, Mansoor said, is \u201chow you get in these forever wars.\u201d <\/p>\n<p>Congress answers with the War Powers Act<\/p>\n<p>In 1973, as the U.S. limped toward its Vietnam exit, Congress passed the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/war-powers-act-trump-congress-9e6832fb5f5f844acf8992008d3a8d63\" rel=\"nofollow noopener\" target=\"_blank\">War Powers Resolution<\/a>, intending to impose guardrails on presidents by requiring certain communication with lawmakers and allowing Congress to hold votes setting parameters for military action. That was the legislative trigger this year for failed Venezuela resolutions and the Iran resolutions.<\/p>\n<p>In 2020, a Democratic-controlled House <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/In 2020, the House narrowly adopted a measure intended to curtail Trump&#039;s powers to take action against Iran.\" target=\"_blank\" rel=\"noopener nofollow\">narrowly adopted<\/a> a measure intended to curtail Trump\u2019s powers against Iran at that point. But in practice the War Powers Resolution has not served as a functional check on executive power. <\/p>\n<p>After Vietnam, presidents assert role as commander in chief<\/p>\n<p>Ronald Reagan sent troops to Lebanon in 1982 as part of a multinational peacekeeping force. He did not cite the War Powers Resolution when notifying Congress and did not agree to congressional authorization until 1983 \u2014 after service members already had died. <\/p>\n<p>In 1990, George H.W. Bush notified Congress under the War Powers Resolution that he\u2019d dispatched troops to the Middle East after Iraq invaded Kuwait. Bush asked Congress for \u201csupport\u201d \u2014 as opposed to \u201cauthorization\u201d \u2014 only after securing U.N. backing for action by an international <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/general-news-e5928ffa60bc45e5a435d2cfa8d93b19\" rel=\"nofollow noopener\" target=\"_blank\">coalition led by U.S. forces<\/a>. Congress authorized force in January 1991. <\/p>\n<p>Bill Clinton deployed U.S. troops multiple times \u2014 to Somalia, Haiti, Rwanda, Bosnia and Herzegovina, Kosovo and Iraq. He asked Congress for appropriations but not explicit authorizations. When some lawmakers pressed Clinton to seek approval for strikes in Iraq in 1998, Clinton asserted his interpretation of presidential authority \u2014 not unlike Trump\u2019s arguments. <\/p>\n<p>Bush calls 9\/11 an act of war \u2014 but never seeks a declaration<\/p>\n<p>George W. Bush quickly mobilized the military after terrorist attacks on Sept. 11, 2001. He consulted quickly with Congress, resulting in a joint resolution authorizing <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/senate-vote-war-powers-iraq-afghanistan-a174a1b97644f2f64994f13b1ff41a20\" rel=\"nofollow noopener\" target=\"_blank\">sweeping action<\/a>. It was unique because no specific country was targeted and it initially focused on al-Qaida. Congress nearly unanimously supported the measure but asked for reports every 60 days. <\/p>\n<p>Mansoor, the military historian, noted that Bush used the vote to conduct antiterrorism efforts anywhere in the world. Bush returned to Congress in 2002, telling leaders he wanted authorization for <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/today-in-history\/march-19\" rel=\"nofollow noopener\" target=\"_blank\">action against Iraq<\/a>. <\/p>\n<p>What Congress <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/2002-iraq-war-vote-senate-reflection-anniversary-bbfcac763a6b253dce18ee6ce5995af2\" rel=\"nofollow noopener\" target=\"_blank\">passed for Bush<\/a> had no effective end date. His successor, Barack Obama, inherited troops in Iraq and did not initially withdraw them.
