{"id":644951,"date":"2026-03-10T06:31:13","date_gmt":"2026-03-10T06:31:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/644951\/"},"modified":"2026-03-10T06:31:13","modified_gmt":"2026-03-10T06:31:13","slug":"arrest-of-phoenix-suns-player-draws-attention-to-arizona-dui-laws","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/644951\/","title":{"rendered":"Arrest of Phoenix Suns player draws attention to Arizona DUI laws"},"content":{"rendered":"<p>Driving under the influence of alcohol and marijuana is punishable in the same way, but the process to prove the charge is different.<\/p>\n<p>SCOTTSDALE, Ariz. \u2014 The arrest of a Phoenix Suns player is drawing attention to Arizona&#8217;s marijuana related DUI laws.\u00a0<\/p>\n<p><strong class=\"cms__embed-related-story\">RELATED: <a href=\"https:\/\/www.12news.com\/article\/sports\/nba\/suns\/it-smells-like-a-dispensary-in-your-car-video-shows-arrest-of-phoenix-suns-dillon-brooks\/75-09abccd0-3597-4b32-9f9b-844cb33d4bf6\" class=\"cms__embed-related-story__link\" rel=\"nofollow noopener\" target=\"_blank\">&#8216;It smells like a dispensary in your car&#8217;: Video shows arrest of Suns&#8217; Dillon Brooks<\/a><\/strong><\/p>\n<p>Driving under the influence of alcohol and marijuana is punishable in the same way, but the process to prove the charge is different.<\/p>\n<p>\u201cIt takes a lot less to charge a marijuana DUI than it does an alcohol DUI,&#8221; criminal defense attorney Josh Kolsrud said.<\/p>\n<p>A Scottsdale police officer stopped Dillon Brooks last Friday morning for allegedly failing to stay in one lane six times.\u00a0<\/p>\n<p>Body-camera video of the traffic stop shows the officer asking Brooks about recent marijuana use several times.\u00a0<\/p>\n<p>&#8220;It smells like a dispensary in your car,&#8221; the officer said.<\/p>\n<p>Brooks told the officer he hadn&#8217;t smoked marijuana in the past six months.<\/p>\n<p>He completed a field sobriety test and blew a 0.0 on the breathalyzer. The officer arrested him, but no charges have been filed yet.<\/p>\n<p>Kolsrud told 12News that field sobriety tests are used to build probable cause of impairment, but these cases often come down to the blood test, which will show the different levels of THC in someone&#8217;s system.<\/p>\n<p>\u201cYou\u2019re going to have primary metabolites, that is, metabolites that are digesting the THC right now. You\u2019re going to have secondary metabolites that are still there, but they\u2019re inactive, maybe from two weeks ago, and then tertiary metabolites that are maybe a month old, where the THC is really being broken down into molecules and almost undetectable,&#8221; Kolsrud said.<\/p>\n<p>Active THC metabolites are needed for prosecutors to have a case, but even then, it doesn&#8217;t prove someone was impaired behind the wheel.<\/p>\n<p>\u201cThat doesn\u2019t automatically mean that you\u2019re guilty.
