{"id":661816,"date":"2026-03-17T10:22:13","date_gmt":"2026-03-17T10:22:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/661816\/"},"modified":"2026-03-17T10:22:13","modified_gmt":"2026-03-17T10:22:13","slug":"nyc-luxury-condo-developer-owes-victims-of-2015-east-village-gas-explosion-1-7m-suit","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/661816\/","title":{"rendered":"NYC luxury condo developer owes victims of 2015 East Village gas explosion $1.7M: suit"},"content":{"rendered":"<p>Former tenants of an East Village building destroyed in <a href=\"https:\/\/nypost.com\/2015\/04\/06\/plumber-says-landlords-son-made-him-illegally-tap-gas-line\/\" rel=\"nofollow noopener\" target=\"_blank\">a fatal 2015 gas explosion<\/a> claim the new owner is stiffing them out of roughly $2 million in housing stipends, according to a new lawsuit.<\/p>\n<p>Developer Yanic Cohen <a href=\"https:\/\/nypost.com\/2017\/06\/11\/les-gas-explosion-lots-sell-for-9-15m\/\" rel=\"nofollow noopener\" target=\"_blank\">shelled out $9.15 million in 2017 <\/a>for the distressed, vacant lots and built a 21-unit \u201cboutique\u201d luxury condo on the Second Avenue site where an explosion, <a href=\"https:\/\/nypost.com\/2016\/02\/11\/5-arrested-in-fatal-east-village-building-explosion\/\" rel=\"nofollow noopener\" target=\"_blank\">caused by an illegal gas line,<\/a> killed two people and destroyed three buildings over a decade ago.<\/p>\n<p>But Cohen \u2014 through an LLC, Avenue Second Owner \u2014 has yet to pay the \u201cpathetic\u201d $1.7 million he legally owes four rent-regulated tenants displaced by the blast, according to their suit filed in Manhattan Supreme Court.<\/p>\n<p>Their building was reduced to rubble on March 26, 2015, in a <a href=\"https:\/\/nypost.com\/2015\/03\/26\/nyc-building-collapse\/\" rel=\"nofollow noopener\" target=\"_blank\">massive seven-alarm <\/a>conflagration that claimed the lives of 23-year-old Nicholas Figueroa and restaurant worker Moises Locon Yac.<\/p>\n<p>The 2015 gas explosion claimed two lives and destroyed three East Village buildings.  Helayne Seidman<\/p>\n<p>The landlord, a contractor and an unlicensed plumber in 2020 were convicted of manslaughter and <a href=\"https:\/\/nypost.com\/2020\/01\/17\/landlord-contractor-and-plumber-sentenced-to-4-to-12-years-for-east-village-gas-explosion\/\" rel=\"nofollow noopener\" target=\"_blank\">sentenced to four to 12 years<\/a> behind bars\u00a0for rigging a hidden basement to illegally siphon gas from a separate building.<\/p>\n<p>When a rent-regulated tenant\u2019s building is destroyed, the owner must either re-house the tenant \u2014 or buy out their leases, according to state regulations.<\/p>\n<p>Darryl Vernon, the tenants\u2019 attorney, said his clients wanted to be re-housed, \u201cbut [they] built a multi-million dollar condominium, and refused to put [my clients] back in.\u201d<\/p>\n<p>\u201cIt\u2019s a little pathetic relative to what you\u2019re giving up,\u201d Vernon said, noting that regular buyouts can reach into the millions.\u00a0<\/p>\n<p>The aftermath of the East Village building explosion. AP<\/p>\n<p>The $1.7 million owed to the tenants was calculated by the state housing agency, and has already been affirmed in a state appellate court, according to the suit.<\/p>\n<p>The owner also notched a major victory in 2023 when the state Division of Housing and Community Renewal ruled that he didn\u2019t have to offer new apartments to the former tenants, but was still on the hook for stipend payments.<\/p>\n<p>\u201cSo we didn\u2019t get apartments, but we got these stipends \u2014 which aren\u2019t a lot \u2014 and [they] won\u2019t even pay those,\u201d said Vernon.<\/p>\n<p>The tenants say they are currently owed a total of $1,709,087, plus interest. AP<\/p>\n<p>Developer Yanic Cohen purchased the distressed vacant lots in 2017 for $9.15 million.
