{"id":666431,"date":"2026-03-19T08:40:00","date_gmt":"2026-03-19T08:40:00","guid":{"rendered":"https:\/\/www.europesays.com\/us\/666431\/"},"modified":"2026-03-19T08:40:00","modified_gmt":"2026-03-19T08:40:00","slug":"mta-goes-to-court-again-to-force-60m-for-second-ave-subway-from-feds","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/666431\/","title":{"rendered":"MTA Goes to Court Again to Force $60M for Second Ave. Subway From Feds"},"content":{"rendered":"<p>The Trump administration is being dragged into court again in the latest funding fight over a key New York transportation project.<\/p>\n<p>The MTA on Tuesday filed a lawsuit that accuses the federal government of withholding $60 million in contractually obligated money for the nearly $7 billion extension of the Second Avenue Subway from the Upper East Side to East Harlem.<\/p>\n<p>\u201cWe intend to get every cent of what has been promised and frankly, based on the agreements, what\u2019s owed to New Yorkers,\u201d Janno Lieber, MTA chairperson and chief executive said Tuesday while testifying before the City Council. \u201cAnd we\u2019re not afraid to fight for it in court, just as we have successfully taken on the feds over congestion pricing.\u201d<\/p>\n<p>The latest legal scrap comes weeks after a federal judge <a href=\"https:\/\/gothamist.com\/news\/federal-judge-says-trump-administration-cant-kill-nycs-congestion-pricing-tolls\" rel=\"nofollow noopener\" target=\"_blank\">rejected the Trump administration\u2019s attempts<\/a> to terminate the Manhattan <a href=\"https:\/\/www.thecity.nyc\/2025\/01\/06\/congestion-pricing-begins-money-manhattan\/\" rel=\"nofollow noopener\" target=\"_blank\">vehicle-tolling plan launched in January 2025<\/a>. It also comes on the heels of <a href=\"https:\/\/www.thecity.nyc\/2026\/02\/18\/gateway-construction-funding-trump-tunnel\/\" rel=\"nofollow noopener\" target=\"_blank\">construction resuming<\/a> last month on Gateway, the massive <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/traffic_and_transit\/2024\/12\/03\/barges-in-hudson-help-build-concrete-casing-for-the-gateway-tunnel-\" rel=\"nofollow noopener\" target=\"_blank\">Hudson River rail tunnel<\/a> project whose funding had been frozen by the feds last year, leading to another court battle and a brief shutdown to work on sites in New York and New Jersey.<\/p>\n<p>Gov. Kathy Hochul said Trump had been warned that more legal action was likely over the freeze on funding. Credit: Rendering via MTA<\/p>\n<p>\u201cWe told Donald Trump that if he did not restore the funding for this project, we\u2019d see him in court \u2014 today, we are doing just that,\u201d Hochul said in a statement. \u201cJust like Gateway, Donald Trump has two options: restore the money now, or wait for a judge to force him to.\u201d<\/p>\n<p>The second phase of <a href=\"https:\/\/www.thecity.nyc\/2020\/09\/20\/mta-property-second-avenue-subway-eminent-domain-transit\/\" rel=\"nofollow noopener\" target=\"_blank\">extending the Q line<\/a> from 96th Street to new stations at 106th, 116th and 125th streets would deliver on decades-old commitments to bring subway service to East Harlem after elevated lines over Second and Third avenues were demolished in the mid-20th century. The <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/in-transit\/2017\/01\/1\/in-transit-1-1-17\" rel=\"nofollow noopener\" target=\"_blank\">first stretch<\/a> \u2014 with stations at 72nd, 86th and 96th streets \u2014 opened Jan. 1, 2017.<\/p>\n<p>\u201cSecond Avenue Subway is an incredibly worthy project, long overdue transit justice for East Harlem, promised since the 1940s,\u201d Lieber said. \u201cAnd Phase 2 is well underway.\u201d<\/p>\n<p>Two of the four contracts have already been awarded for the subway expansion project, which is <a href=\"https:\/\/www.thecity.nyc\/2025\/01\/13\/subways-second-leg-progresses-congestion-pricing-funds\/\" rel=\"nofollow noopener\" target=\"_blank\">partially funded by revenue from congestion pricing<\/a>.\u00a0<\/p>\n<p>The first contract was awarded in January 2024 for the <a href=\"https:\/\/www.thecity.nyc\/2024\/01\/22\/second-avenue-subway-inches-forward-on-phase-two-extension\/\" rel=\"nofollow noopener\" target=\"_blank\">relocation of underground utilities<\/a>, while another followed last August for <a href=\"https:\/\/www.thecity.nyc\/2025\/08\/18\/q-train-harlem-second-avenue-subway-hochul\/\" rel=\"nofollow noopener\" target=\"_blank\">construction of a new tunnel north<\/a> from 116th Street. The second segment of the Second Avenue project will also make use of a <a href=\"https:\/\/ny1.com\/nyc\/all-boroughs\/transit\/2018\/12\/08\/second-avenue-subway-tunnel-never-used-a-rare-look-manhattan-nyc\" rel=\"nofollow noopener\" target=\"_blank\">tunnel built in the 1970s<\/a> that has sat dormant for more than half a century.<\/p>\n<p>It instead has become the latest New York megaproject to be tangled up with the Trump administration, which has been critical of construction costs. The feds <a href=\"https:\/\/www.thecity.nyc\/2025\/10\/02\/second-avenue-subway-trump-cuts-funding\/\" rel=\"nofollow noopener\" target=\"_blank\">put funding on ice last fall<\/a> for the Second Avenue line, as well as Gateway, questioning whether the projects comply with a a USDOT rule on disadvantaged business enterprises.<\/p>\n<p>\u201cUSDOT is committed to ensuring hardworking taxpayer dollars are being spent responsibly,\u201d a spokesperson for the federal Transportation Department said in a statement. \u201cWe are considering all legal avenues.\u201d<\/p>\n<p>Brian Fritsch, of the Permanent Citizens Advisory Committee to the MTA, cited the feds\u2019 spotty track record on court fights over congestion pricing and the Gateway rail tunnel project, adding, \u201cThis crap is getting old.\u201d<\/p>\n<p>\u201cYou\u2019d think [U.S. Transportation] Secretary [Sean] Duffy would get tired of losing lawsuits for clearly unlawful behavior, but here we are again,\u201d he said. \u201cWe\u2019re confident the court will find in the MTA\u2019s favor and applaud Gov.
