{"id":678975,"date":"2026-03-24T19:08:15","date_gmt":"2026-03-24T19:08:15","guid":{"rendered":"https:\/\/www.europesays.com\/us\/678975\/"},"modified":"2026-03-24T19:08:15","modified_gmt":"2026-03-24T19:08:15","slug":"abbott-legal-brief-criticizes-paxtons-rushed-lawsuit-against-harris-countys-immigrant-legal-fund","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/678975\/","title":{"rendered":"Abbott legal brief criticizes Paxton\u2019s rushed lawsuit against Harris County\u2019s immigrant legal fund"},"content":{"rendered":"<p>In a recent brief filed to the Texas Supreme Court, Gov. <a href=\"https:\/\/directory.texastribune.org\/greg-abbott\/\" rel=\"nofollow noopener\" target=\"_blank\">Greg Abbott<\/a> criticized his fellow Republican, Attorney General <a href=\"https:\/\/directory.texastribune.org\/ken-paxton\/\" rel=\"nofollow noopener\" target=\"_blank\">Ken Paxton<\/a>, for rushing a lawsuit challenging a program that provides legal aid to undocumented immigrants.<\/p>\n<p>While Harris County has operated its immigration legal fund for five years, Paxton filed his lawsuit late last year, Abbott noted. After he lost at the district court level, Paxton appealed to the all-Republican 15th Court of Appeals, requesting expedited review within 15 days. <\/p>\n<p>\u201cPerhaps the Attorney General only recently learned of this program; perhaps the office\u2019s attention was focused elsewhere; perhaps some other factor dictated a desire for a ruling before a particular date,\u201d lawyers for Abbott wrote in <a href=\"https:\/\/www.texastribune.org\/wp-content\/uploads\/2026\/03\/abbott-amicus.pdf\" rel=\"nofollow noopener\" target=\"_blank\">the brief<\/a>, filed to the Texas Supreme Court last week. \u201cThe Governor will not speculate.\u201d<\/p>\n<p>Paxton is in a contentious runoff for the GOP Senate nomination against incumbent Sen. <a href=\"https:\/\/directory.texastribune.org\/john-cornyn\/\" rel=\"nofollow noopener\" target=\"_blank\">John Cornyn<\/a>. The deadline he gave the 15th Court to reply was well ahead of the March 3 primary, in which he pulled a close second.<\/p>\n<p><a href=\"https:\/\/www.texastribune.org\/2025\/11\/11\/paxton-sues-harris-county-over-legal-support-for-undocumented-immigrants\/\" rel=\"nofollow noopener\" target=\"_blank\">The 15th Court ruled against Paxton<\/a>, saying he had not produced any proof that, \u201cdespite several years in operation, the program has resulted in any actual harm to residents of Harris County or the state.\u201d <\/p>\n<p>He then appealed to the Texas Supreme Court. Abbott filed an amicus brief supporting Paxton\u2019s legal position \u2014 but blaming the rushed timeline for the adverse outcome at the 15th Court. <\/p>\n<p>\u201cThis emergency \u2014 whether artificial or sincere \u2014 predictably compressed review before the Fifteenth Court,\u201d Abbott&#8217;s lawyers wrote. \u201cAny shortcomings in the lower court\u2019s decision here can easily be attributed to the challenges posed by expedited review.\u201d<\/p>\n<p>Andrew Mahaleris, a spokesperson for Abbott, said in a statement that the governor filed the brief \u201cto put a stop to this illegal spending and ensure taxpayer dollars serve Texans \u2014 not subsidize legal challenges to immigration law.&#8221; <\/p>\n<p>The attorney general&#8217;s office did not respond to a request for comment.<\/p>\n<p>This is not the first time that legal disputes between Paxton and Abbott, a former attorney general and state Supreme Court justice, have splashed out into public view. <\/p>\n<p>When House Democrats left the state to protest last year\u2019s mid-decade redistricting, Abbott asked the Texas Supreme Court to remove them from office. Paxton wrote to the court that while he \u201cappreciates the Governor\u2019s passion,\u201d it was not his place to take this action. Paxton later filed his own lawsuit on the same grounds; the high court consolidated the suits but has not yet ruled on the merits. <\/p>\n<p>Since announcing his Senate run, Paxton has only escalated his usual aggressive pace of litigation. He has filed a flurry of lawsuits against <a href=\"https:\/\/www.texastribune.org\/2025\/11\/14\/texas-attorney-general-paxton-lawsuit-higher-education-coordinating-board\/\" rel=\"nofollow noopener\" target=\"_blank\">state<\/a> <a href=\"https:\/\/www.texastribune.org\/2025\/11\/24\/texas-ken-paxton-housing-department-lawsuits\/\" rel=\"nofollow noopener\" target=\"_blank\">agencies<\/a>, <a href=\"https:\/\/www.texastribune.org\/2025\/11\/11\/paxton-sues-harris-county-over-legal-support-for-undocumented-immigrants\/\" rel=\"nofollow noopener\" target=\"_blank\">county programs<\/a> and <a href=\"https:\/\/www.texastribune.org\/2025\/12\/09\/texas-ken-paxton-nonprofit-immigrant-investigations\/\" rel=\"nofollow noopener\" target=\"_blank\">nonprofits<\/a>, and used the agency\u2019s legal opinion arm to <a href=\"https:\/\/www.texastribune.org\/2026\/01\/19\/ken-paxton-john-cornyn-mlk-day-legal-opinion-dei-republican-primary-senate\/\" rel=\"nofollow noopener\" target=\"_blank\">target Cornyn<\/a>, who also used to be attorney general.
