A CVS worker was within his rights to fatally stab a serial shoplifter<\/a> in a Midtown store, his defense lawyer argued Wednesday \u2014 telling jurors the chronic thief sparked the deadly encounter when he \u201cbashed\u201d his client\u2019s head. <\/p>\n

Scotty Enoe acted in self-defense as he took out his pocket knife and stabbed 50-year-old homeless man Charles Brito, 48, eight times during the early morning July 2023 scuffle, attorney Frank Rothman said during opening statements of Enoe\u2019s closely watched manslaughter trial.<\/a><\/p>\n

\u201cThis is a fight. He was getting his head bashed in by the cooler,\u201d Rothman said, calling Enoe\u2019s actions \u201cconsistent with defense\u201d and \u201creasonable under the circumstances.\u201d<\/p>\n

Scotty Enoe faces up to 25 years in prison if convicted on a manslaughter charge in the July 2023 slaying. Steven Hirsch<\/p>\n

Manhattan Assistant District Attorney\u00a0Julie Nobel\u00a0conceded that Brito punched Enoe first and that the CVS worker, whose job was to stock the fridges at the Broadway and West 49th Street store, \u201cwasn\u2019t getting the best of the fight.\u201d\u00a0<\/p>\n

But once the pair, who had tussled on the floor, ended up back on their feet, Enoe broke the law by pulling out his folding knife \u2014 which he carried to open cardboard boxes \u2014 charging the unarmed Brito and repeatedly stabbing him, the prosecutor argued. <\/p>\n

A bloodied Brito stumbled onto the sidewalk with two stab wounds to his liver, and died from his injuries.<\/p>\n

The slain homeless man had been arrested more than a dozen times and was a known serial thief <\/a>at drugstores in the area, police sources have told the Post.<\/p>\n

Before the fatal encounter, Brito had several other run-ins with Enoe.<\/p>\n

And just a few before Brito died, he walked into the same CVS and \u201cscooped up as many umbrellas as he could,\u201d said Rothman, who described the Times Square area as a haven for shoplifters and many \u201cundesirables.\u201d<\/p>\n

Before the fight broke out, Brito had shouted, \u201cYou can\u2019t f\u2013cking stop me. I\u2019ll f\u2013ck you up. I\u2019m going to steal. You can\u2019t stop me,\u201d Rothman told the jury.<\/p>\n

\u201cHe came on a mission to beat and to steal,\u201d the lawyer added.<\/p>\n

Enoe has been out on electronic monitoring after\u00a0making $100,000 bail<\/a>.<\/p>\n
