BEXAR COUNTY, Texas<\/strong> \u2013 Erik Cantu, who has been arrested six times<\/a> since he survived being shot by a police officer in 2022<\/a>, was expected to make his second court appearance in two days related to a motion to revoke his probation. <\/p>\n

Instead, Cantu returned to Bexar County\u2019s 187th Criminal District Court just after 9:30 a.m. Wednesday. <\/p>\n

The reason for Tuesday\u2019s delay: Charles Bunk, the attorney representing Cantu, said an important defense witness was not present in court. Judge Stephanie Boyd, who presides over the court, granted the defense\u2019s request. <\/p>\n

However, on Wednesday, Bunk said there will be no new witnesses. <\/p>\n

The continuation of Cantu\u2019s hearing was originally scheduled to resume at 10 a.m. Tuesday<\/a> after initially beginning on Monday. <\/p>\n

Boyd did not decide on whether to revoke Cantu\u2019s probation<\/a> during the Monday hearing. Prosecutors presented hours of evidence with Cantu\u2019s ex-girlfriend, Emily Proulx, among the witnesses who testified.<\/p>\n

Cantu, 21, is accused of breaking into Proulx\u2019s home in early December and stealing her tablet<\/a>. Proulx has since asked the Bexar County District Attorney\u2019s Office to drop the burglary charge<\/a>.<\/p>\n

During Monday\u2019s hearing, GPS evidence and testimony from a Bexar County sheriff\u2019s deputy assigned to monitor Cantu\u2019s house arrest device indicated Cantu was at Proulx\u2019s apartment while on house arrest.<\/p>\n

His burglary arrest triggered Wednesday\u2019s hearing, since Cantu was on probation and under GPS monitoring in a pair of evading arrest cases.<\/p>\n

Cantu\u2019s early December arrest was his latest brush with the law since he was shot multiple times in 2022 by ex-San Antonio police officer James Brennand in a McDonald\u2019s parking lot.<\/p>\n

The burglary incident happened less than a month after Cantu was sentenced to eight years of probation<\/a> for violating the terms of his probation from two evading arrest cases last year.<\/p>\n

After Cantu\u2019s arrest, prosecutors moved to revoke his probation.<\/p>\n

Brennand, who has been charged with aggravated assault by a public servant, is scheduled to next appear in court in mid-April.<\/p>\n

Cantu faces up to six years in prison. <\/p>\n
