{"id":73794,"date":"2025-07-18T22:33:09","date_gmt":"2025-07-18T22:33:09","guid":{"rendered":"https:\/\/www.europesays.com\/us\/73794\/"},"modified":"2025-07-18T22:33:09","modified_gmt":"2025-07-18T22:33:09","slug":"sam-gilliam-foundation-david-kordansky-sued-over-disavowed-painting","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/73794\/","title":{"rendered":"Sam Gilliam Foundation, David Kordansky Sued Over &#8216;Disavowed&#8217; Painting"},"content":{"rendered":"<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\t<a href=\"https:\/\/www.artnews.com\/t\/david-kordansky\/\" id=\"auto-tag_david-kordansky\" data-tag=\"david-kordansky\" target=\"_blank\" rel=\"noopener\">David Kordansky<\/a> gallery and the <a href=\"https:\/\/www.artnews.com\/t\/sam-gilliam\/\" id=\"auto-tag_sam-gilliam\" data-tag=\"sam-gilliam\" target=\"_blank\" rel=\"noopener\">Sam Gilliam<\/a> Foundation are facing a <a href=\"https:\/\/www.artnews.com\/t\/lawsuit\/\" id=\"auto-tag_lawsuit\" data-tag=\"lawsuit\" target=\"_blank\" rel=\"noopener\">lawsuit<\/a> over their alleged attempts to \u201cdisavow\u201d what one entity claims is a genuine drape painting by the late artist.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tDrax Fine Art, LLC, which is registered in Albany, New York, filed suit against the gallery, the foundation, and Gilliam\u2019s widow, Annie Gawlak, on July 16.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tIn a summons submitted in the Supreme Court of the State of New York, Drax Fine Art accused David Kordansky and the <a href=\"https:\/\/www.artnews.com\/t\/sam-gilliam-foundation\/\" id=\"auto-tag_sam-gilliam-foundation\" data-tag=\"sam-gilliam-foundation\" target=\"_blank\" rel=\"noopener\">Sam Gilliam Foundation<\/a> of \u201cconcerted efforts to disavow and defame an authentic \u2018drape painting.\u201d The entity is now seeking $6 million in damages.<\/p>\n<p>\t\tRelated Articles<\/p>\n<p>\t\t\t\t\t\t<img decoding=\"async\" class=\"c-lazy-image__img lrv-u-background-color-grey-lightest lrv-u-width-100p lrv-u-display-block lrv-u-height-auto\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/GettyImages-103983807.jpg\" data-lazy-src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/GettyImages-103983807.jpg\" alt=\"Portrait of David Mimran.\" data-lazy- data-lazy- height=\"\" width=\"\"\/><\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tIn a joint statement to ARTnews, David Kordansky and the Sam Gilliam Foundation said the claims in the summons were \u201cabsolutely frivolous\u201d and said they would respond to a complaint if and when one is submitted.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\t\u201cThere have been cases going back to the 1970s where people have taken remnants, often polypropylene that was on the floor of the studio that served as drop cloths, and attempted to sell them as authentic works,\u201d the gallery and the foundation said. \u201cThe piece in question is unsigned and undated, which does not conform to Gilliam\u2019s practice. There are also serious issues of composition and scale for a drape work from this period.\u201d<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tThrough a lawyer, Drax Fine Art told ARTnews that the painting is an untitled work from 1972. According to Drax Fine Art, the work was acquired by an architectural firm from Carl Solway Gallery, a space in Cincinnati that gave Gilliam four solo shows during the 1970s and \u201980s. The painting was then \u201cinstalled in their lobby until it was acquired by Drax Fine Art,\u201d per Drax\u2019s statement, which adds that the gallery had \u201cacquired the Sam Gilliam work in question\u2014a 16 x 26 ft \u2018drape painting\u2019\u2014directly from the artist in 1989 before selling it.\u201d<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tDrax alleged to ARTnews that it had attempted to sell the painting at auction and that David Kordansky and the Sam Gilliam Foundation \u201cblocked the sale by taking the absurd position that museum quality and fully reversible restoration efforts somehow constituted irreparable property damage.\u201d<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tA forensic analysis was then undertaken, Drax claims, and it was determined that it would be possible to restore the piece. \u201cIn light of the forensic and documentary evidence, the Foundation\u2019s position raises very troubling questions about the Defendants\u2019 true intentions to manipulate the Sam Gilliam market and disparage a significant work of art,\u201d Drax said in its statement.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tPressed for detail on Drax Fine Art, a lawyer described it as \u201can\u00a0entity that was formed to house and manage a private art collection.\u201d ARTnews was unable to establish whose collection Drax Fine Art manages. They are often suspended from the walls, so that they appear to dangle or hover, and are occasionally tied in some places.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tDrax\u2019s lawyer sent to\u00a0ARTnews\u00a0a picture of the work at the center of the lawsuit. It shows a tall unstretched canvas tied in three places, creating a triangular form. The piece seems to have been flecked in places with paint. (The image has not been submitted to the court as an exhibit, but was confirmed as the work in question by both David Kordansky gallery and the Sam Gilliam Foundation.)<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tIn addition to being prized by critics and art historians, Gilliam\u2019s drape paintings are valuable on the market. In <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2020-02-06\/an-artist-born-in-1933-finds-his-hottest-market-in-2020\" rel=\"nofollow noopener\" target=\"_blank\">a 2020 Bloomberg article<\/a>, David Kordansky, the dealer who founded his Los Angeles\u2013based gallery, said that he sold Street (1970) to the San Francisco Museum of Modern Art for just under $2 million in 2019.<\/p>\n<p class=\"paragraph larva \/\/ a-font-body-m     \">\n\tDrax\u2019s lawsuit was filed exactly two months after Gilliam\u2019s auction record was re-set.
