The petition alleges that \u201cnatural gas leaking from CPS Energy\u2019s gas distribution pipeline migrated into their home where it ignited and exploded.<\/p>\n<p>\u201cThough (The Nowells) survived, the explosion and resulting fire left them catastrophically injured,\u201d the filing states, adding that they face \u201ca long and painful road to recovery.\u201d<\/p>\n<p>A family friend gave an update Friday morning on the conditions of the Nowell Family. <\/p>\n<p>&#8220;Tim is continuing to recover after undergoing additional skin grafts and participating in physical therapy, including tilt table therapy to aid his healing. Doctors say he is making strong progress and describe his recovery trajectory as positive. Kim has begun to wake up and respond, and is also showing improvement in her breathing, with continued progress expected. Reeves and Ochoa were hospitalized with serious injuries.<\/p>\n<p>That lawsuit alleges CPS Energy failed to properly inspect, maintain, and repair its natural gas infrastructure. It also claims employees provided inaccurate safety information by telling residents it was safe to return home after the initial explosion.<\/p>\n<p>In addition, the filing alleges negligence in training, supervision, and inspection practices and says CPS Energy failed to identify or address hazardous conditions in its gas system before the explosions occurred.<\/p>\n<p>The Reeves and Ochoa lawsuit also includes gross negligence claims and seeks more than $1 million in damages for each plaintiff, including medical expenses, pain and suffering, mental anguish, lost income, and other losses.<\/p>\n<p>Together, the lawsuits represent a broader legal challenge to CPS Energy over the same series of explosions that injured multiple residents on the Northeast Side.<\/p>\n<p>Claims Against CPS Energy<\/p>\n<p>The Nowell lawsuit accuses CPS Energy of negligence and gross negligence, alleging failures in training, inspection, maintenance, and emergency response.<\/p>\n<p>It states CPS Energy \u201cfailed to properly train its employees and contractors,\u201d \u201cfailed to properly inspect its natural gas system,\u201d and \u201cfailed to warn Plaintiffs, and other members of the public, of the known and imminent dangers associated with CPS Energy\u2019s aging and deteriorating gas infrastructure.\u201d<\/p>\n<p>The petition further alleges the utility acted with \u201ca conscious indifference to the rights, safety, or welfare of others.\u201d<\/p>\n<p>Damages Sought<\/p>\n<p>The family is seeking more than $1 million in damages, including medical expenses, pain and suffering, mental anguish, lost income, and other losses.
