tenants. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"N6WSQXEMR5APZL3HSOQJWQVKFI\">Both Jersey City and Hoboken have taken action this year to prevent landlords from using such algorithms to potentially inflate rental costs through coordinated pricing strategies using the software. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GOJBMWXRFJCC5A34OINBNQ6AMM\">However, these cities aren\u2019t the only ones pushing back against the software and high rents.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6DVKHWI5FNGFFFSA7V4QNEK3QQ\">Cities across the country are fighting against it. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GOGNJ4AHGZG4HIAPYZUPZQYW4E\">The New Jersey Attorney General and federal officials got involved last year with separate lawsuits against companies that provide price fixing software.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"7WJQAXXMUZFCLN4SHAGNTAPLS4\">The Justice Department, along with the Attorneys General of North Carolina, California, Colorado, Connecticut, Minnesota, Oregon, Tennessee, and Washington, filed a civil antitrust lawsuit last year against RealPage Inc. for \u201cits unlawful scheme to decrease competition among landlords in apartment pricing and to monopolize the market for commercial revenue management software that landlords use to price apartments,\u201d <a href=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/justice-department-sues-realpage-algorithmic-pricing-scheme-harms-millions-american-renters#:~:text=The%20Justice%20Department%2C%20together%20with,and%20harms%20millions%20of%20Americans\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/justice-department-sues-realpage-algorithmic-pricing-scheme-harms-millions-american-renters#:~:text=The%20Justice%20Department%2C%20together%20with,and%20harms%20millions%20of%20Americans\">according to a statement from the department. <\/a><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KTIUARHSLZHDBCIUGSBZXM2DMQ\">RealPage\u2019s alleged conduct deprives renters of the benefits of competition on apartment leasing terms and harms millions of Americans, the statement said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KPDZUADYABBBVLZ2VTFXU5ISTM\">The bans on the price fixing software reflect a growing movement in New Jersey and across the country.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZK6HRQINJVB2PCV5OAXSOQE7EI\">Those fighting back claim algorithmic price fixing for rent is unfair because it can lead to artificially inflated prices and reduced competition, making housing less affordable for tenants.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3O6AXOU2YFC25CGSDLLU4C7BBY\">These algorithms analyze data to suggest prices that maximize profits for landlords, potentially ignoring market conditions and preventing tenants from negotiating better deals. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MW5HGA6NTNFLVCMFCP67FRVZDY\">Ultimately, it can create a situation where tenants are forced to pay more than they would in a truly competitive market, opponents say.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"77LJ5YS7IBDHDJY26HUD4W7SQE\">Last year, San Francisco made history by implementing the nation\u2019s first ban on software that uses algorithms to set rents for tenants, <a href=\"https:\/\/www.sf.gov\/information--algorithmic-devices-set-rent-are-prohibited-san-francisco\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.sf.gov\/information--algorithmic-devices-set-rent-are-prohibited-san-francisco\">according to the city\u2019s website<\/a>.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5V2XOIQ7D5DYNBXBFTGZXK6D4Y\">In Philadelphia, legislation restricting the use of nonpublic competitor data<b> <\/b>in setting rental prices was passed in 2024, <a href=\"https:\/\/phlcouncil.com\/councilmember-orourkes-algorithmic-rental-price-fixing-ban-passes-council-heads-to-mayor-parkers-desk\/\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/phlcouncil.com\/councilmember-orourkes-algorithmic-rental-price-fixing-ban-passes-council-heads-to-mayor-parkers-desk\/\">according to the city\u2019s website<\/a>. Other cities like Minneapolis and San Diego are also cracking down with their own bans set up in the spring. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DL32SIGCINABLMAC3F6EH733JM\">In New Jersey, <a href=\"https:\/\/www.nj.com\/hudson\/2025\/05\/this-nj-city-just-banned-secret-rent-software-landlords-use-to-jack-up-prices.html\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.nj.com\/hudson\/2025\/05\/this-nj-city-just-banned-secret-rent-software-landlords-use-to-jack-up-prices.html\">Jersey City became the first municipality in New Jersey to ban these algorithms<\/a> when it took action in May. Hoboken soon <a href=\"https:\/\/www.hobokennj.gov\/news\/city-of-hoboken-outlaws-algorithmic-rent-fixing\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.hobokennj.gov\/news\/city-of-hoboken-outlaws-algorithmic-rent-fixing\">followed in July. <\/a><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QI76CRYL7FEJXFMRQNZ5PVXF2E\"><a href=\"https:\/\/www.nj.com\/hudson\/2024\/07\/looking-for-a-fight-tenants-union-and-jersey-city-are-taking-on-rent-hiking-algorithm-realpage.html\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.nj.com\/hudson\/2024\/07\/looking-for-a-fight-tenants-union-and-jersey-city-are-taking-on-rent-hiking-algorithm-realpage.html\">Officials say these measures aim to protect tenants<\/a> from potentially unfair and artificial rents by prohibiting the use of software that shares data between landlords to determine prices. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SGXVPJ2YPJDSPDXCJBJ6E5W7F4\">Both Jersey City and Hoboken officials have expressed support for statewide legislation banning the use of such rent-setting algorithms.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NRCNEI5IJ5HSHJKAZXVZAWFKSM\">Several bills have been introduced in the New Jersey Legislature to address this issue. One that would <a href=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2024\/A4916\/bill-text?f=A5000&amp;n=4916_I1\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2024\/A4916\/bill-text?f=A5000&amp;n=4916_I1\">prohibit the use and sale of algorithmic devices<\/a> for setting rent and another that <a href=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2024\/S3657\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.njleg.state.nj.us\/bill-search\/2024\/S3657\">make using those systems illegal.<\/a><\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"S5S735ZADFDYLFPISXGCUGQQDA\"><a href=\"https:\/\/www.nj.com\/news\/2025\/04\/these-10-nj-landlords-are-scheming-with-software-firm-to-drive-up-rents-state-says.html\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.nj.com\/news\/2025\/04\/these-10-nj-landlords-are-scheming-with-software-firm-to-drive-up-rents-state-says.html\">The New Jersey Attorney General has filed a lawsuit against RealPage <\/a>and 10 large New Jersey landlords, alleging a rent-raising scheme that violates antitrust and consumer protection laws by using algorithmic software to collude and suppress competition.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"UAMSVQUZ6VCTBMSWTOPVPYDSH4\">The property management software company <a href=\"https:\/\/www.realpage.com\/\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/www.realpage.com\/\">RealPage<\/a>, based in Texas, and the landlords allegedly used a pricing software that forced tens of thousands of New Jerseyans to overpay for rent, state Attorney General Matthew Platkin said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WD5QXN4L25CGJECZN4G35U7AV4\">\u201cI\u2019m not going to tolerate corporate greed that violates the law and hurts our residents,\u201d Platkin said previously. \u201cOur lawsuit today is seeking to make RealPage both stop their illegal conduct and pay back their illegal profits.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YGCF52K7DVGWRDFHPHTEGV5VME\">RealPage did not return a request for comment. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OTEWD2FX4JFE5JQCOLTGT5FHJY\">Thank you for relying on us to provide the local news you can trust.
