{"id":801919,"date":"2026-05-17T02:32:54","date_gmt":"2026-05-17T02:32:54","guid":{"rendered":"https:\/\/www.europesays.com\/us\/801919\/"},"modified":"2026-05-17T02:32:54","modified_gmt":"2026-05-17T02:32:54","slug":"nycs-latest-excuse-for-unearthing-long-denied-9-11-toxin-files-we-were-replacing-the-carpets","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/801919\/","title":{"rendered":"NYC&#8217;s latest excuse for unearthing long-denied 9\/11 toxin files: We were replacing the carpets"},"content":{"rendered":"<p>A third of the 68 boxes containing pivotal <a href=\"https:\/\/www.nydailynews.com\/2025\/11\/22\/nyc-long-claimed-it-had-no-info-on-the-9-11-toxins-at-ground-zero-now-they-have-68-boxes-worth\/\" rel=\"nofollow noopener\" target=\"_blank\">documents about the toxins swirling over Ground Zero<\/a> that the city claimed for years didn\u2019t exist were actually discovered during a remodeling project and \u201ccarpet installation\u201d at the city\u2019s Department of Environmental Protection offices, city attorneys humbly admitted as a judge ordered agency heads who denied the documents\u2019 existence to be questioned under oath.<\/p>\n<p>City attorneys said 22 of the boxes were found as DEP employees cleaned out a storage area on the eighth floor in preparation for the new carpets. The rest of the boxes were found in long-term storage, according to a source with knowledge of the case.<\/p>\n<p>While he hasn\u2019t filed his written decision yet, New York Civil Court Judge James Clynes, during a hearing on Monday, ordered the DEP to produce the agency officials who denied repeated Freedom of Information Law requests for the documents and explain how the city missed these boxes during the diligent searches they claim to have completed.<\/p>\n<p>Clynes\u2019 decision came at the same time Mayor Mamdani, who hasn\u2019t spoken on advocates\u2019 demands to have the Ground Zero documents released, <a href=\"https:\/\/www.nyc.gov\/site\/fdny\/news\/FS2326\/fdny-commissioner-lillian-bonsignore-hosts-mayor-zohran-mamdani-new-york-city-officials-9-11\" rel=\"nofollow noopener\" target=\"_blank\">attended a breakfast<\/a> at the 9\/11 Memorial &amp; Museum hosted by Fire Commissioner Lillian Bonsignore.<\/p>\n<p>Both the Mayor\u2019s office and the city Law Department declined to comment on Clynes order to have DEP officials deposed.<\/p>\n<p>Attorneys for 9\/11 advocates, who <a href=\"https:\/\/www.nydailynews.com\/2025\/09\/20\/nyc-reverses-long-running-claim-it-cant-find-documents-on-what-city-hall-knew-about-9-11-toxins\/\" rel=\"nofollow noopener\" target=\"_blank\">have been trying to get the documents through FOIL for the last three years<\/a>, found the city\u2019s carpeting excuse almost laughable.<\/p>\n<p>\u201cI am not aware of any Freedom of Information Law exemption for interior decorating,\u201d said attorney Andrew Carboy, who is representing the families of 9\/11 illness victims and 9\/11 Health Watch. \u201cThis is what we are dealing with. This is what our brave first responders and survivors are facing. This is a city that does not care about them and will not yield its secret September 11 archive willingly.\u201d<\/p>\n<p>Carboy intends to bring up the carpet installation, as well as the city\u2019s other ongoing stall tactics, when DEP officials who had denied the FOIL requests are deposed in court in early July.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"Workers and first responders continue recovery operations at the World Trade Center site on September 14, 2001. (Todd Maisel \/ New York Daily News)<\/p>\n<p>One of the DEP officials to be deposed will be the agency\u2019s public records officer, who rejected attorneys appeals for the documents when DEP said they couldn\u2019t find any to share, Clynes ordered.<\/p>\n<p>\u201cWe are glad that the court is allowing us to take sworn testimony and get definitive answers,\u201d Carboy said. \u201cThese officials should explain, under oath, why they issued sworn denials, rejected our appeal, and aggressively moved to dismiss our case as a \u2018baseless fishing expedition.\u2019 Why did DEP suddenly reverse course and admit to having the records all along?\u201d<\/p>\n<p>Benjamin Chevet, the executive director of 9\/11 Health Watch, said Clynes decision is an \u201cextraordinary remedy\u201d in the ongoing struggle for documents.<\/p>\n<p>\u201cWe feel it is clear from the record, and from what the City said in court on Monday, that discovery is needed,\u201d Chevet said, adding that Mamdani could fix all this by ordering the documents released.<\/p>\n<p>\u201cWhile Mayor Mamdani was apparently visiting the 9\/11 Museum that day, his lawyer was in court essentially defending the Adams\u2019 administration denial that DEP had any records at all of what the Giuliani Administration did in response to 9\/11,\u201d he said. \u201cI have been saying since Mayor Mamdani was elected last year that he could be the Mayor, who finally answers the question: what did the City know about the hazards caused by the toxic chemicals at Ground Zero, and when did it know it?\u00a0 But he can\u2019t be that Mayor if his lawyer is defending the prior administration actions.\u201d<\/p>\n<p>The carpet installation explanation \u2014 nearly 25 years after the attack \u2014 is the latest chapter on an ongoing saga about the level of toxic exposure in lower Manhattan after the terror attacks and how safe the air was when city officials gave the green light to resume business in the area.<\/p>\n<p>For years, city officials claimed they couldn\u2019t find any documents about what and when City Hall knew about the dangers of the 9\/11 toxins swirling around Ground Zero.<\/p>\n<p>That was until last year, when the DEP discovered the 68 boxes of information that could be pivotal in <a href=\"https:\/\/www.nydailynews.com\/2024\/09\/10\/proposed-nyc-council-bill-would-lead-to-unearthing-of-long-sought-9-11-air-toxin-reports\/\" rel=\"nofollow noopener\" target=\"_blank\">learning more about what first responders and survivors were exposed to<\/a>.<\/p>\n<p>Andrew Ansbro, the president of the FDNY\u2019s Uniformed Firefighters Association, which has lost more than 400 members to 9\/11 illness \u2014 more than the 343 who died during the terror attack \u2014 hailed Judge Clyne\u2019s order \u201cthat the DEP officials that participated in the 9\/11 document coverup to appear before him.\u201d<\/p>\n<p>\u201cThose who are sick and the families of those who have died deserve the truth about those who knew the air wasn\u2019t safe, and who chose protect the cities coffers instead of the lives of firefighters, recovery workers and civilians,\u201d Ansbro said. \u201cThe only way to insure that a lie like this never happens in the future, is to hold accountable those that have done it in the past.\u201d<\/p>\n<p>In 2023, Carboy requested records from the DEP regarding the city\u2019s response to the collapse of the World Trade Center, along with historical documents and disaster preparation materials, according to the group\u2019s lawyers<\/p>\n<p>Specifically, he and the 9\/11 Health Watch wanted to know why then-Mayor Rudolph Giuliani requested liability protection from toxic exposure even as he city repeatedly reassured the public that air quality remained \u201csafe and acceptable.\u201d<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" lazyautosizes lazyload\" alt=\"Search and recovery operations continue at the World Trade Center site on Sep. 14, 2001. (Todd Maisel \/ New York Daily News)<\/p>\n<p>Among those seeking answers is Lower East Side state Assembly candidate <a href=\"https:\/\/www.mariamajames.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Mariama James<\/a>, whose parents died of cancer and complications due to 9\/11 toxins.<\/p>\n<p>\u201cMy mother worked at Deutsche Bank (at Ground Zero). She should have been removed, and she was sent back to work like pretty much immediately,\u201d James recalled. \u201cThey reopened Wall Street and told all those people to go back to work. She died of cancer. I was almost nine months pregnant. My dad was babysitting, so he was in the dust cloud, consequently, and died from the 911 toxins as well. But within the time, we were all told that it was safe to be out in that air, that we didn\u2019t need any masks that we could clean up our apartments with a wet rag. All kinds of ridiculousness.\u201d<\/p>\n<p>The DEP discovered their documents in November, while Mayor Eric Adams was still in office.<\/p>\n<p>The Adams administration as well as its predecessors, have fought the release of any 9\/11 studies and documents, claiming they couldn\u2019t find them. The city has also repeatedly said it was worried about a barrage of lawsuits from survivors and first responders suffering from 9\/11 illnesses if the documents were released.<\/p>\n<p>Since the discovery, the city said they plan to be more transparent with 9\/11 documents. Newly sworn in Corporation Counsel Steve Banks at a recent budget hearing said he had \u201cset up a team that is reviewing what documents can be posted on a portal to provide access to the public and the cost for maintaining such access and what documents cannot be posted.\u201d<\/p>\n<p>\u201cWe\u2019re working on this very hard to be able to, as I said, post documents to be available to the public,\u201d Banks said.<\/p>\n<p>His decision on what will be released or a timeline on the decision hasn\u2019t been announced.<\/p>\n<p>At the same time, the City Council has <a href=\"https:\/\/www.nydailynews.com\/2025\/09\/10\/what-did-nyc-know-about-the-9-11-toxins-at-ground-zero-after-20-years-the-truth-may-soon-come-out\/\" rel=\"nofollow noopener\" target=\"_blank\">tasked the city Department of Investigation with finding out what the city knew about the toxins<\/a>. The DOI probe is expected to be completed in two years if the city approves a $3 million request to hire outside investigators for the mammoth task, the agency said.<\/p>\n<p>More\u00a0than <a id=\"m_-3628643948672316407OWA4ab1e13e-d8c8-073f-b878-779b5b38d5a7\" title=\"https:\/\/www.cdc.gov\/wtc\/ataglance.html\" href=\"https:\/\/www.cdc.gov\/wtc\/ataglance.html\" target=\"_blank\" rel=\"noopener nofollow\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/www.cdc.gov\/wtc\/ataglance.html&amp;source=gmail&amp;ust=1778694994652000&amp;usg=AOvVaw0nc3r5-tlh8mp3YtaNc5SO\">9,000 people<\/a> have now died from 9\/11-related illnesses, nearly three times the number killed on September 11, 2001 itself, officials said.<\/p>\n<p>More than 140,000 first responders and survivors are enrolled in the U.S. Center for Disease Control\u2019s\u00a0WTC Health Program,\u00a0which provides health care benefits for medical conditions related to exposure to the toxins that hung over Ground Zero. Out of that number, about 81,000 have a certified condition linked to the toxins that hung above Ground Zero.<\/p>\n<p>The unearthed documents won\u2019t likely cause a flurry of lawsuits since first responders and survivors who are receiving help from the WTC Health Program and the 9\/11 Victim Compensation fund have already signed waivers agreeing not to sue over their illnesses.
