A New York appellate court is ordering a\u00a0new trial<\/a>\u00a0for a convicted killer, Donald White, because \u2014 wait for it \u2014 his buddy was kicked out of the courtroom for napping.\u00a0<\/p>\n

That\u2019s right: Loony judges Betsy Barros, Barry Warhit, Lourdes Ventura and Donna-Marie Golia don\u2019t deny that the \u201cweight of the evidence\u201d backs a guilty verdict.<\/p>\n

But they say White was denied his right to a \u201cpublic trial\u201d because his friend was booted, and never mind that it was only for a day.<\/p>\n

White was convicted of making his way into a Queens pot dealer\u2019s house and shooting him in the head, with the help of an accomplice in a \u201cScream\u201d Halloween mask.<\/p>\n

But the trial judge\u2019s decision to eject the defendant\u2019s snoozing pal was enough for the appellate court to throw out the entire conviction and give the murderer a second chance with a whole new trial.<\/p>\n

Maybe the judges think the lower courts don\u2019t have enough cases backed up and prosecutors have way too much time on their hands, so they ordered a do-over for whatever reason they could come up with.<\/p>\n

Or maybe it was just a knee-jerk reflex by lefty jurists who look for any excuse not to make perps pay serious consequences for their crimes.<\/p>\n

Judges, after all, do have some discretion to kick people out of their courtrooms for bad behavior.<\/p>\n

But the ruling makes it clear why so many criminals in New York think crime pays \u2014 that no matter what they do, even killing someone, they won\u2019t suffer much, if at all.<\/p>\n
