{"id":831403,"date":"2026-05-30T02:46:14","date_gmt":"2026-05-30T02:46:14","guid":{"rendered":"https:\/\/www.europesays.com\/us\/831403\/"},"modified":"2026-05-30T02:46:14","modified_gmt":"2026-05-30T02:46:14","slug":"union-challenges-return-to-office-with-californias-landmark-environmental-law","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/831403\/","title":{"rendered":"Union challenges return-to-office with California&#8217;s landmark environmental law"},"content":{"rendered":"\n<p>In what appears to be a new application of California\u2019s landmark \u2014 yet often criticized \u2014 environmental law, a union representing state legal workers invoked the statute to challenge Gov. Gavin Newsom\u2019s <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2025-03-03\/newsom-orders-state-workers-return-to-the-office\" rel=\"nofollow noopener\" target=\"_blank\">2025 return-to-office mandate<\/a>.<\/p>\n<p>The union argued that the state\u2019s mandate of in-office work four days a week wasn\u2019t properly reviewed under the California Environmental Quality Act, known as CEQA, according to a <a class=\"link\" href=\"https:\/\/calattorneys.org\/wp-content\/uploads\/2026\/05\/CASE-CEQA-Exhaustion-Letter-Caltrans.pdf\" target=\"_blank\" rel=\"nofollow noopener\">letter sent this week<\/a> to more than 104 state agencies and departments. Thousands of state employees have been working from home since the COVID-19 pandemic, but the return-to-office mandate is now set to go into effect July 1, according to union officials. <\/p>\n<p>The letter from CASE, a labor group that represents attorneys, administrative law judges and hearing officers employed by state agencies, argued that the mandate \u201cwill result in significant environmental impacts,\u201d and promised legal action if the state doesn\u2019t conduct such an environmental review. <\/p>\n<p>\u201cClearly, the state\u2019s blanket mandate that more than 90,000 workers commute to offices four days a week will impact California\u2019s environment,\u201d Richard Drury, an attorney representing CASE, said in a statement. \u201cBut no environmental impact report for this project exists. We are asking the state to complete the report its own laws require before moving forward.\u201d<\/p>\n<p>The letter argued that the four-day return to office \u201cwill require hundreds of thousands of additional monthly commutes by state workers, creating hundreds of thousands of new car trips and thousands of tons of additional air pollution from automobile tailpipes.\u201d<\/p>\n<p>The governor\u2019s office did not immediately respond to a request for comment. <\/p>\n<p>CEQA, adopted in 1970, has been credited for protecting California\u2019s natural resources and minimizing pollutants, but it\u2019s also increasingly <a class=\"link\" href=\"https:\/\/www.latimes.com\/homeless-housing\/story\/2025-06-02\/new-ceqa-legislation-most-aggressive-in-generations\" rel=\"nofollow noopener\" target=\"_blank\">come under fire<\/a> for its broad application, sometimes weaponized by opponents of a project, even environmentally friendly ones, like <a class=\"link\" href=\"https:\/\/www.latimes.com\/politics\/la-pol-sac-enviro-bike-lanes-20160407-story.html\" rel=\"nofollow noopener\" target=\"_blank\">bike lanes<\/a>, or <a class=\"link\" href=\"https:\/\/www.latimes.com\/california\/story\/2023-02-24\/court-ruling-halts-uc-berkeley-from-building-student-housing-at-peoples-park\" rel=\"nofollow noopener\" target=\"_blank\">needed housing<\/a>.<\/p>\n<p>UC Davis law professor Chris Elmendorf said he wasn\u2019t surprised to see union attorneys try to apply CEQA to personnel policies, but he did find it novel. <\/p>\n<p>And given case law about CEQA, he said the union has \u201ca very plausible argument.\u201d But he also said it again illustrates how CEQA\u2019s \u201cacross-the-board rule that always favors the status quo &#8230; is not a very practical\u201d one, said Elmendorf, who tracks environmental legislation that affects housing.
