You\u2019ve probably seen the billboards. On top of everything else fire survivors are dealing with, a question arises \u2014 should you also join a lawsuit?<\/p>\n<p>Should fire survivors join a lawsuit? Here\u2019s a guide<\/p>\n<p>Survivors have two years to sue for emotional distress and physical injury; three years to sue for property damage.<\/p>\n<p>Here\u2019s what to consider.<\/p>\n<p>The lead cases<\/p>\n<p><b>Eaton Fire:<\/b> Because there are so many affected households and businesses, there is a designated <a class=\"Link\" href=\"https:\/\/www.documentcloud.org\/documents\/26025598-eaton-fire-master-complaint-individual-plaintiffs-filed-1\/\" target=\"_blank\" data-cms-ai=\"0\" rel=\"noopener\">\u201cmaster complaint\u201d<\/a> that all are filed under and consolidated in front of a single judge. The court has appointed a \u201cliaison counsel\u201d for individual plaintiffs, which serve as neutral parties between the opposing legal firms and the court. All the Eaton Fire suits will be litigated individually in front of Judge Laura A. Seigle in downtown L.A.\u2019s Spring Street courthouse. Amanda Riddle, managing partner with Bay Area firm Corey, Luzaich, de Ghetaldi &amp; Riddle; Rahul Ravipudi of Panish, Shea, Ravipudi; and Gerald Singleton of Singleton Schreiber have been appointed as co-liaisons.<\/p>\n<p><b>Palisades Fire: <\/b>Westlake Village-based Robertson and Associates filed the first lawsuit against the city of Los Angeles\u2019 Department of Water and Power \u2014 that case has been designated the <a class=\"Link\" href=\"https:\/\/www.documentcloud.org\/documents\/26025599-palisades-fire-2025-jul-10-first-amended-complaint-filed-00045529x9cc9dpdf\/\" target=\"_blank\" data-cms-ai=\"0\" rel=\"noopener\">lead case<\/a> by the court in the Palisades Fire litigation. That firm\u2019s founder, Alexander \u201cTrey\u201d Robertson IV, has been appointed as co-liaison, along with attorneys from the firms Foley, Bezek, Behle &amp; Curtis; Boyle Law PC; and McNulty Law Firm.<\/p>\n<p>Consider how you were affected<\/p>\n<p>The death of a loved one, losing your home, emotional trauma, smoke damage in your surviving home, being displaced \u2014 there are a wide variety of ways people were affected by January\u2019s fires that would make them eligible to join a lawsuit.<\/p>\n<p>Money from a lawsuit can help close some gaps in insurance coverage, but don\u2019t get your hopes up too high. That money will likely take at least two years to end up in survivors\u2019 pockets, and it\u2019s usually not enough to make everyone whole.<\/p>\n<p>\u201cWe ended up getting 20 cents on the dollar of what we needed,\u201d <a class=\"Link\" href=\"https:\/\/laist.com\/news\/climate-environment\/six-years-woolsey-fire-struggle-rebuild-continues\" data-cms-ai=\"0\" target=\"_blank\" rel=\"noopener\">said Scott Tallal<\/a>, a Woolsey Fire survivor who sued Southern California Edison after that fire was sparked by the utility\u2019s equipment.<\/p>\n<p>Choose a lawyer carefully<\/p>\n<p>Most of the fire litigation is \u201cmass tort,\u201d not \u201cclass action,\u201d (though there is <a class=\"Link\" href=\"https:\/\/calljustice.com\/10-billion-class-action-lawsuit-filed-for-the-palisades-fire\/\" target=\"_blank\" data-cms-ai=\"0\" rel=\"noopener\">a class action suit, too<\/a>). That means there are thousands of lawsuits being filed at the same time, but they\u2019re all individual cases, so each plaintiff has to get their own lawyer and file their own suit, said Riddle, the co-liaison attorney for the Eaton Fire cases.<\/p>\n<p>But with all the social media ads and billboards, it can be tough to vet who is legitimate. So treat it like a job interview. <\/p>\n<p>Here are some of the most important things to consider when vetting an attorney, according to Riddle:<\/p>\n<ul>\n<li>First, <a class=\"Link\" href=\"https:\/\/apps.calbar.ca.gov\/attorney\/LicenseeSearch\/QuickSearch\" target=\"_blank\" data-cms-ai=\"0\" rel=\"noopener\">check out if they&#8217;re licensed with the California State Bar.<\/a> <\/li>\n<li>Then ask: Are they experienced in California, particularly wildfire cases in California? Different states have different laws, so it\u2019s important a lawyer is well-versed in the laws here.\u00a0<\/li>\n<li>For Eaton Fire cases, has this lawyer or firm worked on utility-sparked wildfire cases?\u00a0<\/li>\n<li>Make sure the law firm has a deep bench \u2014 these cases can take years and require a lot of labor. How long has the firm been around? Is it brand new, or has it weathered large cases in the past? How many other experienced attorneys and staff does the firm have?\u00a0<\/li>\n<li>Has the attorney you\u2019re interviewing held a leadership role in past cases? That shows that not only were they extensively involved in past cases, but also that the court and other attorneys trusted them to hold those leadership roles.<\/li>\n<li>How do they plan to communicate with you? Can they serve your language needs?\u00a0<\/li>\n<\/ul>\n<p>\u201cYou want to find the one where you feel comfortable, you feel like you can work with them in a way that works for you,\u201d Riddle said.<\/p>\n<p>The lead firms can also help direct survivors to other legitimate firms.<\/p>\n<p>    <img decoding=\"async\" class=\"Image\" alt=\"Shells of former homes along the ocean are still smoldering in places.\" data-image-size=\"articleImage\"  width=\"792\" height=\"528\" src=\"https:\/\/scpr.brightspotcdn.com\/dims4\/default\/cc1e589\/2147483647\/strip\/true\/crop\/5808x3872+0+0\/resize\/792x528!\/quality\/90\/?url=http%3A%2F%2Fscpr-brightspot.s3.us-west-2.amazonaws.com%2Fc3%2F32%2F425895c5464ca04f956dd628aca0%2Fap25009021606283.jpg\" loading=\"lazy\" bad-src=\"data:image\/svg+xml;base64,PHN2ZyB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciIHZlcnNpb249IjEuMSIgaGVpZ2h0PSI1MjhweCIgd2lkdGg9Ijc5MnB4Ij48L3N2Zz4=\"\/><\/p>\n<p>The later a fire survivor files a lawsuit, the longer it may take for their case to be resolved, one expert cautions.<\/p>\n<p>(<\/p>\n<p>Etienne Laurent<\/p>\n<p>\/<\/p>\n<p>Associated Press<\/p>\n<p>)<\/p>\n<p>What\u2019s the cost?<\/p>\n<p>Most firms handle these cases on a contingency basis, meaning they don\u2019t get paid until the settlement (and yes, these cases are usually resolved via settlements). Generally, the attorney fee is between 20% and 25% of the settlement, plus additional costs related to your specific case.<\/p>\n<p>\u201c\u200aWe have to hire experts to look at infrastructure. We&#8217;ve got to hire electrical engineers and metallurgists and cause-and-origin experts and fire-spread experts. We have court fees. We have transcript fees. We have filing fees, all of those type of things,\u201d Riddle said.<\/p>\n<p>That usually adds up to about 2% of the settlement, Riddle said.<\/p>\n<p>There\u2019s also the risk of the party who&#8217;s being sued going bankrupt \u2014 that\u2019s what happened after Pacific Gas and Electric equipment sparked devastating fires in 2017 and 2018 in Northern California.<\/p>\n<p>Riddle, however, said she thinks that\u2019s unlikely in the Eaton Fire case.<\/p>\n<p>What\u2019s the timeline?<\/p>\n<p>Survivors have two years from the start of the fire to sue for emotional distress and physical injury \u2014 that deadline is Jan. 7, 2027. They have three years to sue for property damage \u2014 until Jan. 7, 2028.<\/p>\n<p>While the cases individually likely won\u2019t take more than a few weeks, mediating and resolving cases is not likely to start until the middle of next year, Riddle said.<\/p>\n<p>\u201cThese trials are not going to take that long, but what&#8217;s going to happen is not all 10,000 households are going to have a trial at the same time,\u201d she said.<\/p>\n<p>The later a survivor files a lawsuit, the later their case is likely to be resolved.<\/p>\n<p>\u201cMemories fade and documents get lost, so you want to make sure that you&#8217;re working with a lawyer, I think sooner rather than later, so that you can preserve all the information and documents you need to maximize the value of your case,\u201d Riddle said.<\/p>\n","protected":false},"excerpt":{"rendered":"Keep up with LAist.
