{"id":863316,"date":"2026-06-13T00:02:13","date_gmt":"2026-06-13T00:02:13","guid":{"rendered":"https:\/\/www.europesays.com\/us\/863316\/"},"modified":"2026-06-13T00:02:13","modified_gmt":"2026-06-13T00:02:13","slug":"church-group-allowed-to-help-homeless-at-phoenix-parks-judge-rules","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/863316\/","title":{"rendered":"Church group allowed to help homeless at Phoenix parks, judge rules"},"content":{"rendered":"<p class=\"text | article-text text-start\"><b>PHOENIX (AZFamily)<\/b> \u2014 A federal judge has temporarily blocked <a href=\"https:\/\/www.azfamily.com\/2026\/05\/07\/phoenix-city-council-approves-controversial-food-medical-restrictions-parks\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.azfamily.com\/2026\/05\/07\/phoenix-city-council-approves-controversial-food-medical-restrictions-parks\/\">the city of Phoenix from enforcing its new park rules<\/a> regarding helping the homeless against a church group.<\/p>\n<p class=\"text | article-text text-start\">In a ruling issued Wednesday, Judge Krissa M. Lanham granted a temporary restraining order blocking the enforcement against St. Herman\u2019s Table and its founder, Lance Brace, because the ordinance likely violates the First Amendment rights of the Orthodox Christian outreach ministry that feeds homeless people weekly.<\/p>\n<p class=\"text | article-text text-start\">The temporary restraining order only lasts two weeks.<\/p>\n<p class=\"text | article-text text-start\">The city\u2019s new ordinance makes giving food or providing medical care to homeless people at parks without a permit a misdemeanor. The aid must take place under a tent or mobile medical vehicle.<\/p>\n<p class=\"text | article-text\">The ordinance also bans the exchange and distribution of needles in city parks and the distribution of naloxone if given in a needle or syringe.<\/p>\n<p class=\"text | article-text\">Supporters said the change will help keep parks cleaner and more welcoming for families.<\/p>\n<p class=\"text | article-text\">Critics said the restrictions could hurt homeless people and limit syringe programs that help reduce overdose deaths.<\/p>\n<p class=\"text | article-text\">St. Herman\u2019s provides ministry at the Cave Creek Park for up to two hours every Thursday, including volunteers who provide food, water, hygiene products, Bibles, open prayer and information about the church.<\/p>\n<p class=\"text | article-text\">Under the ordinance, a permit allows two \u201cfood distribution events\u201d per month per park, and the church group said the restrictions would \u201cmake it impossible\u201d for them to continue their ministry. <\/p>\n<p class=\"text | article-text text-start\">Along with the First Amendment questions, Lanham said in her ruling that the ordinance is not neutral because it treats people differently based on their motivation for \u201cfood distribution,\u201d such as a restaurant giving out food, compared to a charity feeding the homeless. <\/p>\n<p class=\"text | article-text text-start\">Phoenix said it needs the rules to prevent a \u201cstrain\u201d on park resources and avoid noise and crowds.
