Enshrining a sustainable environment as a human right paves the way for other legal actions, including states returning to the ICJ to hold each other to account, as well as domestic lawsuits.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cThe consequences of climate change are severe and far-reaching: they affect both natural ecosystems and human populations. These consequences underscore the urgent and existential threat posed by climate change,\u201d said the ICJ president, Yuji Iwasawa.<\/p>\n<p class=\"dcr-16w5gq9\">The ICJ was <a href=\"https:\/\/www.theguardian.com\/world\/2023\/mar\/30\/un-vote-on-climate-justice-pacific-island-change-crisis-united-nations-vanuatu\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">instructed to produce this document<\/a> by the UN in 2023, after years of campaigning <a href=\"https:\/\/www.theguardian.com\/world\/2022\/jun\/20\/from-vanuatu-law-school-to-the-hague-the-fight-to-recognise-climate-harm-in-international-law\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">by a group of Pacific island law students<\/a> and diplomacy led by the Pacific island nation of Vanuatu.<\/p>\n<p class=\"dcr-16w5gq9\">During <a href=\"https:\/\/www.theguardian.com\/law\/2024\/dec\/11\/international-court-of-justice-icj-forced-to-listen-to-climate-victims\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">two weeks of hearings<\/a> in The Hague in December, representatives of vulnerable states told judges that a handful of countries <a href=\"https:\/\/www.theguardian.com\/environment\/2024\/dec\/02\/handful-of-countries-responsible-for-climate-crisis-icj-court-told\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">should be held legally responsible<\/a> for the continuing impacts of climate change. Meanwhile, the world\u2019s top greenhouse gas emitters <a href=\"https:\/\/www.theguardian.com\/environment\/2024\/dec\/04\/us-climate-crisis-legal-court\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">denied any legal responsibility<\/a> beyond the Paris agreement on climate change.<\/p>\n<p>Climate activists and campaigners demonstrated outside the international court of justice (ICJ) in The Hague. Earlier this month, the inter-American court of human rights (IACHR) concluded that there is <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/jul\/03\/countries-must-protect-human-right-to-a-stable-climate-court-rules\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">a human right to a healthy climate<\/a>. And both the IACHR and the international tribunal for the law of the sea said states <a href=\"https:\/\/www.theguardian.com\/environment\/article\/2024\/may\/21\/greenhouse-gases-are-pollutants-that-kill-marine-life-court-rules\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">have a legal responsibility<\/a> to control greenhouse gases.<\/p>\n<p class=\"dcr-16w5gq9\">Meanwhile, the African court on human and people\u2019s rights has only just begun the process.<\/p>\n<p class=\"dcr-16w5gq9\">Of all these, the ICJ is the court with the widest jurisdiction and it has the role of harmonising and integrating international law.<\/p>\n<p class=\"dcr-16w5gq9\">Advisory opinions are technically non-binding but are considered authoritative because they summarise existing law rather than create law.
