A deranged serial shoplifter yelled \u201cI can kill y\u2019all\u201d before the CVS shelf stocker now charged with manslaughter <\/a>knifed him to death at a Times Square store, Manhattan jurors heard this week.<\/p>\n

Witnesses took the stand at Scotty Enoe\u2019s trial to describe the bloody scene that unfolded after Charles Brito, a 50-year-old homeless man, burst through the doors of the Broadway and West 49th Street shop in July 2023.<\/p>\n

\u201cI can kill y\u2019all, I can kill everybody,\u201d Brito shouted, then-CVS manager-in-training Katrina Rivera testified in Manhattan Supreme Court.<\/p>\n

\u201cHe\u2019s just basically saying he could do whatever he wants,\u201d Rivera, 45, told the jury, according to a transcript obtained by The Post.<\/p>\n

\u201cThen he said he can kill people. I fight people. Just get out of my way, I\u2019m gonna keep on coming.\u201d<\/p>\n

Enoe, 48, is charged with fatally stabbing Brito in what he says was self-defense.<\/a><\/p>\n

Brito, a known shoplifter at area drugstores<\/a>, punched Enoe several times during the brawl that erupted after he made the threats, \u201csmacking\u201d the worker against the doors of coolers he\u2019d filled with drinks, another witness said.<\/p>\n

Brito later made more frightening threats in another area of the store, where two female employees tried to stop him from opening another cooler, Rivera told the court.<\/p>\n

The chronic thief had been arguing with Rivera and another employee, Allandrea Hollness, when a bruised and bleeding Enoe walked back up to him, both women testified.<\/p>\n

Enoe claims he stabbed Charles Brito in self-defense.<\/p>\n

Prosecutors said Enoe then pulled out a small folding knife and stabbed Brito eight times \u2014 piercing his liver twice \u2014 before a bloody Brito staggered onto the sidewalk and later died.<\/p>\n

Hollness, a prosecution witness, testified that the unarmed but \u201caggressive\u201d Brito swung his elbows near Rivera\u2019s face during the confrontation, though the slain man never struck either woman.<\/p>\n

\u201cThose elbows kept flying?\u201d defense lawyer Frank Rothman asked during cross-examination on July 17.<\/p>\n

Katrina Rivera, a CVS manager-in-training at the time, testified that Brito yelled \u201cI can kill y\u2019all\u201d after barging into the store. Helayne Seidman<\/p>\n

\u201cYes,\u201d the 33-year-old Bronxite replied.<\/p>\n

\u201cThat\u2019s when Scotty came?\u201d Rothman asked.<\/p>\n

\u201cYes,\u201d Hollness responded.<\/p>\n

\u201cI just saw Scotty basically pull him off,\u201d she said. \u201cI saw them fighting, and the next thing I knew the shoplifter was screaming that he\u2019s bleeding, got stabbed. I saw the blood.\u201d<\/p>\n

Hollness also revealed that after the deadly episode, she told police that she didn\u2019t like working nights at the CVS because she feared being attacked by a violent drug addict.<\/p>\n

\u201cYou would wonder going to work what druggie was going to attack you?\u201d Rothman asked her.<\/p>\n

\u201cOne hundred percent,\u201d Hollness responded.<\/p>\n

Enoe, who is out on $100,000 bail, <\/a>faces up to 25 years in prison if convicted. <\/p>\n

Manhattan jurors \u2014 who are set to start deliberations by the end of the week \u2014 can acquit him if they find that he acted \u201creasonably,\u201d either to protect himself or to protect Hollness and Rivera.<\/p>\n

A CVS security guard who witnessed the stabbing testified that his job was to \u201cobserve, watch and report\u201d \u2014 but not to physically confront anyone committing a crime.<\/p>\n

Enoe\u2019s defense attorney said that the CVS employee was getting his head bashed in by Brito before the stabbing. Steven Hirsch<\/p>\n

\u201cSo people were kind of on their own if they get attacked? There was no one in the store who could protect them?\u201d Rothman asked the guard, Roosevelt Tucker. <\/p>\n

\u201cRight,\u201d replied Tucker, who testified that he didn\u2019t carry a gun, taser or club.<\/p>\n

Enoe had \u201cgotten the worse\u201d of the initial scuffle, prosecutors conceded in opening statements earlier this month. <\/p>\n

Jurors saw photos of Enoe\u2019s swollen eye and busted lip he suffered during the encounter.<\/p>\n

\u201cThe guy was just like holding on to Scotty with one hand and smacking him with the other,\u201d testified another eyewitness, then-CVS employee Jose Ramos Martinez.<\/p>\n
