{"id":890181,"date":"2026-06-24T20:20:24","date_gmt":"2026-06-24T20:20:24","guid":{"rendered":"https:\/\/www.europesays.com\/us\/890181\/"},"modified":"2026-06-24T20:20:24","modified_gmt":"2026-06-24T20:20:24","slug":"federal-judge-bars-trump-from-proof-of-citizenship-requirement-to-vote","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/890181\/","title":{"rendered":"Federal judge bars Trump from proof of citizenship requirement to vote"},"content":{"rendered":"<p>A federal judge on Wednesday permanently barred President Donald Trump\u2019s administration from implementing most of his first <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/voting-elections-trump-executive-order-4e9edb53f47e61e241a43ceef8164022\" rel=\"nofollow noopener\" target=\"_blank\">executive order<\/a> on elections, part of which sought to require people to show documentary proof of citizenship when they register to vote.<\/p>\n<p>The ruling by U.S. District Court Judge Denise Casper in Boston effectively converts a preliminary injunction she issued a year ago, in which she temporarily <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-elections-executive-order-4f863aaa8e0c59640ebc727827ffc887\" rel=\"nofollow noopener\" target=\"_blank\">blocked many of Trump\u2019s efforts<\/a> to overhaul elections, into a permanent ban.<\/p>\n<p>Casper rejected the Republican administration\u2019s argument that the lawsuit to block the changes <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-elections-executive-order-states-lawsuit-5790caa7d4d801c4053e73dfa50622e9\" rel=\"nofollow noopener\" target=\"_blank\">brought by Democratic state attorneys general<\/a> was premature because the rules had yet to be put in place. Instead, she agreed that the Constitution gives states and Congress the authority to regulate elections, and that Trump\u2019s requirements violated the separation of powers.<\/p>\n<p>The Constitution \u201cdoes not grant the President any specific powers over elections,\u201d wrote Casper.<\/p>\n<p>Among other proposed changes, <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-elections-voting-executive-order-citizenship-proof-4bbcf7e13183d8c5004ceb0ca53c7845\" rel=\"nofollow noopener\" target=\"_blank\">Trump\u2019s order<\/a> would have required people to provide <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-republicans-citizenship-voting-elections-texas-b6b9298092c84266bc7515209e5aea42\" rel=\"nofollow noopener\" target=\"_blank\">documentary proof of citizenship<\/a> when registering to vote, prevented mail ballots from being counted if they arrive after Election Day, even if they were postmarked by then, and punished states that failed to comply by withholding certain federal money.<\/p>\n<p>In a statement, New York Attorney General <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/hub\/letitia-james\" rel=\"nofollow noopener\" target=\"_blank\">Letitia James<\/a> said she was grateful the court had blocked Trump\u2019s \u201cunconstitutional attempt to seize control of our elections\u201d and would continue to defend voting rights in this year\u2019s midterm elections.<\/p>\n<p>\u201cGenerations of Americans fought tirelessly for the right to vote, and we honor their legacy by protecting that right against anyone who tries to undermine it,\u201d said James, a Democrat.<\/p>\n<p>    <a class=\"AnchorLink\" id=\"image-270000\"\/><\/p>\n<p><img decoding=\"async\" class=\"Image\" alt=\"A voter casts a ballot during New York\u2019s primary election on Tuesday, June 23, 2026, in New York. The Republican president has since signed <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/donald-trump-mail-voting-elections-47cc334b1fb7742244a9c4f176b355cd\" rel=\"nofollow noopener\" target=\"_blank\">another executive order on elections<\/a> that seeks to create a national voter list and limit mail balloting. That directive also faces <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-election-executive-order-democrats-voter-list-ac61e7d4bb77f9901eb6f1a2c1f4b087\" rel=\"nofollow noopener\" target=\"_blank\">multiple legal challenges<\/a>.<\/p>\n<p>Last fall, a federal judge in Washington, D.C., overseeing <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-executive-order-elections-voting-lawsuit-769caf1eceec29a13b4df78a931deb0b\" rel=\"nofollow noopener\" target=\"_blank\">a separate challenge<\/a> to the first election executive order by civil rights and Democratic Party-aligned groups <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-elections-executive-order-democrats-citizenship-034a4d552a978a8f647d95bd3cf38ac0\" rel=\"nofollow noopener\" target=\"_blank\">blocked the government<\/a> from taking steps to include the proof-of-citizenship requirement on the federal voter registration form. That judge later <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-elections-executive-order-citizenship-ruling-305a9cf5f90402369305879ef0f319f0\" rel=\"nofollow noopener\" target=\"_blank\">barred Trump\u2019s defense secretary<\/a> from requiring documentary proof of citizenship when military personnel register to vote or request ballots.<\/p>\n<p>In an apparent nod to the difficulty of implementing a proof-of-citizen requirement by executive order, Trump is <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/voting-trump-midterms-citizenship-republican-senate-d4acd3468c410a8842a0fe3e3b9cda57\" rel=\"nofollow noopener\" target=\"_blank\">pushing legislation<\/a> in the Republican-controlled Congress to create such a mandate. The SAVE America Act has passed the House but has stalled <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/save-act-trump-thune-senate-voter-registration-dbed03cdb33350a49e351ae64676069c\" rel=\"nofollow noopener\" target=\"_blank\">in the Senate<\/a>, leading Trump to advocate for eliminating the filibuster that is blocking the legislation.<\/p>\n<p>On Wednesday, he <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-capitol-republican-senators-968c1454ede461d2db413790670c07df\" rel=\"nofollow noopener\" target=\"_blank\">abruptly canceled<\/a> the expected signing of a bipartisan housing bill, saying he would not sign legislation until Congress passes his proof of citizenship requirement for voting.<\/p>\n<p>The president and many of his Republican allies have been <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/voting-immigrants-noncitizen-trump-republicans-2024-1c65429c152c2a10514b5156eacf9ca7\" rel=\"nofollow noopener\" target=\"_blank\">promoting the narrative<\/a> that <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-immigrant-voting-noncitizens-elections-explained-cf4c73b336147b5f5d9c2a22b2564994\" rel=\"nofollow noopener\" target=\"_blank\">voting by noncitizens<\/a> is a major problem, when in fact <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/noncitizens-voting-republicans-election-2024-immigration-09b86e6768f755fd875f3c51b0e8ea70\" rel=\"nofollow noopener\" target=\"_blank\">it\u2019s quite rare<\/a>. The federal voter registration form already requires people to attest that they are U.S. citizens. Violating that is <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/ohio-voters-citizenship-referrals-42799a379bdda8bca7201d6c42f99c65\" rel=\"nofollow noopener\" target=\"_blank\">punishable<\/a> as a felony that can lead to prison or <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/noncitizen-voting-republicans-prosecutions-2024-election-ohio-ae9dafeeb47ea8941bf82f5988b269ef\" rel=\"nofollow noopener\" target=\"_blank\">deportation<\/a>.<\/p>\n<p>In <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-mail-ballots-election-day-mississippi-2d83cde64284e9e06d19162a45065801\" rel=\"nofollow noopener\" target=\"_blank\">another major voting case<\/a>, the U.S. Supreme Court is due to issue an opinion soon on whether mail ballots must arrive by Election Day.
