{"id":89812,"date":"2025-07-24T22:56:15","date_gmt":"2025-07-24T22:56:15","guid":{"rendered":"https:\/\/www.europesays.com\/us\/89812\/"},"modified":"2025-07-24T22:56:15","modified_gmt":"2025-07-24T22:56:15","slug":"doj-sues-nyc-mayor-adams-over-sanctuary-policies-after-off-duty-cbp-officer-shot","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/89812\/","title":{"rendered":"DOJ sues NYC, Mayor Adams over sanctuary policies after off-duty CBP officer shot"},"content":{"rendered":"<p>WASHINGTON \u2014 The Justice Department filed a sweeping lawsuit Thursday against New York City\u00a0and Mayor Eric Adams\u00a0over Gotham\u2019s sanctuary\u00a0city\u00a0laws \u2014 days after an off-duty <a href=\"https:\/\/nypost.com\/2025\/07\/23\/us-news\/illegal-migrant-accused-of-shooting-off-duty-cbp-officer-in-nyc-was-only-vetted-over-zoom-before-being-set-free-under-biden-admin-sources\/\" target=\"_blank\" rel=\"noopener\">US Customs and Border Protection officer was shot in the face<\/a>\u00a0during a\u00a0botched robbery.<\/p>\n<p>The\u00a037-page filing\u00a0in Brooklyn federal court argued that the city\u2019s\u00a0decades-old\u00a0policies limiting\u00a0the NYPD\u2019s and other law enforcement agency\u2019s\u00a0cooperation with federal immigration enforcement are unconstitutional.<\/p>\n<p>\u201cThe United States has well-established, preeminent, and preemptive authority to regulate immigration,\u201d federal attorneys\u00a0wrote. \u201cNew York City has long been at the vanguard of interfering with enforcing this country\u2019s immigration laws.\u201d<\/p>\n<p>An off-duty CBP agent was shot in a botched robbery over the weekend. DHS<\/p>\n<p>\u201cJust this week, <a href=\"https:\/\/nypost.com\/2025\/07\/21\/us-news\/illegal-migrant-arrested-in-nyc-shooting-of-off-duty-cpb-agent-was-free-despite-long-rap-sheet-and-suspected-in-scooter-robbery-spree-sources\/\" target=\"_blank\" rel=\"noopener\">New York City\u2019s sanctuary policies<\/a> have reaped tragic consequences.\u201d<\/p>\n<p>The tragic consequences allude to a\u00a0<a href=\"https:\/\/nypost.com\/2025\/07\/20\/us-news\/off-duty-border-patrol-agent-shot-in-face-during-nyc-park-robbery-before-striking-back-and-wounding-one-of-his-attackers\/\" target=\"_blank\" rel=\"noreferrer noopener\">moped-riding illegal immigrant<\/a>\u00a0allegedly robbing\u00a0a CBP officer and\u00a0shooting him in the face inside\u00a0Fort Washington Park.<\/p>\n<p>The suspect, later identified as\u00a0Miguel Francisco Mora Nunez,\u00a021,\u00a0had allegedly ambushed the federal agent in concert with another illegal immigrant, Christhian Aybar-Berroa, 22.<\/p>\n<p>DOJ officials underscored both suspects had entered the US \u201cillegally and were repeatedly arrested for criminal\u00a0behavior\u201d before being let off.<\/p>\n<p>The Trump administration\u2019s top priority has been immigration enforcement.  Paul Martinka<\/p>\n<p>\u201cAfter an April 5, 2024, arrest for fourth-degree felony grand larceny and petit larceny, ICE placed an immigration detainer on one of the aliens,\u201d the lawsuit noted. \u201cBut the New York City Department of Correction ignored the detainer and released him back onto the streets of New York City, leaving him free to continue committing crimes.\u201d<\/p>\n<p>The lawsuit names Adams, the City Council, the NYPD and a slew of other local officials and departments as defendants.<\/p>\n<p>Adams has repeatedly insisted he\u2019d like to loosen sanctuary city policies related to dealing with certain crimes, but has been stymied by the council \u2013 leaving him helpless to do anything but follow the mandates.<\/p>\n<p>But he has also maintained the policies are in place so law-abiding immigrants aren\u2019t afraid to use city services.<\/p>\n<p>\u201cKeeping New Yorkers safe also means making sure they feel safe, and Mayor Adams has been clear: no one should be afraid to dial 911, send their kids to school, or go to the hospital, and no New Yorker should feel forced to hide in the shadows,\u201d said City Hall spokeswoman Kayla Mamelak in a statement responding to the lawsuit.<\/p>\n<p>NYC Mayor Eric Adams has taken steps to be cooperative with the Trump administration on immigration, having met with border czar Tom Homan in February. James Messerschmidt<\/p>\n<p>\u201cThat\u2019s why the mayor supports the essence of the local laws put in place by the City Council \u2013 but he has also been clear they go too far when it comes to dealing with those violent criminals on our streets and has urged the Council to reexamine them to ensure we can effectively work with the federal government to make our city safer. So far, the Council has refused.\u201d<\/p>\n<p>The\u00a0immigration provisions in city law flagrantly flout the Supremacy Clause of the Constitution, which declares that the federal government sets the supreme law of the land,\u00a0the lawsuit contends.<\/p>\n<p>\u201cThe Department of Justice is suing New York City and Mayor Eric Adams for continuing to obstruct law enforcement with sanctuary city policies,\u201d US Attorney General Pam Bondi said in a statement on X. \u201cIf New York\u2019s leaders won\u2019t step up to protect their citizens, we will.\u201d<\/p>\n<p>Federal agents, including members of ICE, drag a man away after his court hearing in New York City in July. Getty Images<\/p>\n<p>\u201cNew York City has released thousands of criminals on the streets to commit violent crimes against law-abiding citizens due to sanctuary city policies,\u201d she added in a separate statement.\u00a0<\/p>\n<p>City Hall did not immediately respond to a request for comment.<\/p>\n<p>Since Trump took office Jan. 20, the DOJ has lodged lawsuits against Los Angeles, New York state, New Jersey, Chicago and Illinois in an effort to strike down sanctuary city and state policies.\u00a0<\/p>\n<p>Adams, in the midst of an uphill re-election fight, has taken steps to be cooperative with the Trump administration on immigration, having met\u00a0chummily several times\u00a0with border czar Tom Homan\u00a0\u2013\u00a0sparking outrage from many local\u00a0Democrats.<\/p>\n<p>The mayor signaled he\u2019s open to working with\u00a0Immigration and Customs Enforcement\u00a0to deport migrants who have been charged with crimes, even before they are convicted. He also\u00a0agreed to allow ICE officers to operate inside Rikers Island,\u00a0only to have that stalled after the council filed suit.<\/p>\n<p>Despite\u00a0Adams\u2019 concessions and other overtures,\u00a0Homan vowed to \u201cflood the zone\u201d with ICE agents following the weekend shooting.<\/p>\n<p>People protest at Foley Square and Federal Plaza in Lower Manhattan against ICE immigration arrests. Aristide Economopoulos<\/p>\n<p>\u201cNYPD [New York Police Department] wants to help us,\u201d\u00a0Homan complained to Fox News\u00a0on Thursday before the lawsuit was filed.\u00a0\u201cThe officers on the ground want to help us, but it\u2019s a sanctuary city that was created by Bill de Blasio and supported by the City Council.\u201d<\/p>\n<p>\u201cNew York is NOT helping us with criminals.\u201d<\/p>\n<p>The city\u2019s sanctuary policies \u2013 which go back to Mayor Ed Koch in the 1980s \u2013 only bar local cops from honoring ICE detainer requests for civil enforcement.
