We believe quality journalism should be available to everyone, paid for by those who can afford it.<\/p>\n<p><strong class=\"sc-1uza6dc-1 eRQajs\">Your support makes all the difference.<\/strong>Read more<\/p>\n<p>Residents living near <a href=\"https:\/\/www.independent.co.uk\/topic\/microsoft\" rel=\"nofollow noopener\" target=\"_blank\">Microsoft\u2019s<\/a> Fairwater <a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/elon-musk-grok-data-center-mississippi-trump-doj-b2996658.html\" rel=\"nofollow noopener\" target=\"_blank\">data center <\/a>in Mount Pleasant, <a href=\"https:\/\/www.independent.co.uk\/topic\/wisconsin\" rel=\"nofollow noopener\" target=\"_blank\">Wisconsin<\/a>, are suing the company over the facility&#8217;s alleged noise pollution.<\/p>\n<p>The <a href=\"https:\/\/www.independent.co.uk\/bulletin\/news\/facebook-user-privacy-settlement-second-payment-b2992544.html\" rel=\"nofollow noopener\" target=\"_blank\">class-action lawsuit <\/a>was filed Wednesday in the U.S. District Court for the Eastern District of Wisconsin, according to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.jsonline.com\/story\/money\/business\/2026\/07\/02\/microsoft-sued-by-wisconsin-residents-for-noise-from-data-center\/90786863007\/\">The Milwaukee Journal Sentinel<\/a>. Three residents of Sturtevant \u2014 a village approximately 30 miles south of Milwaukee close to the <a href=\"https:\/\/www.independent.co.uk\/bulletin\/news\/data-centers-ai-artifical-intelligence-cost-b2899187.html\" rel=\"nofollow noopener\" target=\"_blank\">data center<\/a>\u2014are named as plaintiffs.<\/p>\n<p>\u201cThrough its operation and maintenance of the Data Center, Defendant has emitted, and continues to emit, unreasonable and excessive noise onto Plaintiffs\u2019 properties, thereby causing property damages through private nuisance and negligence,\u201d the lawsuit states.<\/p>\n<p>The lawsuit is the latest salvo from frustrated citizens as data centers have swept the country in the <a href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/donald-trump-ai-data-centres-b2933194.html\" rel=\"nofollow noopener\" target=\"_blank\">race to power AI development<\/a>. Complaints have included <a href=\"https:\/\/www.independent.co.uk\/tech\/ai-data-center-emissions-environment-b2887454.html\" rel=\"nofollow noopener\" target=\"_blank\">noise and air pollution<\/a>,<a href=\"https:\/\/www.independent.co.uk\/tech\/ai-water-land-un-report-b2989429.html\" rel=\"nofollow noopener\" target=\"_blank\"> excessive water use<\/a>, and <a href=\"https:\/\/www.independent.co.uk\/news\/wood-mackenzie-big-tech-microsoft-google-amazon-b2804713.html\" rel=\"nofollow noopener\" target=\"_blank\">increasing energy costs<\/a>. Communities<a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/data-centers-risks-usa-b2991889.html\"> in a number of states<\/a> have <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/data-farms-centers-politics-ai-b2866328.html\">launched protests<\/a> and <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.independent.co.uk\/news\/world\/americas\/boston-neighborhood-data-center-lawsuit-b2998660.html\">pushed for legislation<\/a> to stop their construction. <strong> <\/strong><\/p>\n<p>The Fairwater data center is the first of several buildings that Microsoft plans to build on the campus. Both Microsoft, and electronics manufacturer Foxconn, which has a facility at the site, plan to expand their data center operations there in the coming years, according to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wpr.org\/news\/foxconn-expansion-racine-county-wisconsin-jobs\">Wisconsin Public Radio<\/a>. <\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2026\/07\/Microsofts-Fairwater-data-center.jpeg\"  loading=\"lazy\" alt=\"Microsoft\u2019s Fairwater data center in Mount Pleasant, Wisconsin. Residents living nearby are suing the tech giant, accusing the center of excessive noise pollution (Microsoft)<\/p>\n<p>The lawsuit cites complaints and comments about the facility that were received by the Wisconsin Department of Natural Resources.<\/p>\n<p>The plaintiffs claim the center &#8220;generates significant noise pollution from diesel generators and heating, ventilation, and air conditioning (HVAC) systems, including chillers, cooling towers, air-handling units, and condenser fans.&#8221;<\/p>\n<p>The suit further states that the noise produced by the facility is &#8220;not only excessive, but consistent and pervasive.&#8221;<\/p>\n<p>The filing accuses Microsoft of failing to &#8220;implement adequate acoustic barriers, shields, or walls, that absorb, mitigate, and\/or prevent the escape of noise, thereby resulting in the offsite emission of excessive noise beyond its property.&#8221;<\/p>\n<p>The plaintiffs are seeking an unspecified amount in damages.<\/p>\n<p>A spokesperson for Microsoft told The Milwaukee Journal Sentinel that the company is &#8220;aware of the lawsuit related to our facility in the Village of Mount Pleasant.&#8221;<\/p>\n<p>&#8220;Microsoft is committed to being a good neighbor in the communities where we build, own, and operate our data centers,&#8221; the company said in its statement.<\/p>\n<p>The Independent has contacted Microsoft for comment. <\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2026\/07\/2272649609...jpeg\"  loading=\"lazy\" alt=\"CEO of Microsoft Satya Nadella. The company is being sued by residents of Sturtevant, Wisconsin, over alleged excessive noise coming from its Fairwater data center in nearby Mount Pleasant (Getty)<\/p>\n<p>Sean Ryan, the Mount Pleasant village communications director, told The Sentinel that it had not received any complaints about noise since Microsoft made changes to the facility in mid-April to address a humming noise coming from the data center.<\/p>\n<p>&#8220;Village officials stand ready to respond if people do reach out to us, and will continue to ensure Microsoft is a good corporate citizen and a good neighbor,&#8221; he said.<\/p>\n<p>In April, Microsoft investigated the noise complaints and determined the humming disturbing some residents was coming from the data center&#8217;s cooling fans.<\/p>\n<p>&#8220;We anticipated that our systems would need adjustments and create some noise as part of the data center startup, but we did not expect the tonal quality of the sound to travel as far as it has,&#8221; the company <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/local.microsoft.com\/blog\/testing-underway-to-understand-noise-at-our-mount-pleasant-datacenter\/\">said in a statement<\/a>.<\/p>\n<p>The tech giant announced in June that it had fixed the problem.<\/p>\n<p>&#8220;Several neighbors confirmed what our independent monitoring showed: that these mitigations fully resolved the issue,&#8221; the company said.<\/p>\n<p>Residents living near the data center aren&#8217;t only complaining about noise. Dust from construction, light pollution, and increased traffic have also irked locals, according to <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/www.wpr.org\/news\/microsoft-sued-noise-complaints-at-new-mount-pleasant-data-center\">WPR<\/a>.<\/p>\n<p>Larry Neumiller, who has lived in the area for nearly 40 years, now lives across the street from the data center campus. Residents in both Lowell have sued over the noise<\/p>\n<p>He also said that the construction crews use &#8220;super bright lights that even my blinds in the windows can&#8217;t keep out.&#8221;<\/p>\n<p>Resident Roger Johansen lives across the street from the data center and also complained that the bright lights have ruined the peaceful darkness he once enjoyed.<\/p>\n<p>\u201cIt was so dark out there, you could see all the stars, and now you have a hard time seeing the stars with all the light,\u201d he told WPR.<\/p>\n<p>Brian Schue, another resident, moved to the area a few years ago and is already considering moving again due to the data center.<\/p>\n<p>He complained the area had become a &#8220;dust bowl.&#8221;<\/p>\n<p>\u201cI just washed my truck, and it\u2019s completely dusty again,\u201d he told WPR.<\/p>\n<p>Microsoft <a rel=\"nofollow noopener\" target=\"_blank\" href=\"https:\/\/local.microsoft.com\/blog\/mount-pleasant-datacenter-project-update\/\">said on its project website<\/a> that &#8220;street sweepers will operate for approximately 10 hours per day&#8221; to address the dust issue.
