(ABC News: Sean Tarek Goodwin)<\/p>\n<p>MP convicted of &#8216;infamous crime&#8217;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The NSW Constitution contains provisions for expelling sitting members convicted of an &#8220;infamous crime&#8221; \u2014 that is an offence that carries a maximum sentence of more than five years.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">All four of Gareth Ward&#8217;s offences meet that criterion, with the most serious offence \u2014 sexual intercourse without consent \u2014 carrying a maximum prison term of 14 years.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">However, the politician&#8217;s seat will not be vacated just yet.<\/p>\n<p>Sexual assault\u00a0support lines:<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Ward has 28 days to lodge an appeal in the NSW District Court, and his seat in parliament will not be declared vacant until the challenge is resolved.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">However, these provisions do not interfere with the powers of the House to expel members.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Election analyst Ben Raue is a close observer of Australian politics.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">He said the NSW parliament has powers to remove politicians.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I can&#8217;t imagine they would have issues passing a motion of suspension, I think that would be the bare minimum to be honest,&#8221; he said.<\/p>\n<blockquote class=\"EmphasisedText_quote__TE6kn\"><p>&#8220;I think probably Chris Minns is hoping that Gareth Ward just resigns from parliament now and saves him the trouble.&#8221;<\/p><\/blockquote>\n<p class=\"paragraph_paragraph__iYReA\">Mr Raue said NSW parliament is in unchartered waters with this case.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It is very unusual,&#8221; he said.<\/p>\n<blockquote class=\"EmphasisedText_quote__TE6kn\"><p>&#8220;I have never heard of it happening, certainly not in the modern era of modern party politics.&#8221;<\/p><\/blockquote>\n<p class=\"paragraph_paragraph__iYReA\">After the verdict, Ward was granted bail release to return home ahead of a hearing on Wednesday where the Crown will seek to have the politician taken into custody ahead of his sentence.<\/p>\n<p>By-election in Kiama &#8216;likely&#8217;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The verdict was handed down more than <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2022-03-22\/mp-gareth-ward-charged-historical-sexual-abuse\/100929714\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/100929714\" target=\"_blank\" rel=\"noopener\">three years after Ward was first charged.<\/a><\/p>\n<p class=\"paragraph_paragraph__iYReA\">The then-Liberal politician was stood down from his portfolio as the NSW Minister for Families, Communities and Disability Services after it emerged that he was the subject of a police investigation.<\/p>\n<p><img decoding=\"async\" alt=\"Man wearing a suit, smiling and holding a hat.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/us\/wp-content\/uploads\/2025\/07\/684b2a94c9f14c83ef9653812c2bd260\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">NSW MP Gareth Ward arriving at court during the ninth week of his trial.
