{"id":93423,"date":"2025-07-26T06:41:10","date_gmt":"2025-07-26T06:41:10","guid":{"rendered":"https:\/\/www.europesays.com\/us\/93423\/"},"modified":"2025-07-26T06:41:10","modified_gmt":"2025-07-26T06:41:10","slug":"trump-administrations-lawsuit-over-chicagos-sanctuary-city-policies-tossed-by-federal-judge","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/93423\/","title":{"rendered":"Trump administration&#8217;s lawsuit over Chicago&#8217;s sanctuary city policies tossed by federal judge"},"content":{"rendered":"<p>A federal judge appointed by former President Joe Biden on Friday dismissed a <a href=\"https:\/\/nypost.com\/2025\/02\/06\/us-news\/trump-administration-sues-chicago-state-of-illinois-over-sanctuary-laws-and-vows-more-lawsuits-to-come\/\" rel=\"nofollow noopener\" target=\"_blank\">Trump administration lawsuit <\/a>challenging sanctuary city policies in Chicago and the state of Illinois.\u00a0<\/p>\n<p>The Justice Department sued Illinois, Cook County and the city of Chicago \u2014 along with several state and local officials, including <a href=\"https:\/\/nypost.com\/2025\/05\/08\/media\/illinois-gov-pritzker-accused-of-insulting-ice-with-sanctuary-policies-as-noem-angel-families-protest\/\" rel=\"nofollow noopener\" target=\"_blank\">Democratic Gov. JB Pritzker and Mayor Brandon Johnson<\/a> \u2014 in February, arguing their sanctuary laws \u201cinterfere\u201d with Immigration and Customs Enforcement\u2019s (ICE) ability to arrest and deport illegal migrants.\u00a0<\/p>\n<p>District Judge Lindsay C. REUTERS<\/p>\n<p>\u201c[T]he Sanctuary Policies reflect Defendants\u2019 decision to not participate in enforcing civil immigration law \u2014 a decision protected by the Tenth Amendment and not preempted by [federal immigration laws],\u201d Jenkins wrote in her 64-page ruling.\u00a0<\/p>\n<p>\u201cFinding that these same Policy provisions constitute discrimination or impermissible regulation would provide an end-run around the Tenth Amendment,\u201d the judge continued. \u201cIt would allow the federal government to commandeer States under the guise of intergovernmental immunity \u2014 the exact type of direct regulation of states barred by the Tenth Amendment.\u201d\u00a0<\/p>\n<p>Jenkins also determined that the Trump administration lacked standing to sue the \u201cindividual defendants\u201d named in the case, such as Pritzker and Cook.\u00a0<\/p>\n<p>She dismissed the lawsuit without prejudice, meaning the Trump administration may amend its complaint if it wishes to continue litigating the issue.\u00a0<\/p>\n<p>In their lawsuit, the Trump administration singled out the\u00a0<a href=\"https:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs3.asp?ActID=3818\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Illinois Trust Act<\/a> and Chicago\u2019s\u00a0<a href=\"https:\/\/www.chicago.gov\/content\/dam\/city\/depts\/mayor\/Office%20of%20New%20Americans\/PDFs\/WelcomeCityOrdinance.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Welcoming City ordinance<\/a>.<\/p>\n<p>President Donald Trump speaks to reporters outside the White House on July 25, 2025. Ron Sachs\/CNP \/ SplashNews.com<\/p>\n<p>The Trust Act declares that \u201cState law does not currently grant State or local law enforcement the authority to enforce federal civil immigration laws,\u201d while the Welcoming City ordinance emphatically states, \u201cNo agency or agent shall: arrest, detain or continue to detain a person solely on the belief that the person is not present legally in the United States.\u201d <\/p>\n<p>Pritzker and Johnson celebrated the judge\u2019s ruling. <\/p>\n<p>\u201cIllinois just beat the Trump Administration in federal court,\u201d <a href=\"https:\/\/x.com\/GovPritzker\/status\/1948864444542714300\" target=\"_blank\" rel=\"noopener nofollow\">the governor wrote on X<\/a>. \u201cTheir case challenging the bipartisan TRUST Act was dismissed \u2014 unlike the President, we follow the law and listen to the courts.\u201d<\/p>\n<p>Chicago Mayor Brandon Johnson and Illinois Gov. Getty Images<\/p>\n<p>Meanwhile, Johnson tweeted that the ruling \u201caffirms what we have long known: that Chicago\u2019s Welcoming City Ordinance is lawful and supports public safety.\u201d<\/p>\n<p>\u201cChicago cannot be compelled to cooperate with the Trump Administration\u2019s reckless and inhumane immigration agenda,\u201d <a href=\"https:\/\/x.com\/ChicagosMayor\/status\/1948902679184367978\" target=\"_blank\" rel=\"noopener nofollow\">the mayor added<\/a>. \u201cOur city is safer when local law enforcement can focus on the needs of Chicagoans.\u201d<\/p>\n<p>Lindsay C. AP<\/p>\n<p>The ruling is a setback to the Trump administration, which earlier this week <a href=\"https:\/\/nypost.com\/2025\/07\/24\/us-news\/doj-sues-nyc-mayor-adams-over-sanctuary-policies-after-off-duty-cpb-officer-shot\/\" rel=\"nofollow noopener\" target=\"_blank\">sued New York City and Mayor Eric Adams<\/a> over Gotham\u2019s sanctuary city policies \u2014 similarly arguing that rules limiting the NYPD\u2019s and other law enforcement agencies\u2019 cooperation with federal immigration enforcement are unconstitutional.<\/p>\n<p>The move came after two illegal migrants allegedly <a href=\"https:\/\/nypost.com\/2025\/07\/20\/us-news\/off-duty-border-patrol-agent-shot-in-face-during-nyc-park-robbery-before-striking-back-and-wounding-one-of-his-attackers\/\" rel=\"nofollow noopener\" target=\"_blank\">shot an off-duty Customs and Border Protection officer in the face<\/a> in a Manhattan park. <\/p>\n<p>Attorney General Pam Bondi filed suit against Chicago and the state of Illinois on her first day on the job at DOJ.\u00a0<\/p>\n<p>Federal agents hold back a protester during an ICE exercise outside an immigration court in Chicago on June 16, 2025.
