He also said the department has begun First Amendment refresher training across its ranks.<\/p>\n<p data-start=\"687\" data-end=\"1017\">Garcia addressed the June 27 encounter during an <a href=\"https:\/\/www.wfaa.com\/article\/news\/local\/tarrant-county\/fort-worth-police-department-pride-fest-viral-video-david-grisham-officer-sarah-stogner-texas\/287-c8928e80-44d7-4af0-ae77-0890cb28acf0\" rel=\"nofollow noopener\" target=\"_blank\">interview<\/a> with WFAA on Monday. The Dallas Express <a href=\"https:\/\/dallasexpress.com\/tarrant\/justice-department-civil-rights-division-weighs-in-on-fort-worth-first-amendment-case\/\" rel=\"nofollow noopener\" target=\"_blank\">first<\/a> published video showing officers warning street preachers Richard Penkoski and David Grisham about potentially \u201coffensive\u201d speech. Police later cited Grisham for disorderly conduct related to noise after he used a bullhorn.<\/p>\n<p data-start=\"1019\" data-end=\"1166\">\u201cThe biggest issue that I have is just the conversations and the way that we were describing what is lawful, what is not lawful,\u201d Garcia <a href=\"https:\/\/www.wfaa.com\/article\/news\/local\/tarrant-county\/fort-worth-police-department-pride-fest-viral-video-david-grisham-officer-sarah-stogner-texas\/287-c8928e80-44d7-4af0-ae77-0890cb28acf0\" rel=\"nofollow noopener\" target=\"_blank\">told<\/a> WFAA.<\/p>\n<p data-start=\"1168\" data-end=\"1428\">\u201cWhen we\u2019re right, we\u2019re right, and when we\u2019re wrong, we\u2019re wrong,\u201d Garcia said. \u201cThere certainly was a better way to have that communication, and we were wrong in the manner in which we communicated that. Certainly, we\u2019re going to take accountability for it.\u201d<\/p>\n<p data-start=\"1430\" data-end=\"1592\">Garcia\u2019s acknowledgment focused on how officers explained the limits of lawful speech. The department has continued to defend the separate noise-related citation.<\/p>\n<p>Department-wide training underway<\/p>\n<p data-start=\"1633\" data-end=\"1779\">Garcia said the department\u2019s command staff has completed First Amendment refresher courses. Sergeants and officers will receive the training next.<\/p>\n<p data-start=\"1781\" data-end=\"1945\">\u201cWe just trained up our command staff again with refresher courses. We\u2019re going to be training our sergeants. We\u2019re going to be training our officers,\u201d Garcia said.<\/p>\n<p data-start=\"1947\" data-end=\"2217\">FWPD previously <a href=\"https:\/\/dallasexpress.com\/tarrant\/justice-department-civil-rights-division-weighs-in-on-fort-worth-first-amendment-case\/\" rel=\"nofollow noopener\" target=\"_blank\">told<\/a> The Dallas Express that an officer involved in the encounter made \u201ccertain statements that were not accurate.\u201d The department said the City of Fort Worth Law Department would provide additional First Amendment instruction to officers and recruits.<\/p>\n<p data-start=\"2219\" data-end=\"2404\">The department has maintained that officers cited Grisham because he continued using a bullhorn after businesses complained about amplified noise, not because of the preachers\u2019 message.<\/p>\n<p data-start=\"2406\" data-end=\"2621\">\u201cAt no time did officers prevent any individuals from expressing their views,\u201d FWPD previously said. \u201cOfficers told the individuals they could continue exercising their rights without using an amplification device.\u201d<\/p>\n<p>Attorney calls citation baseless<\/p>\n<p data-start=\"2661\" data-end=\"2782\">Attorney C.J. Grisham, who represents David Grisham, said Garcia\u2019s acknowledgment does not resolve the separate citation.<\/p>\n<p data-start=\"2784\" data-end=\"2845\">\u201cThey have already violated their rights,\u201d Grisham told WFAA.<\/p>\n<p data-start=\"2847\" data-end=\"2975\">\u201cIt doesn\u2019t meet the noise violation ordinance in any way whatsoever,\u201d he added. \u201cSo, just on its face, the charge is baseless.\u201d<\/p>\n<p data-start=\"2977\" data-end=\"3081\">The encounter also drew the attention of Assistant Attorney General for Civil Rights Harmeet K.
