PHOENIX (AZFamily)<\/b> \u2014 The legal fight<\/a> over one of downtown Phoenix\u2019s oldest homes is cooling off after Arizona State University said it will drop its case and allow the house to remain.<\/p>\n

ASU has been seeking to acquire the Louis Emerson House, a 124-year-old Queen Anne-style home near 4th and Pierce streets<\/a>. The school is building a new ASU Health headquarters there and plans for a medical school campus<\/a>.<\/p>\n

After multiple unsuccessful attempts to buy the home from 89-year-old owner Robert Young, the university moved to take the property through eminent domain. <\/p>\n

Now, ASU says it is stepping back.<\/p>\n

\u201cTo honor the homeowner\u2019s desires, the university has agreed to withdraw its court proceedings and allow the house to remain. The plans for the ASU Health site will be revised accordingly,\u201d the university said in a statement. <\/p>\n

The lawsuit was originally filed by the Arizona Board of Regents on ASU\u2019s behalf, seeking to acquire what the university called the final parcel needed to complete ownership of nearly the entire block for the project. <\/p>\n

The home was built by a butcher named Louis Emerson and has stood in the area for more than a century, though it was moved about 100 feet in the 1990s. <\/p>\n

Supporters had been circulating a petition urging ASU to preserve the home, and Young and tenant Barry Schwartz were scheduled to appear in court on September 4<\/a>.<\/p>\n
