{"id":950847,"date":"2026-07-22T01:34:18","date_gmt":"2026-07-22T01:34:18","guid":{"rendered":"https:\/\/www.europesays.com\/us\/950847\/"},"modified":"2026-07-22T01:34:18","modified_gmt":"2026-07-22T01:34:18","slug":"us-court-overturns-release-pro-palestinian-militant-mahdawi","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/950847\/","title":{"rendered":"US court overturns release pro-Palestinian militant Mahdawi"},"content":{"rendered":"<p>A US appeals court on Tuesday overturned a 2025 ruling that ordered the Trump administration to release pro-Palestinian advocate <a href=\"https:\/\/www.jpost.com\/diaspora\/antisemitism\/article-899052\" rel=\"nofollow noopener\" target=\"_blank\">Mohsen Mahdawi<\/a> from immigration detention, finding that the lower court lacked jurisdiction to hear the case.<\/p>\n<p>Mahdawi, 35, was one of several <a href=\"https:\/\/www.jpost.com\/international\/article-895481\" rel=\"nofollow noopener\" target=\"_blank\">non-citizen students<\/a> who were placed in deportation proceedings last year after taking part in demonstrations against Israel&#8217;s military campaign in Gaza. The arrests prompted court challenges that placed US President Donald Trump&#8217;s crackdown on immigration against the right to free speech as guaranteed by the First Amendment to the US Constitution.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Tuesday&#8217;s decision from a three-judge panel of the Manhattan-based 2nd US Circuit Court of Appeals stopped short of backing the Trump administration&#8217;s push to deport non-citizens in the US lawfully on the basis that their presence in the country runs counter to US foreign policy &#8211; a practice that rights groups say infringes on free speech.<\/p>\n<p>But taken together with another decision earlier this year in the case of <a href=\"https:\/\/www.jpost.com\/international\/article-887028\" rel=\"nofollow noopener\" target=\"_blank\">pro-Palestinian advocate Mahmoud Khalil<\/a>, the ruling could make it more difficult for non-citizens detained in immigration jails to quickly seek their release on the grounds of an alleged violation of their First Amendment rights.<\/p>\n<p><strong>Decision hinges on jurisdiction<\/strong><\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">Mahdawi, a West Bank-born Columbia University student, was arrested in April 2025 upon arriving for an interview for his US citizenship petition. (credit: REUTERS\/JEENAH MOON)<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">In overturning that ruling, the 2nd Circuit panel said Crawford lacked jurisdiction over the case because it should have been resolved in immigration court first. The judges did not order Mahdawi&#8217;s re-arrest.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">US immigration courts, which conduct deportation proceedings, are overseen by the Justice Department. District courts like Crawford&#8217;s, by contrast, weigh constitutional issues and are independent of the executive branch.<\/p>\n<p class=\"article-paragraph-section article-body-paragraph\">The panel included two judges appointed by Trump in his first term and a third appointed by former President George W.
