{"id":95266,"date":"2025-07-26T23:17:42","date_gmt":"2025-07-26T23:17:42","guid":{"rendered":"https:\/\/www.europesays.com\/us\/95266\/"},"modified":"2025-07-26T23:17:42","modified_gmt":"2025-07-26T23:17:42","slug":"trump-administration-sues-new-york-city-over-sanctuary-city-laws-jurist","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/us\/95266\/","title":{"rendered":"Trump administration sues New York City over sanctuary city laws &#8211; JURIST"},"content":{"rendered":"<p>US President Donald Trump\u2019s administration <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-sues-new-york-city-over-sanctuary-policies\" rel=\"nofollow noopener\" target=\"_blank\">filed<\/a> a <a href=\"https:\/\/www.justice.gov\/ag\/media\/1408886\/dl?inline=&amp;utm_medium=email&amp;utm_source=govdelivery\" rel=\"nofollow noopener\" target=\"_blank\">complaint<\/a> against New York City, its mayor Eric Adams, and other city representatives and officials on Thursday over its <a href=\"https:\/\/www.nyc.gov\/assets\/immigrants\/downloads\/pdf\/nyc-detainer-laws.pdf\" rel=\"nofollow noopener\" target=\"_blank\">sanctuary city laws<\/a>, alleging they are unconstitutional and violate federal immigration enforcement statutes.<\/p>\n<p>Specifically, the Trump administration challenged <a href=\"https:\/\/codelibrary.amlegal.com\/codes\/newyorkcity\/latest\/NYCadmin\/0-0-0-1\" rel=\"nofollow noopener\" target=\"_blank\">New York City Administrative Code<\/a> \u00a7\u00a7 9-131, 9-205, 14-154, and 10-178, as well as New York City Police Department (NYPD) Operations Order No. 4. The administration requested a permanent injunction prohibiting their enforcement, alleging that the laws violate the <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artVI-C2-1\/ALDE_00013395\/\" rel=\"nofollow noopener\" target=\"_blank\">Supremacy Clause<\/a> of the US Constitution, the <a href=\"https:\/\/www.uscis.gov\/laws-and-policy\/legislation\/immigration-and-nationality-act\" rel=\"nofollow noopener\" target=\"_blank\">Immigration and Nationality Act<\/a>, and the <a href=\"https:\/\/www.congress.gov\/bill\/99th-congress\/senate-bill\/1200\" rel=\"nofollow noopener\" target=\"_blank\">Immigration Reform Act<\/a>.<\/p>\n<p>\u00a79-205 generally forbids the Department of Probation from honoring civil immigration detainers by holding a person beyond the time they would otherwise be released. \u00a79-131 and \u00a714-154 impose the same prohibitions on the Department of Corrections and the NYPD, in addition to generally prohibiting them from honoring civil immigration detainers by holding a person beyond the time they would otherwise be released.<\/p>\n<p><a href=\"https:\/\/codelibrary.amlegal.com\/codes\/newyorkcity\/latest\/NYCadmin\/0-0-0-6787\" rel=\"nofollow noopener\" target=\"_blank\">\u00a710-178<\/a> bars agencies from \u201csubject[ing] its officers or employees to the direction and supervision of the Secretary of Homeland Security primarily in furtherance of immigration enforcement\u201d and from using city resources for immigration enforcement. The administration stated that NYPD Operations Order No. 4 generally prohibits members and the department from assisting civil immigration enforcement.<\/p>\n<p>The Trump administration said that the US Constitution grants the federal government the <a href=\"https:\/\/constitution.congress.gov\/browse\/article-1\/section-8\/\" rel=\"nofollow noopener\" target=\"_blank\">power<\/a> to make naturalization laws, \u201cregulate Commerce with foreign Nations,\u201d and \u201ccontrol and conduct relations with foreign nations,\u201d and it <a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/artII-S3-3-6\/ALDE_00000103\/\" rel=\"nofollow noopener\" target=\"_blank\">requires<\/a> the US president to \u201ctake Care that the Laws be faithfully executed.\u201d The lawsuit asserted that the federal government has the power to make and enforce immigration laws based on such provisions and US Supreme Court precedent.<\/p>\n<p>The administration argued that NYC\u2019s sanctuary city laws, as immigration laws, are preempted by Congress\u2019s immigration laws under the Supremacy Clause. It also used Supreme Court precedents to argue that the sanctuary city laws violate the Supremacy Clause by discriminating against the United States and obstruct \u201cthe accomplishment and execution of the full purposes and objectives of Congress.\u201d<\/p>\n<p>The Department of Homeland Security has promulgated a <a href=\"https:\/\/www.ecfr.gov\/current\/title-8\/chapter-I\/subchapter-B\/part-287\" rel=\"nofollow noopener\" target=\"_blank\">regulation<\/a> requiring that when it issues an immigration detainer to a law enforcement agency, the agency \u201cshall maintain custody of the alien for a period not to exceed 48 hours, excluding Saturdays, Sundays, and holidays in order to permit assumption of custody by the Department.\u201d<\/p>\n<p>The administration is emphasizing that NYC\u2019s sanctuary city laws are threatening the safety of the public, federal officers, and the immigrants themselves by leaving illegal immigrants \u201cout in the street\u201d and making officers arrest them there rather than in a public jail. They also stress the \u201cconsiderable financial impact on ICE\u2019s operational costs [because now it] takes more time and more officers to effect arrests over the same number of aliens.\u201d<\/p>\n<p>Adams published the following <a href=\"https:\/\/x.com\/NYCMayor\/status\/1948512716064543043\/photo\/1\" rel=\"nofollow\">press statement<\/a> in response to the complaint:<\/p>\n<blockquote>\n<p>Keeping New Yorkers safe [means] making sure they feel safe \u2026 no one should be afraid to dial 911, send their kids to school, or go to the hospital, and no New Yorker should feel forced to hide in the shadows.
