A California doctor who ran as a Democrat for Congress used her patients\u2019 medical records to send out campaign propaganda during the 2026 midterm election, a lawsuit has claimed.<\/p>\n

The rest of the text allegedly \u201crepeats Dr. Sonia\u2019s credentials\u201d again and includes a link to the doctors campaign.<\/p>\n
It ends with a reminder to vote on June 2. Rose notes the phone number on the political ad is for Devgan-Kacker\u2019s campaign, not the clinic, according to the suit.<\/p>\n
\u201cIt\u2019s unclear why a message about the clinic\u2019s hours would need to come from a congressional campaign and not directly to clinic patients from the clinic itself,\u201d the papers read.<\/p>\n
They go on to say that the clinic admitted the campaign used patient records to send the text messages in an email sent to Rose on May 21.<\/p>\n

Rose started the email chain questioning if the texts were sent by the clinic, according to the suit.<\/p>\n
The clinic responded: \u201cIt appears that you were a patient at this urgent care a few years ago, which is how we have your phone number. The text message was sent to all previous patients,\u201d the email in the papers says.<\/p>\n
It also says the texts were sent out by a third party service used to send out text blasts.\u00a0 Later in the day Rose claims he was sent another email attempting to \u201cwalk back\u201d the clinic\u2019s response.\u00a0<\/p>\n
\u201cThis later email stated the outreach was geographically targeted to members of the local community and was not intended to identify or contact individuals based on patient status,\u201d the papers say.<\/p>\n

Rose disputes that claim, pointing out that when he went to the clinic he lived in District 26, where Devgan-Kacker was running, he has since moved to district 29.\u00a0<\/p>\n
\u201cIf Dr. Sonias\u2019 campaign was using the public voter data, it would have seen that Plaintiff is registered to vote in the 29th district,\u201d the papers say.<\/p>\n
The class action suit points to The California Confidentiality of Medical Records Act which states \u201cit prohibits health care providers from disclosing medical information relating to their patients without a patient\u2019s authorization.\u201d\u00a0<\/p>\n
