Mitch McConnell’s absence, the date Aug. 3 has been thrown around a lot.

Now that that day has come, Gov. Andy Beshear is weighing in on its significance, or lack thereof.

McConnell, 84, has been out of commission, not fulfilling Senate duties like casting votes, since he was hospitalized on June 14 in Washington D.C. His team said he suffered a fall.

Despite two photos provided by his office, he has not been publicly seen, leading to all kinds of theories about what’s going on with him, and whether he’ll be able to finish his term.

A law passed in 2024 stripped the governor from making special appointments for senators, defaulting the decision to a special election.

Kentucky’s constitution gives the governor power to appoint some vacancies or hold a special election depending on timing. That’s three months prior to the next general election, which in this case is Aug. 3.

However, that section is ambiguous, and its unclear whether that rule governs Senate vacancies specifically.

The 2024 state law says the deadline is 56 days prior to file candidate nominations for a special election, which in this case is Sept. 8.

So, there is some confusion on how the constitution and newer law interact with each other.

Beshear says the August date has “no legal impact” on his options for what to do should McConnell be unable to fulfill his term.

Beshear’s response:

This content is imported from facebook. You may be able to find the same content in another format, or you may be able to find more information, at their web site.

“I know there are a lot of folks wondering about the significance of August 3 regarding a potential Senate vacancy. I want everyone to know that this date has no legal impact on my options should there be a vacancy this year. Worth a reminder, right now, there’s one less vote for the SAVE Act, Trump’s war with Iran, or the potential replacement of a SCOTUS justice.”

Beshear has been publicly demanding more transparency from McConnell, calling for videos and even writing him letters.

Beshear’s latest letter to McConnell said he is prepared to challenge how to fill his seat should it be vacated early for any reason.

But right now, there’s no vacancy.

Beshear challenges Aug. 3 theory about potential McConnell vacancy LOUISVILLE, Ky. — On the topic of Sen.
