A 24-year-old man was arrested on an aggravated battery charge after police said he kicked an officer who was called because the man refused to leave a Jacksonville business.<\/p>\n
Police responded at 12:55 p.m. Tuesday to Cricket Wireless at 940 W. Morton Ave. to a report of a man who seemed confused refusing to leave.<\/p>\n
The man pulled away from an officer escorting him out of the store and kicked the officer, according to a police report.<\/p>\n
Lucas A. Magelitz, 24, who is listed as homeless, was arrested on charges of resisting a peace officer and aggravated battery involving a peace officer. Aggravated battery typically is a Class 2 felony when it involves a police officer in performance of their duties, according to state statutes.<\/p>\n
Magelitz was booked into Morgan County Detention Facility and later released under state pre-trial detention guidelines, according to jail records.<\/p>\n
