Being in the country without valid visa or permission makes you subject to deportation. This is the same in every country on earth.
Did any of the 73% with no conviction have a visa? If not that’s a conviction right?

Couldn’t find similar numbers for America but I’m going to hazard a guess the proportion is similar.
